AN ORDINANCE OF THE MAYOR AND CITY COUNCIL)OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION ZONING ORDINANCE BY AMENDING ARTICLE
23,"GENERAL PROVISIONS AND EXCEPTIONS"BY ADDING A NEW SECTION 2330,
"DEDICATION OF PUBLIC RIGHT-OF-WAY REQUIRED";REPEALING ANY CONFLICTING
PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That Article 23,"General Provisions and Exceptions"be amended as permitted by
Arizona Revised Statutes S9-462.01 by adding a new section,2330,"Dedication
of Public Right -of -Way Required,"to read as follows:
SECTION 2330 DEDICATION OF PUBLIC RIGHT-OF-WAY REQUIRED
The City Council may,as a condition precedent to granting approval
to a rezoning application,require the dedication of public right-
of-way along the frontage of and/or within the subject application
area said required right-of-way to be in compliance with the Apache
Junction Street Classification Plan.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance or any part of the code adopted herein by reference are
hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,clause,phrase,or portion of this
ordinance or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portions thereof.
SECTION IV EMERGENCY CLAUSE
I t is necessary for the preservation of peace,health,and safety of the
city of Apache Junction,Arizona,that this ordinance become effective
immediately,an emergency is hereby declared to exist,and this ordinance
shall be effective immediately upon passage and adoption.
PASSED AND ADOPTED by the Mayor and City Council of the City of Apache Junction,
Arizona,this 5th day of May ,1982.
