AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, AMENDING CHAPTER 13, ARTICLE 13-2,
APACHE JUNCTION CITY CODE, BY ADDING SECTION 13-2-3
PERTAINING TO STREET IMPROVEMENTS, THE ADOPTION OF A
STREET CLASSIFICATION PLAN, REQUIRING THE DEDICATION AND
IMPROVEMENT OF RIGHTS -OF -WAY PRIOR TO THE ISSUANCE OF
BUILDING PERMITS, PROVIDING FOR THE ADOPTION BY
REFERENCE OF THE MARICOPA ASSOCIATION OF GOVERNMENTS
STANDARD DETAILS AND SPECIFICATIONS, PROVIDING FOR
PENALTIES, PROVIDING FOR SEVERABILITY, PROVIDING FOR THE
REPEAL OF CONFLICTING ORDINANCES.
BE IT ORDAINED BY THE MAYOR AND COMMON CbUNCIL OF
THE CITY OF APACHE JUNCTION, ARIZONA AS FOLLOWS:
Section I In General
Section 13-2-3 Street Improvements
A.A "Street Classification Plan" is hereby
adopted in a manner and form annexed hereto and made a part
of this Article by reference, said plan to be kept on file
in the office of the City Clerk.
B.It shall be a condition precedent to the
issuance of a building permit for new construction within
the City that the required street right-of-way dedications
and improvements be made as set forth in the street
classification plan of the City of Apache Junction.
C.The Director of Public Works may waive the
required improvements for individual single family
construction prior to the issuance of a building permit
provided that the applicant enters into an agreement to
participate in an improvement district for the purpose of
street improvements.
D.All street improvements shall be constructed in
accordance with the Maricopa Association of Government
Standard Details and Specifications, 1979 edition which
standard details and specifications shall be the standards
of design and construction for the City, provided however,
that the Director of Public Works may revise, delete or add
standard details and specifications by supplement and
addendum as may be required.
Section II Penalties
Any person found guilty of violating any provisions
of this ordinance shall be guilty of a misdemeanor, and upon
conviction thereof shall be punished by a fine not to exceed
$300 or imprisonment for a period of not to exceed three
months, or by both such fine and imprisonment.Each day
that a violation continues shall be a separate offense
punishable as hereinabove described.
Section III Repeal of Conflicting Ordinances
All ordinances and parts of ordinances in conflict
with the provisions of this ordinance or any part of the
Code adopted herein by reference are hereby repealed.
Section IV Severability
If any section, subsection, sentence, clause,
phrase or portion of this ordinance or any part of the Code
adopted herein by reference is for any reason held to be
invalid or unconstitutional by the decision of any Court of
competent jurisdiction, such decision shall not affect the
validity of-the remaining portions thereof.
