August 18, 1979
There was a special meeting of the City Council of Apache Junction on August 18, 1979
at 9:00 a.m. pursuant to notice as required by law.
The Special Meeting was called to order by Mayor Virginia Seeman.
The Pledge of Allegiance was led by Vice -mayor John Granillo.
Roll Call
Councilmembers present:
Mayor Virginia Seeman, Vice -mayor John Granillo, Jimmy Eidson, Norman Hill, and
Marie Shanks.
Councilmembers absent:
Jerry Burgess and Thomas Damiano
Special Business:
Road Maintenance
Norman Hill explained there was a problem with insurance on the road grader hired so
the next person with insurance had been hired for twenty (20) hours because of the
emergency situation with the roads.
Susan Goodwin, City Attorney, explained she had prepared a contract for the emergency
work to be done on a short term basis of 20 hours maximum at $30.00 per hour with
equipment and operator, which can be increased at 20 hours incruments if so desired.
Norman Hill made a motion to ratify the contract and action which has been taken as an
emergency and seconded by John Granillo.Four (4) voted yes, Mayor Seeman, Vice-
mayor John Granillo, Jimmy Eidson, Norman Hill. Marie Shanks abstained.Motion carried.
Norman Hill made a motion to draw a new contract for a back-up grader to meet emergen-
cies on street maintenance and seconded by John Granillo.Motion carried unanimously.
Norman Hill explained he would be working with bid specs to request sealed bids for a
period of 30 days, on a grader.Jimmy Eidson suggested getting a copy of Pinal
Count's bids and specifications for comparisons.Susan Goodwin explained she had
checked into insurance and the problem of a contractor who had no insurance.An in-
surance consultant and insurance agent advised it would be unwise for the City to enter
into a contract with a contractor who does not carry his own insurance.After a lengthy
discussion, it was decided to accept new bids for a back-up contractor on an hourly
rate.
Trailer Office Units
Isabel Ballard reported she had looked at a trailer the City had in mind to purchase
as an office unit, and that she thought the price was too high for what was offered.
The City Council directed the City Clerk to request bids and the specifications are
to be a 14 X 60 with the exterior the same as the modular unit the city now has and
to be state certified for public use.Bids are to be opened on a modular unit at the
Council Meeting of September 5, 1979.
Moratorium
Susan Goodwin reported the hearing on Palm Springs Utility Co.It was asked that de-
cision on the matter be expidited.There was reason to believe the regulatory agent
for the state will order the Palm Springs Utility Co. to take immediate corrective
measures.It isn't certain what the order will contain.She explained the City
Council could reconsider the moratorium on the Palm Springs Utility expecially in
areas where there are no problems.Susan Goodwin explained the City has three choices,

leave the moratorium as it stands, lift it completely or change it to fit the areas
with no problems. The third alternative could create problemsoneof which would be
a certificate of occupancy.
Jimmy Eidson asked if the moratorium could be lifted until the Corporation Commission
had time to take acting with a date for that action to be done.Susan Goodwin ex-
plained it was requested of the Corporation Commission by the Attorney General's
office that Mr. Davis of Palm Springs Utility Co. provide preventative maintenance,
and a management audit be performed.If the Utility cannot correct the problems, the
utility be placed in receivership.
Council called for a break at 10:30 a.m.
John Granillo made a motion to postpone further discussion and decision on Palm Springs
Utility moratorium until August 22, 1979 at 6:00 p.m. and Norman Hill seconded.Four
(4) voted yes, Mayor Virginia Seeman, Vice -mayor John Granillo, Jimmy Eidson and
Norman Hill.One (1) voted no, Marie Shanks.
Clerk/Dispatcher
Jimmy Eidson explained the need of a police dispatcher.Jimmy Eidson made a motion to
authorize Chief McDaniel screen the applications and hire a aerWdispatcher for the
Police Dept. to work at the County Sheriff's Office at a salary of $9,000.00 annually
and seconded by Norman Hill.Three (3) voted no, Mayor Virginia Seeman, Vice -mayor
John Granillo, Marie Shanks.Two (2) voted yes, Jimmy Eidson and Norman Hill. Motion
failed.
Planning Conference
The Council discussed the Planning Conference and Norman Hill made a motion to author-
ize the Planning Director, if on board and if not, the Acting Zoning Administrator
to attend the Planning Conference in Flagstaff on Sept. 19, 20, 21, 1979 with payment
of $136.00 expenses plus mileage and meals and seconded by John Granillo.Motion
carried unanimously.
1979 AZ Tax Conference
John Granillo made a motion to postpone decision on the 1979 Arizona Tax Conference
until August 22, 1979 agenda so Council would have time to study the Conference agenda
and seconded by Norman Hill.Motion carried unanimously.
John Granillo made a motion to adjourn and seconded by Norman Hill.Carried unanimously
