HomeMy WebLinkAboutORD263ORDINANCE NO.263 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL COUNTY,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-10-84 FROM GR GENERAL RURAL TO TRAILER HOMESITE ZONE (TH);AND FROM GR GENERAL RURAL TO CB -2 GENERAL BUSINESS ZONE; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Apache Junction,Arizona,Zoning Map for the parcels of land described as: Parcel No.1:(from GR General Rural to CB -2 General Business Zone) The South 350 feet of the West 1 of the West 1 of the West 1 of the Southwest A of Section 20,Township 1 North,Range 8 East, Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona;and Parcel No.2:(from GR General Rural to CB -2 General Business Zone) Beginning 350 feet North of the Southwest corner of Section 20; thence North along the west line 1300.02 feet;thence South 89°53'07"East 165 feet;thence South 300.21 feet;thenceSouth9027'44"East 60.83 feet;thence South 939.82 feet;thence North 89°53'50"West 175 feet to the point of beginning,in Section 20,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona;and Parcel No.3:(from GR General Rural to Trailer Homesite Zone (TH)) Beginning at the Southwest corner of Section 20;thence North along the west line 350 feet;thence South 89°53'50"East 175 feet to the true point of beginning;thence North 1240.03 feet; thence South 89°53'07"East 164.88 feet;thence South 00 00'25" West 1301.43 feet;thence North 89°53'50"West 154.73 feet to the true point of beginning,in Section 20,Township 1 North, Range 8 East,Gila and Salt River Base and Meridian,Apache Junction, Pinal County,Arizona; be and hereby is amended by changing the zoning district classification from GR General Rural to Trailer Homesite Zone (TH);and from GR General Rural to CB -2 General Business Zone,subject to the stipulation that the applicants dedicate the west fifty feet (50')and the south fifty feet (50')of the subject property for public roadway and associated purposes, and a sixty foot (60')right-of-way for the West Fourth Avenue alignment. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance,or any part of the code adopted herein by reference, are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause,or portion of this Ordinance,or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
