HomeMy WebLinkAboutORD335ORDINANCE NO.335 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE BY AMENDING THE ZONING MAP CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-66-84 FROM GR GENERAL RURAL TO TRAILER HOMESITE ZONE (TH); REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Apache Junction,Arizona,Zoning Map for the parcel of land described as: The East /of the North of the South of the Northwest A of the Southwest A of the Southwest A of Section 18,also known as:the North of the East of Lot 31 in Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Apache Junction,Pinal County,Arizona; be and hereby is amended by changing the zoning district classification from GR General Rural to Trailer Homesite Zone (TH)subject to the following stipulations:1)that the applicant dedicate the east thirty-three feet (33') and the north twenty-five feet (25')of the subject property,including a half cul-de-sac with 20'by 20'cut-offs,for public roadway and associated purposes,but that at such time as that cul-de-sac would need to either be extended or eliminated,the City would at that time eliminate the bulb and deed that property back to the applicant or subject land owner;and 2)the parcel not be developed into a mobile home or R.V.park unless otherwise permitted by the City. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance,or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,sub -section,sentence,phrase,clause,or portion of this Ordinance,or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
