NO.204 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,CITY CODE BY AMENDING SECTION 13-2-3,SUBSECTION (A),BY DELETING FROM THE "STREET CLASSIFICATION PLAN"THE REQUIREMENT TO DEDICATE AND IMPROVE SOUTH VALLEY DRIVE BETWEEN WEST BROADWAY AVENUE AND WEST TWELFTH AVENUE;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND PROVIDING PENALTIES. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AS FOLLOWS: SECTION I IN GENERAL The Apache Junction,Arizona,City Code is hereby amended by amending Section 13-2-3,Subsection (A),relating to the "Street Classification Plan," whereby the City Council of the City of Apache Junction,Arizona,does hereby declare that the certain below alignment being a minor collector shall not be required for dedication as a public right-of-way for public roadway and associated purposes,as a condition precedent to the issuance of a building and/or off -site construction permit;and furthermore,the said City Council declares that the said minor collector will not be required to be constructed as a condition of improving the adjacent lands;and further,these parcels are described as: Parcel No.1 •The east thirty (30')feet of the Northwest /of the Northwest 4 of Section 29,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,located in Apache Junction,Pinal County,Arizona. Parcel No.2 The west thirty (30')feet of the Northeast A of the Northwest 4 of Section 29,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,located in Apache Junction Pinal County,Arizona. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,sub -section,sentence,phrase,clause,or portion of this Ordinance,or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV PENALTY CLAUSE Any person found guilty of violating any provision of this Ordinance, shall be punished by a fine not to exceed $1,000.00 or imprisonment for a period not to exceed six (6)months,or by both such fine and imprisonment. Each day that a violation continues shall be a separate offense punishable as hereinabove described.
