HomeMy WebLinkAbout1979-07-05 City Council Regular MinutesRegular Meeting of the City Council of Apache Junction July 5, 1979 A regular meeting of the City Council of Apache Junction was held on the 5th day of July, 1979 at the Apache Junction City Hall, pursuant to notice as required by law. Invocation was presented by Marie Shanks. The Pledge of Allegiance was led by Vice -mayor John Granillo. Councilmembers present Mayor Virginia Seeman, Vice -mayor John Granillo, Thomas Damiano, Norman Hill, Marie Shanks Councilmembers absent Jerry Burgess, Jimmy Eidson Staff present Susan Goodwin, City Attorney; and Isabel C. Ballard, City Clerk The regular meeting was called to order at 7:15 p.m. by Mayor Virginia Seeman. Mayor Seeman reminded the Council the agenda is per the City Code. Petitions/Guests Mayor Virginia Seeman called on Etta and Richard LaPorte.Mr. & Mrs. LaPorte spoke in reference to the letter sent the Council of a complaint filed with the County on June 18th regarding a trailer park going up on three acres east of their property and asked if now that the City has taken over what will be done about this. Susan Goodwin responded that violations are going on and she plans to have the Zoning Administrator and staff go to this property to make an official inspection and make an official report and a complaint will then be filed in City Court for prosecution. Reports by Officers Norman Hill reported on a meeting scheduled for Friday to discuss the Palm Springs problems, traffic hazards along the highway. Vice -mayor John Granillo reported on the modular unit and the electrical hook-up is the only problem at this point but everything else is going smoothly and on schedule. Thomas Damiano reported on the Planning and Zoning Meeting to select a chairman and of the six members present, three Parks, and three voted for George Baljo. George Baljo was chairman until the seventh person, who is not available at attend the meeting of July 30th at which time they hope to chairman. held Tuesday night voted for Cookie selected as acting this time, could select a permanent Susan Goodwin said she was just made aware the Planning and Zoning Commission and the Board of Adjustments have not yet taken an oath of office which is required under state statutes and anyone on those boards can come in and the City Clerk will administer the oath of office individually or as a group. Marie Shanks reported on Animal Control and if there are any problems the sheriff's department should be contacted first and they will direct to the proper person in charge. Marie Shanks reported a temporary Magistrate is needed until we can hire a full-time person and referred to Mr. Donald R. Brown, a professor at Mesa Community College and teaches police sciences, and is also the assistant Magistrate Regular Meeting July 5, 1979 Page two for the City of Gilbert, has offered his services on a month -to -month basis for $400 per month, to be on call every day of the week, during nights and on week -ends.Marie Shanks made a motion if Mr. Donald Brown is available, he be selected as temporary Magistrate to serve on a monthly basis until a full- time Magistrate can be hired, seconded by Vice -mayor John Granillo. One (1) voted yes - Mayor Virginia Seeman. One (1) voted no - Marie Shanks. Three (3) abstained - Vice -mayor John Granillo, Thomas Damiano, Norman Hill. Motion failed. Mr. Joe Saggio asked if the City Clerk, who was also doing Magistrate work, was receiving an additional salary. The City Council answered that the City Clerk was not being paid for Magistrate. Mr. Saggio then volunteered his services free as Magistrate, but since a law was passed that employees could not also serve on Boards etc. this policy should be studied more carefully by the Council to include non -hiring of relatives, etc. of employees. City Clerk, Isabel Ballard, reported her primary job is City Clerk for which she is getting paid and the Magistrate work is taking too much time from her duties as City Clerk and this is a serious problem and highly recommended the Council should act upon a Magistrate tonight. Mayor Virginia Seeman turned the meeting over to Vice -mayor John Granillo and suggested going into an Executive Session to further discuss this problem and made a motion to go into an Executive Session, seconded by Thomas Damiano. Motion carried unanimously. An Executive Session was held from 7:20 to 7:50 p.m. Vice -mayor John Granillo made a motion Mr. Donald Brown be hired as City Magistrate, seconded by Thomas Damiano. Four (4) voted yes - Mayor Virginia Seeman, Vice- mayor John Granillo, Thomas Damiano, Norman Hill. One (1) voted no - Marie Shanks. Motion passed. Mayor Virginia Seeman reported a temporary building inspector offer has been made by Mr. Elmer Tolf to be available two half days per week for $15.00 per inspection.Norman Hill made a motion to hire Mr. Tolf, seconded by Thomas Damiano. Motion carried unanimously. Mayor Virginia Seeman reported the modular unit will contain the Planning and Zoning offices and the City Clerk's office, and the Planning and Zoning office hours are Tuesday and Thursday from 9:00 a.m. until 3:00 p.m. Unfinished Business None New Business State Purchasing Agreement Susan Goodwin read Resolution No. 79-31 " A resolution of the Mayor and the Common Council of the City of Apache Junction, Arizona authorizing the Mayor to enter into an agreement with the State Division of Finance, Department of Administration", which authorizes the Mayor to enter into the contract for State Purchasing to purchase through the state and at the states' prices. Vice -mayor John Granillo made a motion to adopt Resolution No. 79-31, seconded by Norman Hill. Motion carried unanimously. Regular Meeting July 5, 1979 Page three Request for Airport Committee Mr. John Drummond reported on the airport proposal, funds available and requested Mayor and Council appointment of an Airport Committee, by the Mayor, with no financial commitment to the city. Marie Shanks made a motion to approve Mr. Drummond's proposal to form an investigative committee to look into the airport situation and to attend a public information meeting at Maricopa County Board of Supervisors on July 12th, seconded by Thomas Damiano.Motion carried unanimously. Mayor Virginia Seeman appointed to the airport committee as follows:Dr. Dave Robinson, Chairman; John Drummond, Howard Downs; John Forsberg; Jack Fetz and George Johnston. Planning and Zoning Administrator Mayor Virginia Seeman reported Althea Nunn is temporary acting Zoning Administrator. Claims Vice -mayor John Granillo made a motion to instruct the City Clerk to pay the unpaid bills totalling $7,207.48, seconded by Thomas Damiano.Motion carried unanimously. Miscellaneous Business City Clerk, Isabel Ballard reported she will have sections of the City Code Book prepared for the audience which will explain each item on the agenda and what it is meant to be, for public input. Doris Mathews asked about the modular unit and why it was not located on the slab as was originally planned.Mayor Virginia Seeman replied she believed it was because it was too close to the gas pumps, and this was taken care of by Mr. Karam and the Fire Chief. Doris Mathews asked who the members of the Airport Committee were.Mayor Seeman responded the list will be added to and was given to Doris Mathews. Mayor Virginia Seeman reported a Special Session for an Executive Meeting will be held July 11th at 6:00 p.m. Mr. Joe Saggio asked about the hearing on the proposed budget and since he will be absent requested the Council to consider his statements on the proposed budget.
