HomeMy WebLinkAboutORD311ORDINANCE NO.311 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL,OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-47-84 FROM GR GENERAL RURAL TO CB -2 GENERAL BUSINESS ZONE; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Apache Junction,Arizona,Zoning Map for the parcel of land described as: A portion of the Northeast of the Northeast of Section 20, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,described as follows: Beginning at the northeast corner of said Section 20;thence North 89°47'00"West along the north line of said Section 20, 325.50 feet;thence South 00 05'15"West parallel to the east line of said Section 20,50.00 feet to the true point of beginning; thence continuing South 0°05'15"West 728.07 feet;thence North 89°55'45"West 975.09 feet to a point on the east right- of-way line of Plaza Drive 180.53 feet;thence North 11°51'38" East along the east right-of-way line of Plaza Drive 100.00 feet; thence North 0°04'15"East along the east right-of-way line of Plaza Drive 427.08 feet to a point of curvature on a 25.36 foot radius curve and whose tangent is 25.00 feet;thence on a curve with a delta of 89°58'45",a curve distance of 39.83 feet to a point on the Superstition Drive 50.00 feet right-of- way line;thence South 89°47'00"East parallel to the north line of said Section 20,929.88 feet to the true point of beginning;EXCEPT Ness Boulevard recorded in Book No.11 of Maps,No.24,•in Pinal County Recorder's Office,described as follows:Beginning at the northeast corner of said Section 20;thence North 89°47'00"West 326.50 feet;thence South 0 0 05'15" West 50.00 feet to the true point of beginning;thence South 00 05'15" West 728.07 feet;thence North 89°55'45"West 60.00 feet;thence North 0°05'15"East 707.98 feet to a point on a 24.97 foot radius curve;thence having a delta of Northwest 900 03'15",a curve distance of 39.26 feet;thence South 89°47'00"East 85.00 feet to the true point of beginning; be and hereby is amended by changing the zoning district classification from GR General Rural to CB -2 General Business Zone. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the code adopted herein by reference, are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause,or portion of this Ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
