HomeMy WebLinkAboutORD379ORDINANCE NO.379 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,CHAPTER 1 GENERAL,BY ADDING ARTICLE 1-11 INITIATIVE PETITIONS;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS: SECTION I IN GENERAL That the Apache Junction City Code,Chapter 1 GENERAL,be amended by adding Article 1-11 Initiative Petitions,to read as follows: ARTICLE 1-11 Initiative Petitions 1,11-1 Number of Signatures Required 1-11-2 Petition Filing Deadline 1-11-3 Duties of the City Clerk 1-11-4 Responsibilities of the Applicant Sec.1-11-1 Number of Signatures Required Fifteen percent of the total number of registered voters qualified to vote in the last preceding municipal election at which a member or members of the city council were elected shall be the basis on which the number of electors of the city required to file an initiative petition shall be computed. Sec.1-11-2 Petition Filing Deadline All petitions submitted under this section shall be filed with the city clerk not less than four months preceding the date of the election at which the measures -so proposed are to be voted upon. Sec.1-11-3 Duties of the City Clerk A.Upon receipt of an application for an initiative petition number as provided by Arizona Revised Statutes 19-111 and amendments thereto, the City Clerk shall assign an official number to said petitions and issue that number to the applicant. B.The City Clerk shall furnish to each applicant an initiative petition form as provided by the Secretary of State's office and a copy of the text of Arizona Revised Statutes Title 19 Initiative,Referendum and Recall,and this Article 1-11. C.I t shall not be the responsibility of the City Clerk to furnish the applicant with a completed initiative petition form containing the proposed law or measure to be initiated or to provide the text of the proposed law or measure to be initiated. D.Unless otherwise stated by this code,the duties of the city clerk with regard to initiative petitions shall be the same as prescribed in A.R.S.Title 19 and amendments thereto,and the Arizona Constitution. Sec.1-11-4 Responsibilities of the Applicant I t shall be the responsibility of the applicant for an initiative petition to comply with the procedures for an initiative as prescribed in A.R.S. Title 19,the Arizona State Constitution and this Code. ORDINANCE NO.379 PAGE ONE OF TWO SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,clause,phrase or portion of this ordinance or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV EMERGENCY CLAUSE I t being necessaey for the preservation of the peace,health and safety of the City of Apache Junction,Arizona,that this ordinance become effective immediately,an emergency is hereby declared to exist and this ordinance shall be effective immediately upon its passage and adoption.
