June 20, 1979
A regular meeting of the City Council of Apache Junction was held on the 20th
day of June at the Apache Junction City Hall, pursuant to notice as required
by law.
The meeting was called to order at 7:00 p.m. by Mayor Virginia Seeman.
The Pledge of Allegiance was led by Vice -mayor John Granillo.
Invocation was presented by Marie Shanks.
Councilmembers present
Mayor Virginia Seeman, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano,
Jimmy Eidson, Norman Hill and Marie Shanks.
Staff present
Susan Goodwin, City Attorney; and Isabel C. Ballard, City Clerk
Mayor Virginia Seeman asked Marie Shanks to read the Public Hearing Resolution
No. 79-12 which was included with the agenda packet.
City Code Hearing
Marie Shanks presented Cathy Connolly from the League of Arizona Cities and
Towns and Mr. Hdnk Brock from Pinal County Animal Control Center to review the
City Code section by section to discuss and make changes in any of them.
Sec 6-2-6 Redemption of Animals was changed to read from 5 days to 72 hours.
Unredeemed Animals was changed to read from 5 days to 72 hours.
Impoundment fees were discussed.
Planning and Zoning - Section 11-1-6 -Voting
Thomas Damiano asked to change to "four voting members shall constitute a
quorum.A simple majority shall be required for passage of any matter before
the commission".Committees and Commissions, Section 2-4-7 changed to add "No
employee or appointed office of the City may serve as a voting member of any
such committee or commission".
Mayor Virginia Seeman reviewed chapter by chapter of the City Code and asked
for questions on each chapter.
Mr. Joe Saggio raised a question on Section 2-4-7 and asked if Section 2-4-7 was
necessary to be added and why this is included in the rule and why should
employees be forbidden to participate and made reference to Mr. Norman Teason
who, as an elected official, served for many years as Justice of the Peace
and also served on the Planning and Zoning Commission.
Vice -mayor John Granillo explained the reason to avoid future conflict the
Commission might feel because people who work for the City they might feel they
have to vote in favor of the City. Marie Shanks further explained this was
being done to avoid conflict of interest between employees and committees.
Mr. Saggio said he applied for a City position and felt this item was tailored
to suit his situation.

Chapter 3 - Administration - no comments or changes.
Chapter 4 - Police- no comments or changes.
Chapter 5- Magistrate Court- no comments or changes.
Chapter 6- Animals -
Question was asked by Mr. Earl Laabs if any provisions were made about animals
tied and not fed or watered for several days. Mr. Hank Brock told Mr. Earl
Laabs the state statute and the county ordinances pertained to this and are
enforced.This code is merely a part of the statute.
Chapter 7- Building Code - no comments or changes.
Chapter 8- Business Section 8-1-6.
A question was asked if this covered just the City or what areas of Apache
Junction.Cathy Connelly responded that it covers the 12 square miles of
Apache Junction and there are provisions in the state law for a person selling
produce or agricultural products cannot be regulated by any law, and if they
are selling their own produce they are not in violation of any zoning and cannot
be regulated by the City.
Chapter 9 - Health and Sanitation - no comments or changes.
Chapter 10 - Offenses
Question was raised on off -the -road motorbikes.Cathy Connelly responded it
has been proposed and is being worked on by other cities to require a rider to
have written permission on his or her person to ride on that property.There
are problems involved, however, in that a police officer has to stop each
_person and ask if he has permission to ride on the property as well as being
an enforcement problem.Cathy Connelly will check on this further and send
information from other cities.
Discussion on this topic included motorbikes as fire hazards, noise pollution
etc.Mr. Hank Brock said he had discussed the problem of motorbikes with the
Pinal County Board of Supervisors regarding fire hazards, etc.
Priscilla Gardner said she had already formed a petition against motorbikes on
private property and the police department can't do anything about it.
Mr. John Lapin suggested getting state land for motorbikes and had talked to
Mr. James Karam and Mr. Karam said he would be glad to work with the Council
on this item.
Chapter 11 - Planning and Zoning - corrections were made on Voting.
Chapter 12 - Traffic - no comments or changes.
Mayor Virginia Seeman asked if there were no further comments, the City Code
Hearing for Apache Junction is closed and stated City Code books are available
in the City Hall if anyone desires to see them.

Approval of Minutes
Regular Meeting - June 6, 1979
Marie Shanks made a motion to approve the minutes of the Regular Meeting of
June 6, 1979 as correct, seconded by Vice -mayor John Granillo. Motion carried
unanimously.
Special Meeting - June 11, 1979
Marie Shanks made a motion to approve the minutes of the Special Meeting of
June 11, 1979 as correct, seconded by Jerry Burgess. Six (6) voted yes.Marie
Shanks, Norman Hill, Jimmy Eidson, Thomas Damiano, Jerry Burgess and Mayor
Virginia Seeman. One (1) abstained, Vice -mayor John Granillo. Motion carried.
Special Meeting - June 13, 1979
Corrections were made on the Animal Control Contract and National Municipal
Membership.Jimmy Eidson made a motion to approve the minutes as corrected of
June 13, 1979, seconded by Vice -mayor John Granillo. Motion carried unanimously.
Marie Shanks made a motion to amend under the Imput from the Floor on Board of
Adjustment Legal Statis, seconded by Norman Hill. Motion carried unanimously.
Council Action
Auditor Bid
Mayor Seeman reported on sending out request for bids for an auditor and called
on the City Clerk to explain the requirements.
City Clerk, Isabel Ballard, explained Arizona State Law requires an annual
audit and the City Council needs to set up a Chart of Accounts and an auditor
is needed to set up a good audit trail.It is most important to start out v
correctly with this service.After receiving the application from Mr. John
Naylor, vice -mayor John Granillo made a motion to approve John H. Naylor as
Certified Public Accountant, seconded by Marie Shanks.Motion carried
unanimously.
Additional Council Meeting Dates
Mayor Virginia Seeman said it is necessary for the City Council to schedule
additional meetings and are as follows:
Work Session -Budget Preparation - July 2 at 6:00 p.m.
Special Meeting - Budget Hearing - July 11 at 7:00 p.m.
Executive Session - Personnel - July 5th and July 18th at 6:00p.m.
Executive Session - June 27th at 7:00- time changed to 6:00p.m.
All meetings are to be followed with regular or special meetings.
A motion was made by Marie Shanks to accept the proposed meeting dates as
specified and seconded by Thomas Damiano. Motion carried unanimously.

TAP Program
Norman Hill reviewed the TAP Program and Susan Goodwin read Resolution
No. 79-26, A Resolution of the City Council of Apache Junction to authorize
the Mayor to enter into Arizona Department of Transportations Transportation
Action Program.
City Clerk, Isabel Ballard, explained the way to get on the program is to write
a letter with the Resolution and because there is a waiting list for other
cities it may take about a year before they get to Apache Junction.Motion
was made by Norman Hill to adopt Resolution No. 79-26, seconded by Vice -mayor
John Granillo.Motion carried unanimously.
Employment
A motion was made by John Granillo to ratify the appointment of Althea Nunn
and Sharon Seder to secretarial positions which appointments were made by the
City Clerk pursuant to the City Councils delegation of authority and that the
secretaries shall be governed by the city's personnel policies when adopted
and seconded by Marie Shanks.Motion carried unanimously.
Topics for Discussion and Reports
Budget and Finance
Vice -mayor John Granillo reported on the budget set with Cathy Connolly and
the City Clerk.
Planning and Zoning
Thomas Damiano reported on the Planning and Zoning Advisory Committee Meeting
held Tuesday evening and people to serve on the Committee were to be contacted
to meet Monday, June 25th, at 7:00 p.m.
Police and Fire
Jimmy Eidson reviewed the letter from the Fire Board and asked the Council to
study this consideration regarding the Apache Junction Fire Department
District Resolution to be placed on the Wednesday, June 27th agenda.
Streets and Right -of -Way
Norman Hill reported on the air conditioning and septic tank prices for the
mobile units.There are state laws regarding mobile units and are state
approved.City Clerk, Isabel Ballard reported if we purchase a mobile unit
and change it into an office we would have to go to the State and get plans
approved per their specifications before proceeding with the modifications.
Vice -mayor John Granillo directed that we could go to the manufacturer and get
state approved plans.
Magistrate/Policies/Animal Control
Marie Shanks reported the building contract will be coming up from the Board
of Supervisors Monday, June 25th and all was going well.Marie Shanks further
reported she is working on a new agenda format for Planning and Zoning to
expedite the meetings, on a consent agenda.

Announcements
Mayor Virginia Seeman announced the Town Meeting June 28, 1979.
Isabel Ballard said the committee decided to have the meeting at 7:00 p.m.
rather than 6:00 p.m. to get more people out.
Mrs. Ruby Forsberg of the Chamber of Commerce said their meeting is the same
night as the Town Meeting and a 6:00 p.m. supper meeting will be held at the
Elks and extended an invitation to everyone to attend.
Mayor Virginia Seeman reported a CAAG Workshop on Public Speaking will be
held Friday June 22nd and will be attending this meeting with Marie Shanks and
Isabel Ballard.
Input from the Floor
Dr. Dave Robinson spoke on the airport proposal. He has served as chairman
of the Airport Board Committee on the Chamber of Commerce and expects to hear
from the FAA by July 15th regarding the proposal and would like to work closely
with the City.Procedures have been done and presented and stated the field
is to be located in the area of the city dump and the City should plan to
annex to take in the field in the future.
Mr. Drummond also spoke on the airport proposal and said that 91.6% are federal
funds, the state funds are 5% and the City funds would be 3.4%. He feels
the City should basically run the airport, coordinated by the City and with
City approval.
