HomeMy WebLinkAbout1979-07-25 City Council Special MinutesSpecial Meeting of the Apache Junction City Council July 25, 1979 A special meeting of the Apache Junction City Council was held at the City Hall July 25, 1979 pursuant to notice as required by law. An Executive Session was held from 6:00 p.m. to 7:00 p.m. The Special Meeting was called to order by Mayor Virginia Seeman at 7:05 p.m. The Invocation was presented by Marie Shanks. The Pledge of Allegiance was led by Vice -mayor John Granillo. Councilmembers present Mayor Virginia Seeman, Vice -Mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman Hill, and Marie Shanks. Staff present Susan Goodwin, City Attorney; Isabel C. Ballard, City Clerk Approval of minutes Regular Meeting July 18, 1979 Marie Shanks made a motion to accept the minutes as corrected of the Regular Meeting of July 18, 1979 and seconded by John Granillo.Motion carried unanimously. Petitions/Guests Jane Moats made a presentation of the Senior Citizens Health Services.She reported there would be a Health Fair on Sept. 15 at the Apache Junction Jr. High School orientated toward Senior Citizens with good examinations plan- ned.Hours will be 8:00 a.m. to 4:00 p.m.Samaritan Health Services and American Red Cross are assisting with the program. Mr. Dick LaPort presented to City Council a petition on Archie Lowe from the homeowners in the area. City Attorney, Susan Goodwin, advised that Mr. Lowe is under a temporary restraining order.After discussion with Mr. Joe Saggio and Mr. C. T. Parks the City Attorney advised she felt that all loop holes are covered. Reports by Officers Mr. John Granillo advised to enter Budget and Finance under reports from officers, not new business. He advised he had conferred with the Investment Officer of Copper State Bank and looked into avenues of investment for the account.Interest is computed on a day to day basis and funds will be avail- able on a day to day basis. Norman Hill advised the Council on the need to hire a Public Works director and the purchase of a pickup.He is working on it. Thomas Damiano read RESOLUTION 79-33, A RESOLUTION OF THE CITY COUNCIL OF APACHE JUNCTION PLACING A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS FOR NEW CONSTRUCTION WITHIN THE SERVICE AREA OF THE PALM SPRINGS UTILITY COMPANY, and seconded by John Granillo. City Attorney, Susan Goodwin, expressed a legal opinion that the moratorium Special Meeting July 25, 1979 Page two could be passed in the name of Health, Welfare of citizens of Apache Junction, when Mr. Joe Saggio questioned the legality of passing the resolution without a public hearing.Six (6) voted yes, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman Hill and Mayor Seeman.One (1) voted no. Marie Shanks. Thomas Damiano reported the Planning and Zoning Advisory Committee would like to recommend the City Council adopt, with revisions, the City of Casa Grande's Sub -division regulations and Sub -division Design Standards and Principles as presented.After Council discussion Marie Shanks made a motion for the Plan- ning and Zoning Commission Board to study and make recommendations at the next City Council meeting and have the public hearing at the same time and seconded by Norman Hill. Motion carried unanimously. Unfinished Business City Attorney, Susan Goodwin, stated the Travel Policy was a good basic policy and reported she added a paragraph #6 to provide for councilmembers, and added options on the approval of extended travel.Norman Hill made a motion for extended in -state and all out of state be approved by the majority of the Council and seconded by John Granillo.Six (6) voted yes, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman Hill and Marie Shanks.One (1) voted no, Mayor Virginia Seeman. The Travel Policy with changes will be presented to Council at the next Council meeting. Jimmy Eidson made a motion to change the Council meeting night to Thursday evenings, the second and fourth starting with first meeting in Sept.Susan Goodwin brought to Council's attention and amendment to the City Code can not be done by a motion.It would take an amended Ordinance.Jimmy Eidson withdrew his motion and then made a motion to instruct the City Attorney to prepare an amendment to the Ordinance of the City Code of Apache Junction, Section 2-4-1 entitled Regular Meeting and set meetings for 2nd and 4th Thursday of Each month and seconded by Jerry Burgess. There were five (5) voted no, Mayor Virginia Seeman, Vice -mayor John Granillo, Thomas Damiano, Norman Hill and Marie Shanks.Two (2) voted yes, Jerry Burgess and Jimmy Eidson.Motion failed. New Business Jimmy Eidson reported on the screening committee results of Chief of Police and made a motion that the City of Apache Junction hire William E. McDaniel as Chief of Police at a salary of $22,000.00 annually starting August 15, 1979, and seconded by Thomas Damiano.Motion carried unanimously. Marie Shanks made a motion to call Executive Sessions for July 30th for inter- viewing applicants for City Magistrate and August 4th to interview applicants for City Manager, and seconded by Norman Hill. Motion carried unanimously. Claims None Special Meeting July 25, 1979 Page three Miscellaneous Marie Shanks reminded City Council agenda items are due no later than noon on Friday. Agenda should be available to councilmembers on Friday evenings.Public may pick up the agenda on Maonday morning.
