HomeMy WebLinkAboutORD266ORDINANCE NO.266 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE BY AMENDING CHAPTER 3 ADMINISTRATION,ARTICLE 3-10 PERSONNEL SYSTEM,PERTAINING TO PAID HOLIDAYS FOR CITY EMPLOYEES;REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS: SECTION I IN GENERAL That Chapter 3 ADMINISTRATION,Article 3-10 PERSONNEL SYSTEM, be amended to read as follows: ARTICLE 3-10 PERSONNEL SYSTEM A.That certain document entitled Personnel Policies,City of Apache Junction,Arizona,be amended to read as follows: RULE X.ATTENDANCE AND LEAVES SECTION 11.Paid Holidays:The holidays to be observed in the City are as follows: 1.January 1,"New Year's Day". 2.Employee's Birthday (effective January 1,1983). Note:Employees of Magistrate Court are excluded from this holiday effective January 1,1984). 3.Second Monday in February,"Lincoln Day". Note:This holiday pertains only to employees of the Magistrate Court effective January 1,1984). 4.Third Monday in February,"Washington Day". 5.Last Monday in May,"Memorial Day". 6.July 4,"Independence Day". 7.First Monday in September,"Labor Day". 8.Second Monday in October,"Columbus Day". 9.November 11,"Veteran's Day". 10.Fourth Thursday in November,"Thanksgiving Day". 11.Fourth Friday in November (Friday following Thanksgiving Day). 12.December 25,"Christmas Day". Said holidays shall be observed on the same day as the State of Arizona, (Note:When a holiday falls on a Saturday,the preceding Friday shall be observed.When a holiday falls on a Sunday,the following Monday shall be observed.)I t should be noted that Public Safety and other essential service employees may be required to be on duty on holidays in the interest of the public, health,safety,or general welfare of the City.Should the taking off of an employee's actual birthday present a schedule conflict within his/her department,the employee shall take the birthday holiday sometime within the pay period in which i t falls,as scheduled by the Department Head. Ordinance No.266 Page One of Two SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,clause,phrase or portion of this ordinance or any part of the code adopted herein by reference is, for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV DECLARING AN EMERGENCY It being necessary for the preservation of the peace,health and safety of the City of Apache Junction,Arizona,that this ordinance become effective immediately,an emergency is hereby declared to exist and this ordinance shall be effective immediately upon its passage and adoption. PASSED AND ADOPTED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,THIS 6TH DAY OF MARCH 1984.
