AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
PINAL COUNTY,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING
ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT
CLASSIFICATION IN REZONING CASE PZ-16-84 FROM GR GENERAL RURAL TO TRAILER
HOMESITE ZONE (TH);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING
FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Apache Junction,Arizona,Zoning
Map for the parcel of land described as:
Commencing at the Southwest corner of Lot 26,Section 18,Township 1
North,Range 8 East,Gila and Salt River Base and Meridian;thence
North 00 03'55"East along the westerly section line of Section 18,
a distance of 168.50 feet to a point on the said westerly section line
of Section 18;from which the Northwest corner of Lot 26,Section 18,
bears North 00 03'55"East 161.50 feet distant therefrom;thence
North 89°58'00"East a distance of 391.34 feet to the true point of
beginning;thence North 00 00'12"West;being parallel to the easterly
line of said Lot 26,a distance of 161.52 feet;thence North 89°57'53"
East being the northerly line of said Lot 26 a distance of 248.00 feet;
thence South 00 00'12"East being the easterly line of Lot 26,a
distance of 181.53 feet;thence South 89 0 58'00"West a distance of
33 feet;thence North 00 00'12"West a distance of 20 feet;thence
South 89°58'00"West a distance of 215.00 feet to the true point of
beginning in Section 18,Township 1 North,Range 8 East,Gila and
Salt River Base and Meridian,Apache Junction,Pinal County,Arizona.
be and hereby is amended by changing the zoning district classification
from GR General Rural to Trailer Homesite Zone (TH),subject to the
stipulation that the applicant dedicate the north thirty-three feet (33')
the east thirty-three feet (33'),and the south five feet (5')of the
subject property for public roadway and associated purposes.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions
of this Ordinance,or any part of the code adopted herein by reference,
are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause,or portion of this
Ordinance,or any part of the code adopted herein by reference is,for
any reason,held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.
