AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE BY
AMENDING CHAPTER 1 GENERAL,ARTICLE 1-8 PENALTY;CHAPTER 12
TRAFFIC,ARTICLE 12-1 ADMINISTRATION,SECTION 12-1-1;ARTICLE
12-2 TRAFFIC CONTROL,SECTION 12-2-2 AND 12-2-3;AND ARTICLE
12-3 PARKING,SECTIONS 12-3-2,12-3-5 AND 12-3-6 (A);REPEALING
ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That Chapter 1 GENERAL,Article 1-8 PENALTY,be amended to read as follows:
ARTICLE 1-8 PENALTY
A.Any person found guilty of violating any provisions of this code,
except as otherwise provided in this code,shall be guilty of a
misdemeanor,and upon conviction thereof shall be punished by a
fine of not to exceed one -thousand dollars or by imprisonment
for a period not to exceed six months,or by both such fine
and imprisonment.Each day that a violation continues shall
be a separate offense punishable as hereinabove described.
B.Any violation of or failure or refusal to do or perform any
act required by Chapter 12 of this code constitutes a civil
traffic violation.Civil traffic violations are subject to
the provisions of Title 28,Chapter 6,Articles 20 and 21,
Arizona Revised Statutes and amendments thereto.
That Chapter 12 TRAFFIC,Article 12-1 ADMINISTRATION,Section 12-1-1
Duty of Police Department,be amended by adding a Subsection B to read as
follows:
B.Any peace officer or duly authorized agent of the City of Apache
Junction may stop and detain a person as is reasonably necessary
to investigate an actual or suspected violation of any chapter
of this code,and to serve a copy of the traffic complaint for
any alleged civil or criminal violation of said articles.
That Chapter 12 TRAFFIC,Article 12-2 TRAFFIC CONTROL,Section 12-2-2
Obedience to Traffic Regulations and Section 12-2-3 Use of Coasters,Roller
Skates and Similar Devices Restricted,be amended to read as follows:
Section 12-2-2 Obedience to Traffic Regulations
No person shall do any act forbidden or fail to perform any act required
by this chapter.No person shall willfully fail or refuse to comply
with any lawful order or direction of a police officer.

Section 12-2-3 Use of Coasters,Roller Skates and Similar Devices
Restricted
No person upon roller skates or riding any coaster,toy vehicle or
similar device shall go upon any roadway except while crossing a
street on a crosswalk and,when crossing,such person shall be
granted all of the rights and shall be subject to all of the
duties applicable to pedestrians.
That Chapter 12 TRAFFIC,Article 12-3 PARKING,Section 12-3-2
Blocking Traffic,Section 12-3-5 Parking Vehicles on Sidewalk and
Section 12-3-6 Abandoned Vehicles,Subsection A,be amended to read
as follows:
Section 12-3-2 Blocking Traffic
A.No person shall stop,stand or park any motor vehicle or other
vehicle upon a street in the city in such manner or under such
conditions as to leave available less than twenty feet of the
width of the roadway for the free movement of vehicular
traffic,except that a person may stop temporarily,in the
actual loading or unloading of passengers or,when necessary,
in the observance of traffic signs or signals of a police
officer.
B.No person shall park a motor vehicle or other vehicle within
an alley or entrance to a private driveway except for the
loading or unloading of materials,and not then unless such
loading or unloading can be accomplished without blocking
the alley to the free movement of vehicular traffic.
Section 12-3-5 Parking Vehicles on Sidewalks
No person shall park any vehicle,whether in usable condition or
not,upon any sidewalk in the city nor shall a vehicle owner
permit his vehicle to be parked upon any sidewalk in the city.
Section 12-3-6 Abandoned Vehicles (Amending Subsection A Only)
A.No person shall abandon any vehicle on public or private
property.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions.
of this ordinance or any part of the code adopted herein by reference
are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY -
If any section,subsection,sentence,clause,phrase or portion of this
ordinance or any part of the code adopted herein by reference is,for
any reason,held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.

SECTION IV EMERGENCY CLAUSE
It being necessary for the preservation of the peace,health and safety
of the City of Apache Junction,Arizona,that this ordinance become
effective immediately,an emergency is hereby declared to exist and
this ordinance shall become effective immediately upon passage and
adoption.
