AN ORDINANCE OF THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION, ARIZONA,
AMENDING THE APACHE JUNCTION CITY CODE
CHAPTER 3 ADMINISTRATION, BY ADDING ARTICLE
3-11 OFFICE OF THE LIBRARY, SECTIONS 3-11-1
THROUGH 3-11-3; REPEALING ANY CONFLICTING
PROVISIONS; AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:
SECTION I IN GENERAL

Section 3-11-1 Office Established
A.The office of the Library of the City of Apache
Junction is hereby created and established.It
shall consist of the Library Director who shall be
the chief administrator of the office and all other
employees assigned thereto.All other employees
shall perform their duties subject to the supervision
of the Library Director who shall operate under the
guidance and direction of and report directly to the
City Manager.The Library Director shall supervise
his office in accordance with the applicable personnel
ordinances and shall exercise such powers and perform
such duties as are required by this code, applicable
ordinances, resolution or lawful directives.
B.Appointment and Compensation.The position of the
Library Director is hereby declared as classified
service and he shall be appointed and removed by the
City Council subject to recommendation of the City
Manager and the Library Board; and shall serve and
receive such compensation as shall be determined in
accordance with the applicable personnel ordinance.
Section 3-11-2 Duties of Library Director
A.The Library Director shall:Retain all duties and
responsibilities assigned by this code, law or
ordinance and shall abide by those set forth in
Arizona Revised Statutes §9-411 through 9-420.
B.Consult with the president of the Library Board as
to the items to be included on the agenda of meetings
for said Board prior to the preparation and distribution
of the agenda by the Library Director.The Library
Director, if requested by any board members, shall
include on the agenda any item requested by said
board member.
C.Prepare and distribute the official minutes of all
Library Board meetings.
D.Consult with the Library Board and City Manager on
the establishment of all policies and procedures
including, but not limited to library hours, general
standards of service, book selection, policy, and fees.

E.Administer and operate existing library facilities
and programs and plan for the development and
operation of proposed facilities and programs in
accordance with policies set by lawful directives of
the Library Board and the City Council.
F.Make recommendations to the City Manager, with the
assistance of the Library Board, for the annual
budget for submittal to the City Council.
G.Inform the general public of the services and
facilities being provided by the office of the
Library; address professional civic and lay groups
on related subjects, solicit suggestions from the
general public on increasing the effectiveness of
programs; cooperate with governmental and voluntary
organizations and agencies in the solving of related
problems; provide, upon request, assistance of a
technical nature to community agencies and organizations
on problems related to library facilities and programs.
H.Assist community organizations in the promotion of
library services; conduct studies of local conditions
and needs for such services; assist with the recruit-
ment and training of professional library personnel
and volunteer leaders.
I.Upon request, advise the Council, the Library Board
and community organizations concerning the expenditure
of public funds for the library; acquisitions, design
and development of facilities; and shall maintain
effective and cooperative relations with all City
officials, state and federal agencies and with local,
state and national voluntary organizations.
Section 3-11-3 Vacancies
In case that the office of the Library Director shall
become vacant for any reasons, the City Council shall
appoint a successor based upon recommendations by the
City Manager and Library Board.
Section II REPEALING OF CONFLICTING PROVISIONS
All ordinances and part of ordinances in conflict with
the provisions of this ordinance or any part of the code adopted
herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, clause, phrase or
portion of this ordinance or any part of the code adopted herein
by reference is for any reason held to be invalid or unconstitu-
tional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining
portions thereof.

APACHE JUNCTION, ARIZONA, THIS 3RD DAY OF AUGUST , 1982.
