MAP CHANGING THE ZONING DISTRICT CLASSI- FICATION IN REZONING CASE PZ-17-83 FROM TRAILER HOMESITE ZONE (TH)AND GR GENERAL RURAL TO TRAILER HOMESITE ZONE BY PLANNED DEVELOPMENT (TH/PD)AND LOCAL BUSINESS ZONE BY PLANNED DEVELOPMENT (CB-1/PD);REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL 1.The zoning district classification on the Apache Junction,Arizona,Zoning Map for the parcels of land described below,be and hereby are amended by changing the zoning district classification as stipulated: Parcel No.1 (from Trailer Homesite Zone (TH)to Trailer Homesite Zone by Planned Development (TH/PD)): The Northwest *of the Northwest *of Section 29,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, located in Apache Junction,Pinal County,Arizona;EXCEPT the west 330'feet and the north fifty (50')feet of city street right-of-way.Containing 28.86 acres. And,EXCEPT the following thirty (30')foot -wide right-of- way for city street: Commencing at the 3/16 corner of said Section 29; Thence easterly 312.5 feet; Thence southerly 106.00'feet to the point of beginning of said thirty (30')foot right-of-way; Thence easterly 198.35'feet; Thence along a curve northeasterly 247.87'feet,said curve having a radius of 469.54'feet and central angle of 30014' 45"to a point of reverse curvature; Thence along a curve northeasterly 279.54'feet,said curve having a radius of 529.54'feet and central angle of 30° 14'45"; Thence easterly 306.00'feet; Thence southerly thirty (30')feet to the 11/16 corner of said Section 29; Thence westerly 306.00'feet; Thence along a curve southwesterly 263.7'feet,said curve having a radius of 499.54'feet and central angle of 30°14'45"to a point of reverse curvature; Thence along a curve southwesterly 263.7'feet,said curve having a radius of 499.54'feet and central angle of 30°14'45"; Thence westerly 198.35'feet; Thence northerly thirty (30')feet to the true point of beginning. Containing 5.35 acres,net. Parcel No.3 (from CR-3 Single Residence Zone to Trailer Homesite Zone by Planned Development (TH/PD)): Located in the Southwest of the Northwest i ,of Section 29, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,located in Apache Junction,Pinal County,Arizona, and being described as follows: Beginning at the 3/16 corner of Section 29; Thence running east toward the 10/16 corner,312.5'feet to the true point of beginning; Thence continuing east 701.5'feet; Thence southwesterly and bearing left along the arc of a 499.54'feet radius curve,with a central angle of 30°14'45", 263.7'feet to a point of reverse curvature; Thence southwesterly and bearing right along the arc of a 499.54'feet radius curve,with a central angle of 30 014 14511, 263.7'feet to a point of tangency; Thence west 198.35'feet; Thence north 136.00'feet to the true point of beginning. Containing 1.40 acres. Parcel No.4 (from GR General Rural Zone to Local Business Zone by Planned Development (CB-1/PD)): The west 275'feet of the north 595'feet of the Northwest i of the Northwest A of Section 29,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,located in Apache Junction,Pinal County,Arizona;EXCEPT the north fifty (50')feet,and the west fifty (50')feet thereof. Containing 2.81 acres,net. 2.The approval of the zoning district classification incorporates,by reference, the preliminary approval of the Planned Development,including all materials and documents as submitted by the applicant,and the development of said property shall be in accordance with said Planned Development application conditions,provisions,and stipulations,and as provided in Article 33 of the Zoning Ordinance.The application includes the "Agreement for Maintenance of Landscaping Within City Rights -of -Way,"and "Street Light Agreement,"i f executed as part of the application. 3.Applicant shall install,at his expense,fire hydrants,as per approved plans of the Apache Junction Fire Chief,for this Planned Development. 4.Applicant shall install,at his expense,off -site street improvements as set forth on the Planned Development plans in compliance with design details, approved by the Director of Public Works. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,sub -section,sentence,phrase,clause,or portion of this Ordinance,or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV PENALTY CLAUSE Any person found guilty of violating any provision of this Ordinance, shall be punished by a fine not to exceed $1,000.00 or imprisonment for a period not to exceed six (6)months,or by both such fine and imprisonment. Each day that a violation continues shall be a separate offense punishable as hereinabove described.
