AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE BY
AMENDING CHAPTER 3 ADMINISTRATION,ARTICLE 3-1 CITY MANAGER,
SECTION 3-1-7 (B)COMPENSATION AND SECTION 3-1-10 REMOVAL
PROCEDURE,SUBSECTION (F)RESIGNATION OF MANAGER;REPEALING
ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That Chapter 3 ADMINISTRATION,Article 3-1 City Manager,Section
3-1-7 (B)Compensation,be amended to read as follows:
Section 3-1-7 Compensation
B.Upon termination of the city manager by reason of involuntary
removal from service for other than willful misconduct in
office,the manager shall receive payment for all accrued
regular working hours,all accrued vacation hours and
the equivalent •of thirty (30)days severance pay at the
regular pay rate.
That Chapter 3 ADMINISTRATION,Article 3-1 City Manager,Section
3-1-10 Removal Procedure,Subsection (F)Resignation of Manager,be
amended to read as follows:
F.Resignation of Manager.The manager shall provide the council
with thirty (30)days written notice of intention to resign
his position.The manager shall assist the council in the
recruitment and selection of a replacement i f requested by
the council.In the event of resignation due to health
reasons,the period of written notice shall be determined
in conference between the manager and the council.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the pro-
visions of this ordinance or any part of the Code adopted herein by
reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of
this ordinance or any part of the Code adopted herein by reference is,for
any reason,held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.

SECTION IV EMERGENCY CLAUSE
Whereas,i t is necessary for the preservation of the peace,health
and safety of the City of Apache Junction,Arizona,an emergency is declared
to exist and this Ordinance shall become immediately operative and in force
from and after the date of posting hereof.
