AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION ZONING ORDINANCE BY AMENDING SECTION
2503 PUBLIC HEARINGS;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR
SEVERABILITY;AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AS FOLLOWS:
SECTION I .IN GENERAL
The Zoning Ordinance,SECTION 2503 PUBLIC HEARINGS,shall be amended
to read as follows:
"SECTION 2503 PUBLIC HEARINGS:Upon receipt of the application,
in proper form,the Board of Adjustment shall proceed to
hold a public hearing on the application at which all
persons whose property is affected,and the general
public,shall be given an opportunity to be heard.
Notice of time and place of the hearing,including a
general explanation of the matter to be considered and
including a general description of the area,shall be
given at least fifteen (15)days before the hearing in
the following manner:
Publication of the notice at least once in a newspaper of
general circulation in the City of Apache Junction;
posting the notice in conspicuous places close to the
property affected;and by depositing in the United States
mail notices thereof addressed to -the last owners as shown
on the list submitted by the applicant under the pro-
visions of Section 2501(c)of this Ordinance.
SECTION II.REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance or any part of the Code adopted herein by reference,are
hereby repealed.
SECTION III.PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause or portion of this
Ordinance or any part of the Code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portions thereof.
SECTION IV.EMERGENCY CLAUSE
WHEREAS,i t is necessary for the preservation of the peace,health and
safety of the City of Apache Junction,Arizona,an emergency is declared
to exist,and this Ordinance shall become immediately operative and in
force from and after the date of posting hereof.
