HomeMy WebLinkAboutORD323ORDINANCE NO.323 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-56-84 FROM CR-1 SINGLE RESIDENCE TO CB -2 GENERAL BUSINESS ZONE; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Apache Junction,Arizona,Zoning Map for the parcel of land described as: Parcel No.1: That portion of the North of the Northwest * of the Southwest A of the Northwest *of Section 15,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Apache Junction,Pinal County,Arizona,lying south of the right-of-way of U.S.Highway 88;and Parcel No.2: That portion of the South I of the Northwest *of the Southwest *of the Northwest A of Section 15,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Apache Junction,Pinal County,Arizona,lying south of the right-of-way of U.S.Highway 88;excepting therefrom the following described portion thereof: Beginning at a point 28.31 feet east of the Southwest corner of said South I of the Northwest *of the Southwest *of the Northwest A of Section 15 and running thence East 259.79 feet to a point;thence North 10°34'West 193.75 feet to a point;thence South 490 38'West 294.17 feet to the point of beginning; be and hereby is amended by changing the zoning district classification from CR-1 Single Residence to CB -2 General Business Zone;subject to the stipulation that the applicant dedicate the east thirty-three feet (33')of the subject property for public roadway and associated purposes. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the code adopted herein by reference, are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,sub -section,sentence,phrase,clause,or portion of this Ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
