AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, ADDING CHAPTER 5 TO VOLUME II OF THE LAND
DEVELOPMENT CODE OF THE CITY OF APACHE JUNCTION, PERTAINING TO
FLOODPLAIN MANAGEMENT, ADOPTING BY REFERENCE, PROVIDING FOR
REPEAL OF CONFLICTING PROVISIONS, PROVIDING FOR SEVERABILITY,
PROVIDING FOR PENALTIES AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE.JUNCTION, ARIZONA, THAT:
SECTION I IN GENERAL
Those certain documents which were made public record by
Resolutions Number 82-56 and 82-57 and entitled "Floodplain
Management Ordinance" and "Flood Insurance Study" are hereby
adopted by reference as Chapter 5, "Volume II of the Land
Development Code" and made a Part thereof as if fully set
out in this ordinance.
SECTION II REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict with the
provisions of this ordinance or any part of the code adopted
herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, sub -section, sentence, phrase, clause or
portion of this ordinance or any part of the code adopted
herein by reference is for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity
of the remaining portion thereof.
SECTION IV PROVIDING PENALTIES FOR THE VIOLATION THEREOF
Any person, firm or corporation, whether as principal, owner,
agent, tenant, employee, or otherwise, who violates any pro-
visions of this ordinance or violates or fails to comply with
any order or regulation made hereunder, shall be guilty of a
misdemeanor and upon conviction thereof shall be punishable by
a fine of not more than one -thousand dollars ($1,000) or by a
term not exceeding six (6) months or by both such fine and
imprisonment, and each day's continuance of a violation shall
be deemed a separate offense.
SECTION V EMERGENCY CLAUSE
It is necessary for the preservation of Peace, health, and
safety of the city of Apache Junction, Arizona, that this ordinance
become effective immediately, an emergency is hereby declared to

exist, and this ordinance shall be effective immediately upon
passage and adoption.
PASSED AND ADOPTED by the Mayor and City Council of the
City of Apache Junction, Arizona, this uth day of August
