AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA,
AMENDING CHAPTER 2 BY ADDING ARTICLE 2-9 ESTABLISHING AN
AIRPORT COMMISSION, PROVIDING FOR APPOINTMENT TO THE
COMMISSION AND POWERS AND DUTIES OF THE COMMISSION;
PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES;
PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
APACHE JUNCTION as follows:
SECTION 1

Section 2-9-1 Creation
An Airport Commission of the City of Apache
Junction, Arizona is hereby created.
Section 2-9-2 Membership and Terms of Office
A.The Airport Commission shall consist of five
(5) members who shall be appointed by the Mayor and approved
by the City Council.Ex officio members, without voting
privileges, may be designated by the Mayor with approval of
the City Council.At least one ex officio member may be
designated from outside the City limits of the municipality.
B.The appointments shall be for three (3) years
each with the terms of members so staggered that the terms
of no more than two (2) members shall expire in any one
year.The initial appointments of members shall be for two
(2) members with terms beginning upon their appointment and
expiring March 1, 1981, two (2) members with terms beginning
upon their appointment and expiring March 1, 1982; one (1)
member with a one year term beginning upon his appointment
and expiring March 1, 1983.Thereafter, they shall all
serve for a term of three (3) years or until their
successors are duly appointed and qualified.Honorary
members shall serve for a term not to exceed one (1) year.
C.All members shall be residents of the City of
Apache Junction except as otherwise provided for ex officio
members.
Section 2-9-3 Salaries and. Personal Expenses
The members of the City of Apache Junction Airport
Commission shall receive no salaries or other remuneration
for their services in such capacity, and shall not be
entitled to personal expenses incurred by them in the
discharge of their official duties, except to the extent and
purposes and amount such expense is first authorized and
approved in advance by Common Council.
Section 2-9-4 Officers
The Commission shall elect a Chairman,
Vice -Chairman, and Secretary from its members to serve for a
period of one (1) year.The Vice -Chairman shall preside at
meetings in the absence of the Chairman.
Section 2-9-5 Rules of Procedure; Power and Duties
There is hereby vested in the City of Apache
Junction Airport Commission full power and authority for,
and on behalf of the City of Apache Junction, Arizona, to
represent said City in any and all negotiations with
individuals, -corporations, associations, Governmental
agencies, etc for the development and promotion of
commerce by air in the Counties of Pinal and Maricopa and
especially the City of Apache Junction, Arizona.The
Director of Public Works shall review all the Commission's
recommendations and shall submit his recommendations to the

Council.No contracts or other commitments shall be deemed
to have been entered into or made, except in compliance with
the provisions of Article 3-7 of this Code.
Section 2-9-6 Meetings
The Commission shall establish a regular meeting
day and time at least once a month.Special meetings may be
called as required.A quorum shall consist of four (4)
voting members for the transaction of all business.
Section 2-9-7 Vacancies
Vacancies shall be filled in accordance with
Section 2-9-2 by the City Council for the unexpired term of
the member affected.
Section 2-9-8 Removal of Members
Members of the Commission serve at the pleasure of
the Council and may be removed by the Mayor with the
concurrence of the Council.A member shall not be absent
from the Airport Commission's meetings for more than three
(3) consecutive times.After the absence of three (3)
consecutive meetings, the remaining members of the Airport
Commission shall vote to retain or recommend to the City
Council that the absentee member be relieved of his duties
on the Commission.
SECTION 2 REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict
with the provision of this ordinance or any part of the Code
adopted herein by reference are hereby repealed.
SECTION 3 SEVERABILITY
If any section, subsection, sentence, clause,
phrase or portion of this ordinance or any part of the code
adopted herein by reference, is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.
