AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, EXTENDING AND
INCREASING THE CORPORATE LIMITS OF THE CITY OF APACHE JUNCTION, ARIZONA,
INTO FINAL COUNTY, STATE OF ARIZONA, PURSUANT TO THE PROVISIONS OF
TITLE 9, CHAPTER 4, ARTICLE 7, ARIZONA REVISED STATUTES AND AMENDMENTS
THERETO, BY ANNEXING THERETO CERTAIN TERRITORY PREVIOUSLY UNINCORPOR-
ATED AND CONTIGUOUS TO THE EXISTING CITY LIMITS OF THE CITY OF APACHE
JUNCTION, ARIZONA, REPEALING ANY CONFLICTING PROVISIONS AND PROVIDING
FOR SEVERABILITY.
WHEREAS, a written petition has been presented to the Mayor and
City Council members of the City of Apache Junction, Arizona, signed
by the owners of more than one-half in value of the real and personal
property in Section 32, Township 1 North, Range 8 East, Gila and Salt
River Basin and Meredian, as would be subject to taxation by the City
of Apache Junction, Arizona, in the event of annexation within the
territory and land hereinafter described as shown by the last assess-
ment of said property, which said territory is contiguous to the
City of Apache Junction, Arizona, so as to embrace the same; and
WHEREAS, the Mayor and City Council of the City of Apache
Junction, Arizona, are desirous of complying with said petition and
extending and increasing the corporate limits of the City of Apache
Junction, Arizona, to include said territory; and
WHEREAS, it will be to the benefit of the City of Apache Junction,
Arizona, to establish the zoning in the vicinity of the proposed
Superstition Freeway in Section 32, immediately south of the City; and
WHEREAS, the rest of Section 32 is State Trust properties having
no real or personal property valuation subject to taxation; and
WHEREAS,the State Land Department has stated by letter:
"we neither protest nor take a position of
advocacy for annexation";
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL
That the following described territory be, and the same hereby
is, annexed to the City of Apache Junction, Arizona, and that the
present corporate limits be, and the same hereby are, extended and
increased to include the following described territory contiguous
to the present City limits, to wit:

A parcel of land being all of Section 32, Township 1 North,
Range 8 East, G&SRB&M, Pinal County, Arizona.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
_All ordinances and parts of ordinances in conflict with the provisions
of this ordinance or any part of the code adopted herein by reference,
are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, clause, phrase or portion
of this ordinance or any part of the code adopted herein by refer-
ence, is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall
not affect the validity of the reamining portions thereof.
PASSED AND ADOPTED by the Mayor and Common Council of the City of
Apache Junction, Arizona, this 7th day of may 1980.
