AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE BY AMENDING
THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING
CASE PZ-63-84 FROM GR GENERAL RURAL TO CB -1 LOCAL BUSINESS ZONE,AND
FROM GR GENERAL RURAL TO CR-5 MULTIPLE RESIDENCE ZONE;REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Apache Junction,Arizona,Zoning
Map for the parcels of land described as:
Parcel No.I :(from GR General Rural to CB -1 Local Business Zone)
Lot 26,Block 3,Amended Plat of Newtown,according to Book 5 of
Maps,Page 23A,records of Pinal County,Arizona;EXCEPT the west
120 feet;and
Parcel No.2:(from GR General Rural to CR-5 Multiple Residence Zone)
The west 120 feet of Lot 26,Block 3,Amended Plat of Newtown,
according to Book 5 of Maps,Page 23A,records of Pinal County,
Arizona;
be and hereby is amended by changing the zoning district classification from
GR General Rural to CB -1 Local Business Zone,and from GR General Rural to
CR-5 Multiple Residence Zone;subject to the stipulation that the applicant
dedicate the east seventeen feet (17')of Parcel No.1 for public roadway
and associated purposes.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance,or any part of the code adopted herein by reference,are
hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause,or portion of this
Ordinance,or any part of the code adopted herein by reference is for
any reason held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.
