August 1, 1979
A regular Meeting of the Apache Junction City Council was held at'ithe -City Hall
Hall August 1, 1979, pursuant to notice as required by law.
The regular meeting was called to order by Vice -mayor John Granillo at 7:00 p.m.
The Invocation was presented by Reverand Larson.
The Pledge of Allegiance was led by Thomas Damiano.
Councilmembers present
Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman
Hill and Marie Shanks.
Councilmembers absent
Mayor Virginia Seeman

Approval of Minutes
Special Meeting of July 25, 1979
Marie Shanks made a motion to accept the minutes as correct and seconded by
Norman Hill. Motion carried unanimously.
Petitions/Guests
Etta La Port, from Westside Homeowners Association, asked if the hearing set for
Archie Lowe on Friday August 4, 1979 had been cancelled.City Attorney, Susan
Goodwin, advised it would be cancelled.She also advised the hearing was not
a trial, it is to see what happens pending trial.The hearing involves the
question of should Mr. Archie Lowe be stopped from what he is doing.The hearing
determines what the status will be until the trial.Mrs. LaPort asked if the
restraining order would be void and was advised that it would not be,,by Susan
Goodwin.
Joe Saggio asked the Council if Friday was to determine if there is cause to de-
termine if the restraining order could be a permanent restraining order pending
trial, and if there was no court the temporary restraining order was void.City
Attorney advised no.The hearing is postphoned, until needed, not vacated or
canceled.Mr. Archie Lowe apologized and assured the Council and residents he
would correct the violations and would abide by the law.He asked for forty-five
days to correct the situation.
Reports by Officers
Norman Hill requested to hold his report until Mr. C. T. Parks arrives.
Unfinished Business
After discussion of the Personnel Policies Norman Hill made a motion to accept
the Travel Policy as it reads and seconded by Thomas Damiano.Motion carried
unanimously.
Marie Shanks reported the Senior Citizens Health Fair requested the City to supply
four citizens to volunteer for two hours each to man the coffee pot during the
Health Fair on Sept. 15.
Jimmy Eidson made a motion for the Council to move into an Emergency Executive

Session involving a personnel matter and seconded by Jerry Burgess.Five (5)
voted yes, Jimmy Eidson, Norman Hill, Thomas Damiano, Jerry Burgess, and John
Granillo.One (1) voted no.Marie Shanks.Council adjourned into an Executive
Session at 7:35 p.m.
New Business
Marie Shanks explained to the public that Monday, July 30, 1979, the Council
had an Executive Session to interview two people for the position of City
Magistrate, Gary Stienhoff and Donald Brown.Marie Shanks made a motion to
appoint Donald R. Brown as City Magistrate.The motion failed due to a lack of a
second to the motion.
Jimmy Eidson made a motion to hire Gary Stienhoff as the City Magistrate at the
salary of $12,000.00 per year and seconded by Thomas Damiano.Four (4) voted no.
John Granillo, Jerry Burgess, Norman Hill, Marie Shanks.Two (2) voted yes,
Thomas Damiano and Jimmy Eidson.Motion failed.
Marie Shanks suggested that the Council re -advertise for the City Magistrate.
Marie Shanks made a motion for the Executive Committee further investigate the
two applications and put the matter on the agenda for the next Regular Meeting
and seconded by Norman Hill.Motion carried unanimously.
Joe Saggio reminded the Council of his application that he submitted at no salary
whatsoever for City Magistrate and asked if it had been considered and why it
wasn't among the final decision.It was explained to Mr. Saggio that an unbaised
committee had been picked to screen the applicants and they had decided on the
two.
Sealed Bids on Street Maintenance:
The sealed bids on street maintenance were opened and read by Vice -mayor John
Granillo.Bids submitted were: Anderson Truss Manufacturing & Lumber Co., 55 N.
Palo Verde St., P.O.Box 1297, Apache Junction; David M. Spenser, Dadson Enter-
prises; and Clarence Westerbur, 1012 S. Lawson Drive, Apache Junction.Norman
Hill said he would research and study the bids prior to making a recommendation
to the City Council.The bids are on file at the City Hall.
Final Budget:
Joe Saggio asked for an explanation of the working budget.Susan Goodwin, City
Attorney, offered Mr. Saggio the explanation of the budget.The Legal Budget is
required to be published, and is subject to the 10% limitations.State Laws
apply to the Legal Budget.The Working Budget is what a city accountant in reality
works with.Joe Saggio voiced a protest of the budget which was answered by the
City Clerk and the City Attorney.Arthur Strange asked for an explanation to the
budget and was explained by Vice -mayor Granillo and City Clerk Isabel C. Ballard.
Susan Goodwin, City Attorney read RESOLUTION NO. 79-34
WHEREAS, IN ACCORDANCE WITH THE PROVISIONS OF TITLE 42, SECTIONS 302, 303, and
304, A.R.S., THE CITY COUNCIL DID ON THE 11TH DAY OF JULY, 1979, MAKE AN ESTIMATE
OF THE DIFFERENT AMOUNTS REQUIRED TO MEET THE PUBLIC EXPENSES FOR THE ENSUING
YEAR, ALSO AN ESTIMATE OF RECEIPTS FROM SOURCES OTHER THAN DIRECT TAXATION, BY
THE CITY OF APACHE JUNCTION.
Thomas Damiano made a motion to adopt Resolution No. 79-34 for the fiscal year
1979-80 and seconded by Jerry Burgess.Four (4) voted yes, Vice -Mayor John

Granillo, Jerry Burgess, Thomas Damiano, and Jimmy Eidson.Two (2) abstained,
Norman Hill and Marie Shanks.
Proposed Subdivision Ordinances
Susan Goodwin read a letter from the Planning and Zoning Commission Chairman
C.T. Parks.After review by the Commission they recommended the City adopt
Casa Grande's sub -division Ordinances. Susan Goodwin suggested input from a
City Planner and the public.She suggested a team of two or three (CAAG, Casa
Grande P & Z and Mesa P & Z) sit down next Tuesday afternoon, go over comments
that are made by the public tonight and be sure that is what Apache Junction
needs.
Marie Shanks made a motion to hold a Public Hearing on the subdivision ordinances
on August 15, 1979 along with the proposed subdivision standards and seconded
by Thomas Damiano.Motion carried unanimously.
Jimmy Eidson requested Chief McDaniel to present to Council his request for equip-
ment.Chief McDaniel stated the equipment is at the State Surplus in Phoenix.
Equipment requested is two vehicles, a 1975 Ford four door at a cost of $673.00
and a 1974 Mercury four door at a cost of $687.00.He also stated he had found
a typewriter and two calculators at State Surplus.Approximate total price
$2000.00.He also requested the City Council purchase new (two) Motorola radios
from Pinal County through bids at $1095.00 and $318.00 for scramblers.Two
mobile and two portable radios could be obtained for $4759.00.He expressed a
possibility of obtaining used radios from State Surplus.
Jimmy Eidson made a motion to authorize Chief McDaniel to purchase radios through
Pinal County bids at a cost of $4759.00 and seconded by Norman Hill.Five (5)
voted yes, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson
and Norman Hill.One (1) voted no, Marie Shanks.
Mercer Weiskotten, Sergant from Pinal County Sheriff's Office, explained the
vehicle radios from State Purchasing are not useable to County Sheriff's offices
or Police Departments.
Susan Goodwin, City Attorney, requested an item to be placed on the agenda, item
being application for purchase of State Land with unanimous approval by Council.
Susan Goodwin explained the process of applying for the State land for the City
Hall site.Thomas Damiano made a motion to accept Resolution 79-35:
A RESOLUTION PROVIDING FOR THE EXECUTION OF AN APPLICATION7POR:THETPURCHASE0F
100 ACRES OF STATE LAND WITHIN THE CITY LIMITS OF APACHE JUNCTION, ARIZONA AND
FOR THE LEASE OF TWO ACRES OF STATE LAND WITHIN THE CITY LIMITS OF APACHE JUNCTION,
and seconded by Marie Shanks Motion carried unanimously.
Norman Hill read the bids on the pickup truck from Berge Ford, $5,765.76;Brown
and Brown Chevrolet, $5300.00; Arnold Auto Center, $4940.76.Norman Hill made
a motion to purchase the Chevrolet pickup truck from Arnold Auto Center, seconded
by Thomas Damiano.Five (5) voted yes, John Granillo, Jerry Burgess, Thomas
DAmiano, Jimmy Eidson,Norman Hill.One (1) voted no, Marie Shanks.
Misc.
Joe Morvac, a building contractor, spoke his opinion on the Moratorium placed on
Palm Springs Utility Co. and wanted to know how long and if it was serving a
purpose.Thomas Damiano stated there is little known until the hearing on August

17, 1979.Susan Goodwin, City attorney, stated the moratorium is temporary and
is the only option to put pressure on the Corporation Commission to solve the
problem.Joe Saggio also stated his opinion that the Corporation Commission
would only delay in making a decision.
Survey indicated water was undrinkable and had other problems.If any area is un-
affected the moratorium could be modified to exclude that portion.Marie Shanks
made a motion to rescind the moratorium on Palm Springs Utility and seconded by
Jimmy Eidson.
Jimmy Eidson made a motion to amend the moratorium rescindment to August 17, 1979
and seconded by Thomas Damiano.Motion carried unanimously.On the amended
motion by Marie Shanks four (4) voted yes, Vice -mayor John Granillo, Jimmy Eidson,
Norman Hill, Marie Shanks.Two (2) abstained, Jerry Burgess and Thomas Damiano.
Claims
Marie Shanks made a motion to pay the unpaid bills for July, 1979 in the amount
of $28,083.80 and seconded by Jerry Burgess.Motion carried unanimously.
Misc.
Earl Laabs asked Council what the status was on the proposed ordinances on motor-
cycles.Susan Goodwin answered Mr. Earl Laabs saying she had submitted two
ordinances for City Council to review.
Discussion on Public Works will be on August 4th at an Executive Session.
