HomeMy WebLinkAbout1979-08-15 City Council Regular MinutesRegular Meeting of the City Council of Apache Junction August 15, 1979 A regular meeting of the City Council of Apache Junction was held on the 15th day of August, 1979 at the Apache Junction City Hall, pursuant to notice as required by law. The regular meeting was called to order at 7:00 p.m. by Mayor Virginia Seeman. The Invocation was presented by Marie Shanks. The Pledge of Allegiance was led by Vice -mayor John Granillo. Roll Call Members Present: Mayor Virginia Seeman, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman Hill and Marie Shanks. Staff Present: Susan Goodwin, City Attorney; Isabel C. Ballard, City Clerk. Minutes Regular Meeting August 1, 1979 Vice -mayor John Granillo made a motion to accept the minutes of the regular meeting of August 1, 1979 as presented and seconded by Jimmy Eidson.Six (6) voted yes, John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman Hill and Marie Shanks.One (1) abstained, Mayor Virginia Seeman. Special Meeting August 7, 1979 Jerry Burgess made a motion to accept the minutes of the Special Meeting of August 7, 1979 as presented and seconded my Marie Shanks.Six (6) voted yes, Mayor Virginia Seeman, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman Hill and Marie Shanks.One (1) abstained, Vice -mayor John Granillo. Petitions Joe Saggio„543 N. Ironwood, petitioned the City Council to dissolve the Planning and Zoning Advisory Board and stated the actions by the Board were immoral, dis- honest and devious. Reports by Officers Jimmy Eidson reported that Chief McDaniel had started to work today. Norman Hill reported that a Public Works employee had been hired and was working and that a second employee would start on Monday, August 20.Norman HIll introduced a representative from Empire Machinery, Mr. Jim Decker. Mr. Jim Decker presented information on costs of machinery and operation.He explained the advantage and disadvantages of the City acquiring their own machinery and have employees to operate it.He explained the equipment can be acquired by direct purchase, by purchase thru a lease, lease with a residual or by rental. Jim Decker explained each of these options to the Council and answered many questions from the council and audience.A lengthy discussion took place on heavy equipment the costs on rental, purchase, etc. Regular Meeting August 15, 1979 page 2 Norman Hill made a motion for Mr. Hal Anderson to grade the five washes that are in great need of being cleaned out and Jerry Burgess seconded.Six (6) voted yes, Mayor Virginia Seeman, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson and Norman Hill. One (1) abstained, Marie Shanks. Motion carried. Susan Goodwin, City Attorney, asked a question of Mr. Anderson on contractors insurance and needed to gather the information from him. A motion was made by Jerry Burgess to call an Executive Session for Sept. 5, 1979 and Sept. 19, 1979 on personnel at 6:00 p.m. on both dates and seconded by Marie Shanks. Motion carried unanimously. Mayor Virginia Seeman appointed Mr. William Vaughn on the Board of Adjustments in place of Mr. Binucci. Marie Shanks explained we are running out of space at City Hall and the Council discussed the situation.Susan Goodwin reported on the State Land as requested by Mayor Seeman. Vice -mayor John Granillo directed that the City Clerk put out requests for Sealed Bids on another modular unit. The City Clerk was also directed to find out on the office unit mentioned to the City Council by a citizen in the audience. A break was taken at this time. Norman Hill brought up the subject on the road grader once again explaining that Mr. Anderson didn't have any insurance, bonding, nor a contractor's license and felt before you can let a grader go out on the road, the insurance should be taken care of and referred to the attorney on the matter. Susan Goodwin explained that the City could have to pick up all of the insurance and the usual proceedures taken by contractors. A motion was made by Norman Hill requesting Susan Goodwin to explore the situation on the insurance prior to letting Mr. Anderson do any work and to call a Special Meeting August 18, 1979 Saturday morning at 9:00 a.m. and seconded by Jerry Burgess. Five (5) voted yes, Mayor Virginia Seeman, Vice -mayor John Granillo, Jerry burgess, Jimmy Eidson, and Norman Hill. Two (2) abstained, Thomas Damiano and Marie Shanks. New Business City Seal After review of the entries of the City Seal, Thomas Damiano recommended that a citizens committee select the seal.Margaret Carland, Ruby Forsburg and Doris Brooks volunteered to look over the entries and select the final three for City Council decision. The final decision is to be placed on the agenda for Sept. 5th. AORCC Grant Jerry Burgess explained the agreement between the City and the School District for a recreational park consisting of two lighted ball fields and three lighted tennis courts.Susan Goodwin explained one half of the expense to be shared equally by the City and the School District for design and construction cost after the Federal Grant. Jerry Burgess made a motion to authorize and .• the mayor to enter into an Regular Meeting August 15, 1979 page 3 agreement upon those terms subject to the City Attorney's approval on the final document from the County Attorney's office and seconded by Thomas Damiano.Motion carried unanimously. Proposed Ordinance on Motor Bikes Two ordinances were discussed by the City Council and the City Attorney explained the difference between the two ordinances.Marie Shanks suggested a citizens committee research and study the ordinances with both for and opposing sides participating. Mr. Harvey Morrison and Mrs. Jones spoke and asked questions concerning the ordinances. Planning and Zoning Research Personnel Althea Nunn, Acting Zoning Administrator, requested to hire a person in the Florence Court House to research legal abstracts. John Granillo made a motion to authorize Althea Nunn to negiotate an arrangement to hire a person for research purposes and leave it up to her descretion and Norman Hill seconded.Six (6) voted yes, Mayor Virginia Seeman, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson. One (1) voted no, Marie Shanks.Motion carried. City Engineer Consultant Althea Nunn, Acting Zoning Administrator, explained to Council the proposed subdivision regulations could not be implimented without a City Engineer.This does not need to be an employee, it could be a-consultant. It was decided that the Acting Zoning Administrator, the City Clerk, Thomas Damiano and the Chairman of the Planning and Zoning Commission should check into a consultant. Public Hearing Subidivision Regulations & Proposed Subdivision Standards & Principals Susan Goodwin and Wayne Balmer explained the proposed subdivision regulations and the proposed subdivision standards and principles and the need for them.Wayne Balmer described the details of the adoption of the proposed subdivision, what it means and why it was recommended. No public comments or imput were made. Roy Hire questioned the action on his petition submitted to the Council.Council directed the City Clerk to put the petition on the Sept. 5th agenda. Claims None. Miscellaneous Betty Swanson asked about Mr. Morvac stated the Corporation Friday at 9:00 a.m. He hoped would attend. He urged every Saggio's petition against the Advisory Committee. Joe Commission hearing on Palm Springs Moratorium was that citizens, councilmembers, and city attorney one involved to attend or write a letter. Regular Meeting August 15, 1979 page 4 Reconsideration of the moratorium will be put on the agenda for Saturday. Joe Saggio asked Vice -mayor John Granillo to respond to the question of justification of expenditures on the budget. Mr. Saggio was asked to ask the question next week of the vice -mayor.
