June 27, 1979
A special meeting of the City Council of Apache Junction was held on the
27th day of June, 1979 at the Apache Junction City Hall, pursuant to notice
as required by law.
An executive session was held from 6:00 to 7:15 p.m..
The Special Meeting was called to order at 7:15 by Mayor Virginia Seeman.
Invocation was presented by Marie Shanks.
The Pledge of Allegiance was presented by Vice -mayor John Granillo.
Councilmembers present
Mayor Virginia Seeman, Vice -mayor John Granillo, Thomas Damiano, Jimmy
Eidson, Norman Hill and Marie Shanks.

Feddral Revenue Sharing Hearing on Expenditures
Mayor Seeman called on Isabel Ballard to report. City Clerk, Isabel
Ballard, reported there must be a public hearing prior to spending any
federal revenue funds and we are expecting $46,000 to $50,000 possibly in
April, 1980.The Council decided the majority of the money should be spent
specifically for the city hall building. Marie Shanks made a motion to allow
the funds received from the federal government to go toward the City Hall
Building Fund, seconded by Vice -mayor John Granillo.Motion carried unanimously.
Council Action
Adoption of City Code
Mayor Virginia Seeman announced public hearings were held on the City Code
and Planning and Zoning Codes.Attorney Susan Goodwin read Resolution No.
79-27 to take effect at 12:01 a.m. July 1, 1979.

ARIZONA DECLARING AS A PUBLIC RECORD THAT CERTAIN DOCUMENT FILED WITH THE
CITY CLERK AND ENTITLED THE CODE OF THE CITY OF APACHE JUNCTION, ARIZONA AND
DECLARING AN EMERGENCY."
Vice -mayor John Granillo made a motion to adopt Resolution No. 79-27, seconded
by Marie Shanks. Motion carried unanimously.
Susan Goodwin read Ordinance No. 7 as follows:
AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA, ADOPTING "THE CODE OF
THE CITY OF APACHE JUNCTION, ARIZONA" BY REFERENCE, PROVIDING PENALTIES FOR
THE VIOLATION THEREOF, AND DECLARING AN EMERGENCY.
"Any person found guilty of violating any provisions of this Code shall be
guilty of a misdemeanor and upon conviction thereof shall be punished by a
fine of not to exceed $300 or by imprisonment of not to exceed three months
or both such fine and imprisonment.Each day that a violation continues shall
be a separate offense punishable as herein and above described.

Marie Shanks made a motion to adopt by reference Ordinance No. 7, seconded
by Thomas Damiano.Motion carried unanimously.
Adoption of Planning and Zoning
The Mayor and Council discussed the Planning and Zoning Ordinance and
revisions were made as follows:
Section 2704 - Contractor's License
Except for applicant exempt from the provisions of ARS Title 32, chapter 10,
each applicant for a permit shall file a signed statement that the applicant
is currently licensed under the provisions of Title 32, chapter 10, and shall
provide his license number.If the applicant is exempt the statement shall
contain the basis of the asserted exemption and the name and license number
of any general mechanical, electrical or plumbing contractor who will be
employed on the work.

Section 2709
C.Buildings legally under construction with a Building or Use Permit, issued
by the Pinal County Planning and Zoning Commission prior to the effective
date of this Ordinance, and the exterior walls of which have been completed to
the plate line or beyond, shall not be required to secure a City Building
Permit but the City shall require that buildings shall be structurally safe
and conform to pertinent County zoning regulations in effect at the time the
County permit was issued.
F.Any use or activity conducted contrary to County Zoning regulations at
the effective date of this Ordinance and not constituting a nonconforming use
under the County zoning regulations shall not be considered a conforming
use and the continuance thereof shall constitute a violation of this ordinance.
Motion was made by Thomas Damiano to adopt the changes and additions to the
proposed ordinance, seconded by Vice -mayor John Granillo. Motion carried
unanimously.
CR-3 - Buildable Area
Susan Goodwin explained CR-3 zoning as suggested through Palm Springs Home-
owners and applicable throughout the city and it would have restrictions on

building size.Provisions would be for exterior building security lighting,
restriction on fencing or hedge lines, and restriction on new construction.
After a lengthy council discussion, Norman Hill made a motion to reject the
Palm Springs Homeowners Association CR-3 recommendations and not include
them in the Zoning Ordinance, seconded by Marie Shanks. Five (5) voted
yes - Mayor Virginia Seeman, Vice -mayor John Granillo, Jimmy Eidson, Norman
Hill and Marie Shanks.Thomas Damiano abstained.
Susan Goodwin read RSOLUTION NO. 79-28:
RESOLUTION MADE BY THE MAYOR AND THE COMMON COUNCIL OF APACHE JUNCTION,
ARIZONA DECLARING THIS A PUBLIC RECORD THAT CERTAIN DOCUMENT FILED WITH
THE CITY CLERK AND ENTITLED "APACHE JUNCTION CITY ZONING ORDINANCE" AND
DECLARING AN EMERGENCY."
Vice -mayor John Granillo made a motion to accept Resolution No. 79-28 as
read, seconded by Norman Hill.Motion carried unanimously.
Susan Goodwin read ORDINANCE NO. 8 as follows:
ORDINANCE NO. 8:AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA,
ADOPTING "APACHE JUNCTION CITY ZONING ORDINANCE" BY REFERENCE, PROVIDING
PENALTIES FOR THE VIOLATION THEREOF, AND DECLARING AN EMERGENCY.
Any person, firm or corporation, whether it is principle, owner, agent,
tenant, employee or otherwise who violates any provision of this ordinance
or violates or fails to comply with any order or regulation made hereunder
shall be guilty of a misdemeanor and upon conviction thereof shall be punishable
by a fine of not more than $300 or by imprisonment for a period of not
exceeding three months, or by both imprisonment and fine. Each days'
continuation of such violation shall be guilty of a separate offense.
Motion was made by Norman Hill to adopt Ordinance NO. 8, seconded by Vice-
mayor John Granillo.Motion carried unanimously.
Adoption of Personnel Policies
Marie Shanks read Resolution No. 79-29:
A RESOLUTION OF THE MAYOR AND THE COMMON COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA ADOPT THAT CERTAIN DOCUMENT FILED WITH THE CITY CLERK,
ENTITLED PERSONNEL POLICIES OF APACHE JUNCTION AND DECLARING AN EMERGENCY.
Motion was made by Marie Shanks to adopt Resolution No. 79-29, seconded
by Thomas Damiano. Motion carried unanimously.
Bids on Mobile Units
Vice -mayor John Granillo read the mobile unit bids from Edgewood Leasing V/
and Modulaire as prepared by Mr. Cookie Parks.Mr. Parks was asked if this
could be purchased on a lease -purchase basis and Mr. Parks answered he thought
all companies involved either wanted to lease or sell the units.Motion was
made by Vice -mayor John Granillo to rent from Modulaire in Phoenix the specified
unit, seconded by Jimmy Eidson.After discussion on the matter vice -mayor
John Granillo then withdrew the motion to rent the mobile unit and made a
motion to purchase from Modulaire the 12 X 60 unit for office use for a cost
of $14,400, seconded by Norman Hill. Motion carried unanimously.

Reopening of Advertisement for Planning Director
Mayor Virginia Seeman reported enough

Insurance Consultant

Susan Goodwin reported the City some time ago retained the firm of Fred S.
JamesCo. to have adequate insurance coverage for the City by July 1, 1979
which has been done and the proposal offered by the Fred S. James Co., if an
additional $500 is paid they will include the entire next year or from July
1, 1979 to June 30, 1980.Mr. Bob Molenaro, a representative from the Fred
S. James Co. (Insurance Consultants) reported that sixteen insurance bids
were reviewed by his firm and the most complete bid was submitted by Carr-
White Insurance, and he felt that within the next six to twelve months the
insurance needs will change eradically. He felt the additional time to June
30, 1980 will provide an update on insurance needs throughout the year.
Susan Goodwin read Resolution No. 79-30.
A RESOLUTION OF THE CITY COUNCIL OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE
MAYOR OF THE CITY TO ENTER INTO AN AGREEMENT FOR THE EMPLOYMENT OF AN
INSURANCE CONSULTANT.
Motion was made by Thomas Damiano to accept Resolution No. 79-30, seconded
by Vice -mayor John Granillo. Motion carried unanimously.
Letter from Fire Department
Jimmy Eidson made a motion to write a letter to the Pinal County Board of
Supervisors disclaiming in advance any portion of the auto lieu tax funds that
might have gone to the city, and ask that it be forwarded to the Fire District.
Five (5) voted yes, Vice -mayor John Granillo, Thomas Damiano, Jimmy Eidson,
Norman Hill and Marie Shanks. One (1) abstained, Mayor Virginia Seeman.
Motion carried.
Special Meetings and Executive Sessions
Mayor Virginia Seeman reported a special meeting and executive session for
July 25, 1979 at 6:00 p.m.Motion was made by Vice -mayor John Granillo to
hold this meeting July 25, 1979 at 6:00 p.m., seconded by Thomas Damiano.
Motion carried unanimously.
Mayor Virginia Seeman announced a special meeting to be held Saturday, June
30, at 7:30a.m. to appoint an acting Zoning Administrator.Mayor Virginia
Seeman turned meeting over to Vice -mayor John Granillo and made a motion to
hold this meeting Saturday, June 30 at 7:30 a.m., seconded by Thomas
Damiano. Motion carried unanimously.

Executive Committee:
Marie Shanks reported a screening committee has been set up to review City
Manager applications.
Budget and Finance:
Vice -mayor John Granillo reported meeting with Cathy Connelly on the budget
and will have a budget to present to the Council.
Parks and Recreation
Isabel Ballard reported for Jerry Burgess that another $50.00 has been
received from Mr. Cookie Parks for the Swimming Pool Fund.
Planning and Zoning
Thomas Damiano reported Mr. Iry Hill would like to be removed from the
Planning and Zoning Commission and placed on the Board of Adjustment and Mr.
Joe Jessamine who is presently on the Board of Adjustment would like to serve
on the Planning and Zoning Commission. The Planning and Zoning Commission
met Tuesday night and could not select a committeemen or chairman among
them because Mr. Hill and Mr. Strange were absent.The City Council suggested
Mr. Hill submit a letter of resignation since he would be out of town much of
the time anyway and could not serve.The Ordinance states the Mayor appoints
and the Council approves these people effective July 1, 1979. Marie Shanks
placed Mr. Joe Barroco on the list to serve on the Board of Adjustment as a
replacement for Mr. Hill.
Vice -mayor John Granillo made a motion to create a list of people before
Saturday morning when they will next be meeting and have this list available
by Friday, June 30 at 5:00 to give the Mayor time to appoint a person from,
seconded by Norman Hill.Motion carried unanimously.
Streets -arid Right -of -Way
Norman Hill reported on the purchasing of street maintenance equipment and
some bids have been received on the equipment and presented his ideas on the
office lay -out as a back-up to Mr. Park's proposal; and discussed contracting
services. The audience and City Council discussed the proceedures of sealed
bids.
Announcements
City Clerk, Isabel Ballard, reported a letter received from the department
of Administration Finance Division with information to consider purchasing
through the bid plan through the state on their bidding plan; and a
communication received from Arizona Cable Television Association and suggested
the Council study this as a possible source of revenue.These items will be
re -scheduled at a future agenda.

Mayor Virginia Seeman announced the Planning and Zoning office hours are
Tuesday and Thursday from 9:00 a.m. to 3:00 p.m. but no location has been
decided as yet. Mayor Virginia Seeman further announced a press conference
has been scheduled for July 5th at 11:00 at City Hall for input regarding
the CAHSA decision.
