AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY
CODE,CHAPTER 3 ADMINISTRATION,BY AMENDING ARTICLE 3-13
SAFETY POLICIES,SUBSECTION A,PERTAINING TO MANDATORY USE
OF SEAT BELTS BY CITY EMPLOYEES;REPEALING ANY CONFLICTING
PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That Chapter 3 ADMINISTRATION,Article 3-13 SAFETY POLICIES,
Subsection A,be amended to read as follows:
ARTICLE 3-13 SAFETY POLICIES
A.That the certain document entitled City of Apache Junction
Employee Safety Handbook be amended to read as follows:
FLEET SAFETY
Vehicle Operation
All city vehicles and equipment are to be operated in a safe manner
and adhere to all applicable laws.Seat belts shall be worn by all
city employees while operating or while a passenger in a city
vehicle.The operator is totally responsible for the safe oper-
ation of the equipment.The vehicle operator shall report any
accidents or damage immediately to the supervisor.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the pro-
visions of this ordinance or any part of the code adopted herein by ref-
erence are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,clause,phrase or portion
of this ordinance or any part of the code adopted herein by reference is,
for any reason,held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.
SECTION IV EMERGENCY CLAUSE
I t being necessary for the preservation of peace,health and
safety of the City of Apache Junction,Arizona,that this ordinance become
effective immediately,an emergency is hereby declared to exist and this
ordinance shall be effective immediately upon its passage and adoption.
PASSED AND ADOPTED by the Mayor and City Council of the City of
Apache Junction,Arizona,this 19th day of June ,1984.
