AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA
ADDING ARTICLE 2-8, PARKSAND RECREATION COMMISSION, TO
THE CITY CODE; ESTABLISHING THE APACHE JUNCTION PARKSAND
RECREATION COMMISSION; PROVIDING FOR APPOINTMENT TO THE
COMMISSION AND POWERS AND DUTIES OF THE COMMISSION;
PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES;
PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF
APACHE JUNCTION AS FOLLOWS:

A Parks and Recreation Commission of the City of
Apache Junction is hereby created.
Section 2-8-2 MEMBERSHIP AND TERMS OF OFFICE
A.The Park3and Recreation Commission shall
consist of nine (9) members who shall be appointed by the
Mayor and approved by the City Council.Ex Officio members,
without voting privileges, may be designated by the Mayor
with the approval of the City Council.
B.The initial appointments of members shall be
as follows:three (3) members with terms beginning upon
their appointment and expiring April 1, 1981, three (3)
members with terms beginning upon their appointment and
expiring April 1, 1982, three (3) members with terms
beginning upon their appointment and expiring April 1, 1983.
Thereafter, Commission members shall all serve for a term of
three (3) years or until their successors are duly appointed
and qualified, and terms of members shall be so staggered
that the terms of no more than three (3) members shall
expire in any one year.Ex Officio members shall serve for
a term not to exceed one (1) year.
C.All members shall be residents of the City of
Apache Junction.
Section 2-8-3 SALARIES AND PERSONAL EXPENSES
The members of the Parks and Recreation Commission
shall receive no salaries or other remuneration for their
services in such capacity, and shall not be entitled to
personal expenses incurred by them in the discharge of their
official duties, except to the extent and purposes and
amount such expense is first authorized and approved in
advance by the City Council.
Section 2-8-4 OFFICERS
The Commission shall elect a Chairman, Vice
Chairman and Secretary from their members to serve for a
period of one (1) year.The Vice Chairman shall preside at
meetings in the absence of the Chairman.
Section 2-8-5 MEETINGS
The Commission shall establish a regular meeting
day and time at least once a month.Special meetings may be
called asrequired,.A quorum shall consist of five (5)
voting members for the transaction of all business.
Section 2-8-6 VACANCIES
Vacancies shall be filled by the City Council in
accordance to Section 2-8-2 for the unexpired term of the
member affected.
Section 2-8-7 REMOVAL OF MEMBERS
Members of the Commission serve at the pleasure of
the Council and may be removed by the Mayor with the
concurrence of the Council.A member shall not be absent
from Parks and Recreation Commission regular meetings for
more than three (3) consecutive times without a reasonable
excuse.After the absence of three (3) consecutive meetings
the remaining members of the Parksand Recreation Commission
shall vote to retain or recommend to the City Council that
the absentee member be relieved of his duties on the
Commission.
Section 2-8-8 DUTIES
The Commission through the Director of Public Works
shall recommend regulations and policy for the government,
control and improvement of the public parks of the City of
Apache Junction.The.Commission shall also recommend fees
for the use of public park facilities and recommend full
time or seasonal employees as necessary for the efficient
management of the City Parks and Recreation Program.
SECTION 2 Repeal of Conflicting Ordinances
All ordinances and parts of ordinances in conflict
with the provisions of this ordinance or any part of the
Code adopted herein by reference are hereby repealed.
SECTION 3 Severability
If any section, subsection, sentence, clause,
phrase or portion of this ordinance or any part of the code
adopted herein by reference, is for any reason held to be
invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions thereof.
