AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE
CITY CODE, SECTION 11-1-6, RELATING TO VOTING BY THE PLANNING AND
ZONING COMMISSION; REPEALING ANY CONFLICTING PROVISIONS; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL AS FOLLOWS:
Section 1:City Code, Section 11-1-6 Voting shall be amended to read
as follows:
Sec. 11-1-6 Voting
Five voting members shall constitute a quorum.A simple majority of
the quorum voting shall be required for passage of any matter before
the commission.The minutes of the meetings shall reflect the "ayes"
and "nays" cast on a particular measure and shall reflect the vote of
each member present.A member may abstain from voting only upon a
declaration that he has a conflict of interest, in which case such
member shall take no part in the deliberations on the matter-in question.
Section 2:All ordinances and parts of ordinances in conflict with
the provisions of this ordinance or any part of the code adopted herein
by reference, are hereby repealed.
Section 3:If any section, subsection, sentence, clause, phrase or
portion of this ordinance or any part of the code adopted herein by
reference, is for any reason held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions thereof.
Section 4:Whereas, it is necessary for the preservation of the peace,
health and safety of the City of Apache Junction, Arizona, an emergency
is declared to exist, and this ordinance shall become immediately
operative and in force from and after the date of posting hereof.
PASSED AND ADOPTED by the Mayor and Common Council of the City of Apache
Junction, Arizona, this 16th day of January , 1980.
APPROVED this 16th day of January , 1980, by the
affirmative vote of three fourths of the members of the Common
Council of the City of Apache Junction, Arizona.
