HomeMy WebLinkAbout1979-09-05 City Council Regular MinutesRegular Meeting of the City Council of Apache Junction September 5, 1979 There was a regular meeting of the Apache Junction City Council at the City Hall on September 5, 1979 pursuant to notice as required by law. The Meeting was called to order by Mayor Virginia Seeman. The Invocation was presented by Marie Shanks. The Pledge of Allegiance was led by Vice -mayor John Granillo. Roll Call Councilmembers present Mayor Virginia Seeman, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman Hill and Marie Shanks. Staff Present Ray Lee, City Manager; William McDaniel, Chief of Police; Althea Nunn, Acting Zoning Administrator; Michael Curtis, City Attorney; Susan Goodwin, City Attorney; Isabel C. Ballard, City Clerk. Minutes Special Meeting, August 13, 1979 Jerry Burgess made a motion to approve the minutes of the Special Meeting of August 13, 1979 as presented and seconded by Marie Shanks.Motion carried unanimously. Regular Meeting, August 15, 1979 Vice -mayor John Granillo made a motion to table the minutes of the regular meeting of August 15, 1979 until the next regular meeting and seconded by Thomas Damiano. Motion carried unanimously. Special Meeting, August 18, 1979 Vice -mayor John Granillo made a motion to approve the minutes of August 18, 1979 as presented and seconded by Thomas Damiano.Motion carried unanimously. Special Meeting, August 22, 1979 Jerry Burgess made a motion to approve the minutes of the Special Meeting August 22, 1979 as presented and seconded by Vice -mayor John Granillo. Six (6) voted yes, Mayor Virginia Seeman, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson and Marie Shanks. One (1) abstained, Norman Hill. Petitions Willdan Associates Mike Cline of Willdan & Associates gave a presentation to Council for the purpose of showing qualifications in planning services for airport facilities.Mr. Cline gave brochures to Council showing other projects the firm has helped with in other cities. Mr. Cline requested from Council an opportunity to discuss with staff some of the details that may be looked for in developing airport facilities. Regular Meeting September 5, 1979 Page 2 Tommie Bain - State Division of Mobile Housing Standards Tommie Bain spoke on saving lives in mobile homes. State of Arizona signed an agree- ment with HUD in 1977 to inspect all mobile homes built in Arizona.Any mobile home produced outside the state and coming into the state is inspected.Legislature said State Division of Mobile Housing Standards would have to protect the consumer.State Division of Mobile Housing Standards is supported from licensing fees from dealers. State Division of Mobile Housing Standards is asking local jurisdiction to help with the inspection which will require only local building permits and inspection.The City may charge up to $40.00 for an inspection, and no paper work or money needs to be turned over to State or the State will do the inspections with no revenue to the City. The agreement is to be staffed by City Manager and City Attorney prior to sub- mitting it for Council approval. Roger Spencer/Charles Ayers, Attorney on Palm Springs Utility Moratorium Charles Ayers discussed the moratorium with Council and City Attorney.Charles Ayers spoke on the behalf of approximately 150 property owners affected by the moratorium, on the legal problems and responsibilities of the City Council. City Manager Report Mr. Ray Lee called on Chief McDaniel to give a report on the purchases made for the Police Department.Chief McDaniel reported on the purchase of three vehicles from the Department of Public Safety, two (2) 1975 Fords, and one (1) 1974 Mercury.He has also purchased two portable radios from Motorola, with other equipment forth- coming shortly. Unfinished Business Being that Mr. Hier was not present the Mayor and Council directed the City Clerk that the petition by R. J. Hier be placed on the next Regular Meeting agenda. City Seal The Mayor and Council reviewed the four final selections of the City Seal by the Com- mittee. Marie Shanks instructed City Attorney to prepare a resolution accepting the City Seal.Norman Hill made a motion to accept entry #3 and Vice -mayor John Granillo seconded.Three (3) voted yes, Mayor Virginia Seeman, Jerry Burgess and Norman Hill. Four (4) voted no, Vice -mayor John Granillo, Thomas Damiano, Jimmy Eidson and Marie Shanks.Motion failed. Marie Shanks made a motion to accept entry #1 and to instruct the City Attorney to pre- pare a Resolution for the City Seal and seconded by Thomas Damiano.Motion carried unanimously. Announcement of drawing: Kenneth C. Balcomb, 800 W. Apache Trail, Apache Junction. Marie Shanks requested the Mayor to instruct the City Clerk to inform the winner of the City Seal entries of the Council's decision and to present the Council with a first cut. City Cletk was so instructed. Off Road Vehicle Ordinance The Mayor and Council discussed along with public participation the Off -Road Vehicle Ordinance, and informed any wanting to study the proposed Ordinance can request one from City Hall. Report on Archie Lowe Case Mike Curtis, City Attorney, reported on the status of the Archie Lowe Case.Mike Regular Meeting September 5, 1979 Page 3 Curtis stated the attorneys are still in the process of finishing a form of agree- ment to settle the civil matter.After the Civil matter is settled, criminal matter will be presented to court for disposition.The civil matter should be settled within the next week or so. Joe Saggio asked the attorney's name representing Archie Lowe and was told Robert Slausher by Mike Curtis.When the City Attorney went on to tell of Mr. Slausher's qualifications Mr. Saggio said he didn't ask for the man's history.Mayor Virginia Seeman called Mr. Saggio out of order after some arguementive statements.The Chief of Police was requested to escort Mr. Saggio out of the Meeting Hall.Mr. Saggio was requested not to return for the evening. Mr. Curtis stated that he has'beenAarid will continue to be available to answer any concerned citizen's inquires.He sub- mitted to Council that neither he nor Miss Susan Goodwin had received inquires that have not been answered. Council recessed for a short break. The Council discussed the need of Special Meeting to further discuss the Moratorium. Norman Hill made a motion to have a special meeting on Wednesday, September 11, 1979 at 6:00 p.m. and Vice -mayor John Granillo seconded the motion. The motion carried unanimously. New Business Sealed Bids The following sealed bids on a modular building were opened: Bonded Mobile Homes, Inc., 2044 W. Apache Trail, Apache Junction, AZ $16,400; Edgewood Leasing, 30 W. Ray Road, Chandler, AZ 85224, $16,788.18;Porta-House Inc., 2150 W. Van Buren, P.O. Box 6533 Phoenix, AZ $19,235.00;Design Space Int'l, 2940 N. 29th Drive, Phoenix, AZ, $15,650;Modulaire Leasing Company, 3171 W. Osborn Road, Phoenix, AZ $15,650 plus $425.00 for a 4 -ton a/c unit. Vice -mayor John Granillo asked for a study of each bid with Norman Hill, Jimmy Eidson, Thomas Damiano, Jerry Burgess and City Manager Ray Lee.The recommendation shall be put on the agenda for action on the September 12th Special Meeting. Road Grader Norman Hill reported he had a Bid of $87,035.52 on a road grader.Norman Hill made a motion for the City of Apache Junction to purchase the grader immediately from Empire Machinery and Thomas Damiano seconded. The motion carried unanimously. Vice -mayor John Granillo made a motion to authorize and direct the Mayor to go into an agreement with Valley Nation Bank, Apache Junction branch, to establish a warrant account of $65,000.00 to be used for the equipment this specific time and any other needs in the future, and seconded by Thomas Damiano.The motion carried unanimously. PZ-35-79 Rezoning Superstition Estates After Council discussion with Mr. Tom Keys, a realty representative, and Althea Nunn, Acting Zoning Administrator, Marie Shanks made a motion to instruct the zoning depart- ment to get lot sizes, facts and figures and give Council accurate information and seconded by Norman Hill.The motion carried unanimously. PZ-1-79 Marie Shanks made a motion to approve and adopt the zoning change requested by Frank Rowland and seconded by Thomas Damiano.Althea Nunn stated the Plannning and Regular Meeting September 5, 1979 Page 4 Zoning Commission recommended to Council approval of rezoning to CB -2.Five (5) voted yes, Vice -mayor John Granillo, Thomas Damiano, Jimmy Eidson, Norman Hill and Marie Shanks.Two voted no, Mayor Virginia Seeman and Jerry Burgess.The motion carried. PZ-2-79 A request by John Kubler to rezone to CB -2 with a stipulation to be 300' deep. The Planning and Zoning Commission recommended to Council for approval.Jerry Burgess made a motion to approve the rezoning requested by Mr. Kubler and seconded by Vice -mayor John Granillo. Six (6) voted yes, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano, Jimmy Eidson, Norman Hill and Marie Shanks.One voted no, Mayor VS.rginia_ Seeman.The motion carried. League Conference The City Council discussed the Councilmembers and Administrative Personnel attending the League of Arizona Cities & Towns conference. Marie Shanks made a motion to approve attendance of City Manager, Chief of Police, Mayor, City Clerk and Marie Shanks to the League Conference on October 2, 1979 thru October 5, 1979 and seconded by Norman Hill. Motion carried unanimously. A Proclamation for Senior Health Fair Day was read by Marie Shanks: Proclamation WHEREAS, the State of Arizona now has the country's fastest growing elderly population with an increase of 79% between 1960 and 1970 and, WHEREAS, Apache Junction is one of the fastest growing cities in the State of Arizona with a large population of senior citizens, and WHEREAS, the senior citizens of Apache Junction are anxious to lead productive lives and continue as active members of this community, and, WHEREAS, the health and well-being of the City's elderly is of vital importance to our City, THEREFORE, I, Virginia Seeman, Mayor of the City of Apache Junction, Arizona, do on this day proclaim the 15th day of September, 1979 Senior Health Fair Day and urge all citizens to this City to recognize the many past contributions of our elderly and to encourage and support them for their participation in the society in which we all live. Marie Shanks made a motion to proclaim September 15, 1979 Senior Health Fair Day and seconded by Vice -mayor John Granillo.Motion carried unanimously. Stateland - Chamber of Commerce Mayor Seeman explained the Chamber of Commerce made application years ago for some acreage within the 80 acres for the same site as the City of Apache Junction.The Chamber of Commerce and City Council met to agree to lease a portion to the Chamber upon purchase by the City. Thomas Damiano made a motion for the City Council to direct the City Attorney to create a resolution under which the City of Apache Junction formally recognizes Regular Meeting September 5, 1979 Page 5 the Apache Junction Chamber of Commerce as the Civic Advertising Arm of the City of Apache Junction, in accordance with the provisions of ARS 9-493, and that direction be given to the City Attorney to prepare a resolution of intent to set aside one half acre parcel of land within Section 16, Township 1, North Range 8, East GSRB & M bordering on the Apache Trail, more specifically known as the municipal complex parcel, and that this action be contingent upon the City's successful acquisition of approximately 100 acres of land from the State Land Commission and seconded by Jerry Burgess. Motion carried unanimously. Claims Vice -mayor John Granillo made a motion to approve payment of the outstanding bills and seconded by Mayor Virginia Seeman. Motion carried unanimously. Miscellaneous Jimmy Eidson made a motion to direct the City Attorney to draft an Ordinance banning strip teasing, topless waitresses, etc., and seconded by Jerry Burgess. Motion carried unanimously. Doris Matthews asked Council about the City Seal and was answered the third entry had been selected. Discussion was also held on the agenda.Mr. Lee, City Manager, stated a news media mail box had been set up in City Hall.News media could pick up copy of the agenda on Friday afternoon. Vice -mayor John Granillo made a motion for City Council to adjourn and seconded by Jerry Burgess. Motion carried unanimously. Meeting adjourned: 10;00 p.m. 2tApproved this /7i/.2 day of 1979.
