HomeMy WebLinkAboutORD113ORDINANCE NO.113 AN ORDINANCE OF THE CITY OF APACHE JUNCTION, ARIZONA AMENDING CHAPTER 2 OF THE CITY CODE BY ADDING ARTICLE 2-11 PERSONNEL BOARD;PROVIDING FOR APPOINTMENT TO THE BOARD,ESTABLISHING POWERS AND DUTIES OF THE BOARD,PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES:AND PROVIDING FOR SEVER- ABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION AS FOLLOWS: SECTION I IN GENERAL That Chapter 2 of the City Code be ARTICLE 2-11 SECTION 2-11-1 2-11-2 2-11-3 2-11-4 2-11-5 2-11-6 2-11-7 2-11-8 created. Personnel Board amended Creation Membership and Terms of Office Salaries and Personal Expenses Officers Meetings Vacancies Removal of Members Duties Section 2-11-1 Creation by adding the following: The Personnel Board of the City of Apache Junction is hereby Section 2-11-2 Membership and Terms of Office A.The Personnel Board shall consist of 5 members who shall be appointed by the Mayor and approved by the City Council. B.The initial appointments of members shall be as follows: 1.Two members with terms beginning upon their appointment and expiring one year from date of appointment. 2.Three members with terms to expire two years from their appointment.Thereafter Board members will serve for stag- gered terms of Three (3)years or until successors are duly appointment. C.All members shall be residents of the City of Apache Junction. Section 2-11-3 Salaries and Personnel Expenses The members of the Personnel Board shall receive no salaries or other remuneration for their services in such capacity,and shall not be entitled to personal expenses incurred by them in the a dis- charge of their official duties,except to the extent and purposes and amount such expenses are first authorized and approved in advance by the City Council. Section 2-11-4 Officers The Board shall elect a Chairman,Vice Chairman and Secretary from their members to serve for a period of one (1)year.The Vice Chairman shall preside at meetings in the absence of the Chairman. Section 2-11-5 Meetings The Board shall meet when business is to be transacted or at least one time a year.Special meetings may be called as required. A quorum shall consist of three (3)members for the transaction of all business. ORDINANCE NO.113 PAGE 2 Section 2-11-6 Vacancies Vacancies shall be filled by the City Council in accordance with Section 2-11-2 for the unexpired term of vacancy. Section 2-11-7 Removal of Members Members of the Board serve at the pleasure of the Council and may be removed by the Mayor with the concurrence of the Council.A member shall not be absent from Personnel Board meetings for more than three (3)consecutive times without a reasonable excuse.After the ab- sence of three (3)consecutive meetings the remaining members of the Personnel Board shall vote to retain or recommend to the City Council that the absent member be relieved of his duties of the Board. Section 2-11-8 Duties The Board shall hear grievances and appeals from personnel in accordance with the rules outlined in the Personnel Policies of the City of Apache Junction.The Board through the Personnel Director may recommend amendments to the personnel policies. SECTION I I REPEAL OF CONFLICTING ORDINANCES All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the Code adopted herein by reference are hereby repealed. SECTION III SEVERABILITY I f any section,subsection,sentence,clause,phrase or portion of this Ordinance or any part of the Code adopted herein by reference, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
