AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING SECTION
439 OF THE ZONING ORDINANCE; REPEALING ANY CONFLICTING PROVISIONS;
PROVIDING FOR SEVERABILITY: AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL AS FOLLOWS:
Section 1:The Zoning Ordinance, Section 439 "LOT" shall be amended
to read as follows:
"Sec. 439 LOT:An area or parcel of land under one ownership
abutting upon at least one (1) street at the time of adoption
of this ordinance."
Section 2:All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the code adopted herein by
reference, are hereby repealed.
Section 3:If any section, subsection, sentence, clause, phrase or
portion of this ordinance or any part of the code adopted herein by
reference, is for any reason held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions thereof.
Section 4:Whereas, it is necessary for the preservation of the peace,
health and safety of the City of Apache Junction, Arizona, an emer-
gency is declared to exist, and this ordinance shall become immediately
operative and in force from and after the date of posting hereof.
PASSED AND ADOPTED by the Mayor and Common Council of the City of
Apache Junction, Arizona, this 16th day of -.January 1980.
