HomeMy WebLinkAboutORD254ORDINANCE NO.254 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL COUNTY,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-2-84 FROM GR GENERAL RURAL TO CB -2 GENERAL BUSINESS ZONE;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Apache Junction,Arizona, Zoning Map for the parcels of land described as: Parcel No.1: That portion of the West of the West of the West of the Southwest A of Section 20,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County, Arizona,described as follows: Beginning at the northwest corner of said Southwest thence south along the west line of said Southwest A 660 feet to the true point of beginning;thence continuing south along said west line 230 feet; thence parallel to the north line of said Southwest A 165 feet; thence north parallel to the west line of said Southwest 230 feet; thence west parallel to the north line of said Southwest 165 feet to the true point of beginning;EXCEPT the south 100 feet thereof; and EXCEPT any part lying within the west thirty-three feet (33')of said Southwest of Section 20;and Parcel No.2: That portion of the West of the West /of the West of the Southwest of Section 20,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona, described as follows: Beginning at the northwest corner of said Southwest i ;thence south along the west line of said Southwest /390 feet to the true point of beginning;thence easterly along a line parallel to the north line of said Southwest 165 feet;thence north parallel to the west line of said Southwest A 120 feet;thence west parallel to the north line of said Southwest /165 feet;thence south 120 feet to the true point of beginning;EXCEPT any part lying within the west thirty-three feet (33')of said Southwest I of Section 20; be and hereby is amended by changing the zoning district classification from GR General Rural to CB -2 General Business Zone,subject to the stipulation that the applicant dedicate the west seventeen feet (17') of the subject property for public roadway and associated purposes. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance,or any part of the code adopted herein by reference, are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause,or portion of this Ordinance,or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
