CALL TO ORDER Mayor Nerdy called the meeting to order at 7:03 p.m. INVOCATIONB. I Vice Mayor Wilson gave the invocation and Councilmember Evans led the meeting attendees in the Pledge of Allegiance. C. CONSENT AGENDA Councilmember Barker moved and Councilmember Rizzi seconded that the consent agenda be accepted as presented. 1. 19-214 Consideration of acceptance of agenda. The agenda was accepted. City of Apache Junction,Arizona page 1 City Council Meeting Meeting Minutes May 21,2019 2. 19-215 Consideration of approval of minutes of regular meeting of May 7, 2019. The minutes were approved. E. AWARDS, PRESENTATIONS AND PROCLAMATIONS 3. 19-224 Presentation of proclamation recognizing the week of May 13-19, 2019 as National Salvation Army Week. The proclamation will be accepted by Major Kris Saurez. Mayor Serdy read the proclamation designating the week of May 13-19,2019 as National Salvation Army Week. The proclamation was accepted by Major Kris Saurez. 4. 19-228 Formal presentation by mayor of certificates of graduation to the graduates of the 21 st Citizen Leadership Institute(CLI). Public Information Officer Al Bravo introduced the graduating class of the 21st Citizen Leadership Institute. F. ANNOUNCEMENT OF CURRENT EVENTS 5. 19-216 Announcement of current events from mayor and councilmembers. Councilmember Barker mentioned several councilmembers were able to attend the D.A.R.E. graduation. She attended the Pinal Partnership breakfast,and Councilmember Rizzi was present for the donation from Curt Fonger to"Paws and Claws"presented by his wife Marta Saint James. Councilmember Schroeder recognized the graduating classes from Imagine Prep Superstition High School. Over 25 scholarships were awarded and wished the kids great success in their endeavors. Councilmember Rizzi stated the community is amazing with all their support and volunteering to the"Paws and Claws"facility. The donation was significant. She recognized all the graduates and the other students advancing up a grade. Vice mayor Wilson stated he attended an agriculture and water resources meeting last week. He stated that while the county has had some relief of the drought conditions due to the significant rains this year,Pinal County will be impacted the most this year on the agricultural front. The state is still in a drought and he reminded everyone to continue water conservation efforts. Councilmember Evans stated several councilmembers and the community participated in the annual food bank food drive through the postal service. Wednesday,May 22nd there will be a health care job fair at Empowerment Systems. Veterans will be granted access first from 3:00 to 3:30 p.m.then the general public will have access until 6:00 p.m. Councilmember Struble stated he and councilmember Schroeder participated in the Friends of A.J.annual fundraiser. After expenses they raised about$6,800. He attended the D.A.R.E. graduation as well and was impressed that they combined the graduating classes from all the schools. It provided a more atmosphere of community and the speeches on what the student gained from the class was impressive and inspirational to hear. He announced a local 7th grade student,Logan Reichwald,who won the National Bull Riding Championship last year in south Dakota has made the finals again and will be headed back to the National championships this summer. He asked the community if they can help the family defray some of the costs related to this trip,please do. City of Apache Junction,Arizona Page 2 City Council Meeting Meeting Minutes May 21,2019 Mayor Serdy commented on the food bank food drive announced City Manager Bryant Powell and Police Chief Kelly were there working as well. He mentioned the very generous donation to the city from local artist Merrill Orr who was unable to attend the meeting to receive his certificate of recognition,so he delivered it personally. He announced Monday,May 27th at Mountain View Cemetery starting at 9:00 a.m.there will be a Memorial Day Ceremony with many riders from different legions to honor those who gave the ultimate sacrifice. G. CITY MANAGER'S REPORT 6. 19-217 City manager's report. Mr.Powell thanked the Council's and community's support given to such a great shelter. Cities do not have such a program and Apache Junction is very proud of this unique shelter. He announced the city will be accepting applications for its boards and commissions later this summer. Applications will be available on line and the city will be sending out those announcments around August/September. The Pinal Partnership group had a meeting recently where discussions revolved around the homebuilders in the valley. He stated the panel received an Apache Junctionopoly game which recently came out; it fit right in with the discussion of that meeting. 7. 19-149 Introduction of and discussion with new Chief Executive Officer, Denny Barney, of East Valley Partnership. Mr.Powell then introduced Denny Barney,the Chief Executive Officer of the East Valley Partnership. Mr.Barney provided a brief update related to jobs,construction and efforts in promoting and supporting the region. He stated for the third year in a row,Maricopa County is the largest growing county in the U.S. While Apache Junction is in Pinal County,it is so close to Maricopa County the impact of that growth extends to Apache Junction. He stated statistics show Maricopa County is in the top five in the country for job growth. 8. 19-223 Introduction by Steve Byfleld of the new Chief Executive Officer, Denise Hart, of Apache Junction Chamber of Commerce. Mr.Powell then introduced Steve Byfield who then introduced the new Chief Executive Officer of Apache Junction Chamber of Commerce,Denise Hart. Ms.Hart provided the Council with a brief background of her experience and future plans for the Chamber. She announced they hope to re-brand the chamber next year. They will be celebrating their 60th Anniversary next year. They will implement quarterly meetings,additional education seminars and a speaker series,increase social media and support of the community members through social media,member recruitment and retention,and the shop local program with a membership card. H. PUBLIC HEARINGS 9. 19-234 Consideration of application for a new Series 9 Liquor Store License for Heng Chao for the Canyon Food Mart located at 1000 E. Old West Highway, Apache Junction, AZ. 85219. The next step in this process is for the council City of Apache Junction,Arizona Page 3 City Council Meeting Meeting Minutes May 21,2019 to hold a public hearing on the application and make a recommendation for approval or denial to be forwarded to the Arizona Department of Liquor Licenses and Control. Deputy City Clerk Jennifer Pena briefed the council on the item. Councilmember Rizzi moved,seconded by Vice Mayor Wilson to recommend approval of the Series 9 liquor store liquor license for Canyon Food Mart. Yes: 7- Mayor Serdy, Vice Mayor Wilson, Councilmember Barker, Councilmember Evans, Councilmember Rizzi, Councilmember Struble and Councilmember Schroeder No: 0 10. 19-235 Consideration of application for a new Series No. 6 Bar Liquor License for Duane Earnest Carble for Tipsy Kow Smokehouse & Spirits located at 185 N. Apache Trail, Apache Junction, AZ 85120. This matter was continued by the council with a vote of 4:3 at the city council meeting of May 7th, 2019, in order to provide the applicant additional time to handle some building permit irregularities. The next step in the process is for the council to hold another public hearing on the application and make a recommendation for approval or denial to be forwarded to the Arizona Department of Liquor Licenses and Control. Deputy City Clerk Jennifer Pena introduced the item stating it had been continued from the May 7th Council meeting in order to allow the applicant time to rectify building permit irregularities. She stated Staff would be providing an update on the matter and the applicant was present as well. Building and Safety Manager Dave Zellner stated some updated information which arrived earlier that day was shared with staff. He met with Mr.Carle and Mr. Leitzell on Friday the 10th after the May 7th meeting. They went over the items they were trying to work out and upon completion of that meeting,staff was very confident the applicant understood the work and process required was clearly articulated. The city received some information on Monday,May 20 and again today,Tuesday May 21,yet there are still missing pieces to get the permit issued. Councilmember Evans asked if Tipsy Kow has identified a licensed contractor. Mr.Zellner stated for the work that was done on the bar no. They've done the electrical and the plumbing. Councilmember Evans said they still don't have a permit because they don't have a license contractor? She inquired as to how much the permit cost. Mr.Zellner stated the balance remaining on Mister Carble's account is between$80.00 to$100.00. Mayor Serdy thought that some of the work related to the bar did not need a contractor because it was millwork and it was just like placing a piece of furniture in the building. City of Apache Junction,Arizona Page 4 City Council Meeting Meeting Minutes May 21,2019 Mr.Zellner said that was not what City staff discussed with Mr.Carble on Friday. It is a new structure,it changes the floor plan. It has to meet certain requirements and this matter requires a permit. Councilmember Rizzi stated she visited the establishment to look at the bar. She said it was not constructed it was moved in like the table and chairs. She inquired if it was moved in like a piece of furniture. Mr.Zellner stated that with the pictures he saw today he is not sure it was moved in. It looks like the bar was constructed inside the facility. Mr.Zellner said he met with them at the site. He saw the bar from one side,they are still working things out in order to get a permit which allows them to inspect. He stated that is the process that everyone follows. The pictures he saw that shows the inside(or back side)of the bar does not look like it was moved in like furniture. It looks like it was built on-site. Councilmember Rizzi said the city has everything else signed off by a contractor. Mr.Zellner clarified stating they have information as to which contractor will take responsibility of the work that was done by someone else,prior to permits being issued. Mr.Zellner stated there are still issues to be resolve on those matters,but they have not gotten that far because permits have not been issued. It is the same for the bar. A permit has not been issued and therefore the city has not been able to inspect. Councilmember Rizzi clarified that a permit cannot be issued until there is a licensed contractor. Mr.Zellner stated that is the way the city has always executed state law. Councilmember Rizzi inquired specifically what is it about the bar that is throwing red flags. She said there's no water to it,there's no electricity to it and since the bar was moved in it probably needs to be secured. Mr.Zellner stated this(the bar)is not exempt from the city's permitting list per city code.It has to meet ADA requirements,it has been presented as work done elsewhere and brought in,but still needs to be inspected. Mr.Zellner stated that when you build something on-site or you change the layout of the space it changes the permitting requirements. Councilmember Rizzi asked what type of contractor are they having trouble finding. Mr.Zellner said they clarified that on a Friday. They need a contractor that is licensed for whatever the state category requires. So a general contractor,which is an elevated level,the city is not requiring a general contractor. Councilmember Rizzi said she hears the applicant has reached out to several contractors and she doesn't understand the mix-up,or the difficulty in getting this special type of contractor. She does not understand how development services can go in and say that it is not safe,yet when the work is done,how come you can't determine the work is safe. City of Apache Junction,Arizona Page 5 City Council Meeting Meeting Minutes May 21,2019 Mr.Zellner said the city's goal is to be fair to each individualiapplicant that spends money for an architect,hires a contractor or gets a permit before they do work. The city is consistent in order to be fair to all applicants. Councilmember Rizzi asked how the city has the experts to determine something is not safe or needs a permit but we don't have the expertise to determine that it is safe once built. She asked if it's a liability issue that the city wants someone else to be liable. Mr.Zellner asked if her concern was with the city requiring a contractor or requiring the permit to begin with. She asked what is it that's throwing red flags and how is that we can go from determining something's unsafe to not being able to determine it is safe. City Attorney Joel Stern asked Mr.Zellner to clarify what the holdup was on the permit from a technical standpoint. Mr.Zellner stated you are required to have a licensed commercial contractor for commercial projects on the permit. Mr.Stern asked if he has discussed this with Mr.Carble directly and in those simple terms. Mr.Zellner stated yes,several times. Mr.Stern,so there is a lack of a general contractor. Mr.Zellner stated not a general contractor but a licensed contractor for that type of work. The city does have licensed contractors that are willing to sign off on the electrical and plumbing,but not for the bar. Councilmember Evans inquired that because the applicant did the work themselves,a license contractor is not willing to put themselves at risk for work someone else has done. They do not want to risk their license for work performed by someone else. Mr.Zellner stated that could be the issue he just does not know,but it has come up in other cases. Mayor Serdy asked if the city has a list of licensed contractors available for individuals when they come in. Not that the city would be recommending them,but just to provide a list of licensed contractors. City Manager Bryant Powell stated on this case two weeks ago tonight Staff agreed to meet with the applicant on Friday May 10. After that meeting,Development Services Larry Kirch provided an update on the following Monday that the applicant stated there was a contractor working with them. Then yesterday the city was informed there was no licensed contractor and today the city was receiving photos from the applicant showing design work that is not from a contractor. The typical process is you have a contractor design and show staff plans before a permit is pulled, because the permit is specific to the plans so that the city knows what is being constructed and is able to provide feedback on how to comply with various code requirements. Councilmember Rizzi stated this is not a built-in item. It was purchased and moved in like a piece of furniture. She is trying to understand what the issue is with a piece of furniture that was brought in. City of Apache Junction,Arizona Page 6 City Council Meeting Meeting Minutes May 21,2019 Development Services Director Larry Kirch said this is an alteration to the floor plan that requires a permit. The fact that it was built somewhere else and brought in is irrelevant. It is an alteration that requires a permit from the building department. The second question is can we inspect things. The city only inspects things once a permit is issued. We have the expertise to inspect things only after a permit is issued. No permit has been issued. We have a contractor for plumbing that was done without a permit, we have a contractor for electrical that was done without a permit,a bar that was brought in without a permit,which is an alteration to the building,which requires a permit because it is not exempt as Mr.Zellner has indicated. It requires a licensed contractor to put their name on it and then a permit is issued,and then the city can inspect it. Mr.Kirch then spoke on another case the city just handled two weeks ago. Stating another bar came in,the city was out doing the inspection and noticed work had been done without a permit. They addressed this with the business owner,that business owner came in the next day with a licensed contractor and it was all handled by the public hearing date,which was just a few days away. Work does happen before people get permission they know this. The troubling thing is the city has already been through this once with the applicant in another building,they have had meetings with the applicant before and a permit still has not been applied for. City Manager Mr.Powell stated this is a liquor license application but the recommendation of denial is based on the alterations to the building without a permit and whether it meets ADA requirements. Mayor Serdy asked the applicant to come forward again to address the ADA requirements. Mr.Carble said they received an email from Mr.Zellner on how they are to address ADA requirements. He had a contractor come in and do the work based on the measurements provided. The ADA portion has been done. Councilmember Evans said so a licensed contractor came in to do the ADA work but wouldn't sign off on the bar? Mister Carble stated it wasn't a license contractor it was a handyman. The confusion lies in the scope of the work to the bar that needed to be done. He is receiving conflicting information from the contractors saying it does not require a permit. Councilmember Evans asked if Mr.Zellner or was it Mr.Kirch stated you did not need a license contractor to inspect the bar? Mr.Carble said at the last council meeting he said it was or wasn't millwork,he could not recall the exact phrase,but that statement implied a permit was not required. If you look at the bar it's just a counter,there is no electrical,no plumbing,so a permit was not required. Mr.Carble stated the bar(referred to earlier as a counter)that was brought in was anchored down. They added extra anchors to it,if there is a design flaw,they are willing to fix it,if it needs an extra brace they will fix it,whatever it needs they are willing to do that. But at this stage the work has been completed,well the ADA portion of it has been completed. City of Apache Junction,Arizona Page 7 City Council Meeting Meeting Minutes May 21,2019 Councilmember Evans said I'm confused you said it's two things you said it's a counter but it's really a bar so you're going to be serving drinks on top of it is that the idea? Mr.Carble stated yes. Councilmember Evans said so the handyman that you had,was not a licensed contractor, correct?,and that's why he could not sign off on the installation of the bar or the structural integrity of it. Mr.Carble said he could sign off on it but the city is requiring a licensed contractor. Several of the licensed contractors that he has spoken to said they're willing to sign off on it but the information that he's getting from them is that the city comes in first,does the inspection,creates a punch list,and then the licensed contractor works from that punch list. Councilmember Evans asked him what has stopped him from doing that. Mr.Carble said they don't have a punch list from the city. Councilmember Evans asked why he had not hired a contractor to do work on the bar. Mr.Carble stated the licensed contractors would like a bucket list first. They want the inspection first so that they can get a list from the city. The contractors do not want to make themselves liable for something that wasn't quite correct. Councilmember Evans said that is correct. But what Mr.Zellner is saying is that the city does not come in first,even though they came in on their day off to help you and provide you with a list. She is confused as far as what the contractor is needing versus what the city has told him what the process is. Councilmember Rizzi asked if the business owner himself can come get the permit she thought that he could come in to get the permit. Mr.Zellner stated anyone can come pick up an application but the city cannot issue a permit until a licensed contractor is listed on that application that will be responsible for work done under that permit. Assistant City Manager Matt Busby said the requirement for a licensed contractor is not a city requirement,it is a state law requirement. We can't ignore state laws so before we issue a permit we have to know that there is a licensed contractor dealing with those items related to what is listed on the application for a permit. Councilmember Barker said the process to get a permit is this: 1. Applicant or other-comes in,asks for an application for a permit 2. Takes it home, fills it out,gets a licensed contractor to sign off on the application 3. Then either party can bring in the application 4. Gets a permit from the city 5. Goes back to the business does the work 6. Comes back to the city and says we are ready for an inspection 7. The city goes and performs the inspection and based on that will let the applicant know what needs to be done by providing a"punch list"or signs off on the work. Mr.Zellner stated that is correct. City of Apache Junction,Arizona Page 8 City Council Meeting Meeting Minutes May 21,2019 Councilmember Rizzi said she had a question for the business owner. She said it sounds like you have contacted several people trying to get a licensed contractor but they are either not showing up or they are not the right type of contractor so you have made the attempts. Mr.Carble stated yes. She asked him,you are a restaurant,are people sifting at this bar eating food from the bar? Mr.Carble said yes. Mayor Serdy asked if there were any other questions or comments. He then asked the applicant if he is going to get a licensed contractor. Mr.Carble said yes he will get a licensed contractor once he gets a bucket list so that he can get the inspection done. Councilmember Barker stated Mr.Carble you just said that you need a bucket list from the city again after we just reviewed the steps that you need to take in order to get a permit from the city. You come in and pick up an application for a permit,take it home,fill it out,have the contractor sign off that he'll be the contractor on the project,you bring it back to the city,you get a permit, do whatever work it is you need to do,you contact the city to perform an inspection,and that is where the bucket list comes from. You cannot get a list from the city until you have a licensed contractor to do the work. Councilmember Barker expressed concern and discontentment with the process that businesses think they can skirt the system by moving walls and doing construction work without pulling a permit. Councilmember Struble agreed with Councilmember Barker,there are businesses that we never hear about because they're doing the process correctly,or they managed to get away with doing work without a permit,but there is a history here with the applicant. Council has been told in the past things will be done and they were not done and therefore past history does play a role in this application. The process was very well delineated by Staff, Councilmember Barker,by city ordinance,by state law and there still seems to be a problem in understanding the process. Mr.Carble stated he does understand the process to an extent. He stated this is the second time he has gone through the process. The first time he did this,there were so many issues with the other building he's trying to figure out what the next step is for this building and to get past this issue. He stated contractors are a problem for him. He stated he could find people to sign off on the work for him but what he's getting from the people that are willing to help is that they want that list from the city to move forward. So he's in the middle. He wants to get them what they need and he wants to make the city happy,but he can't figure out how to accomplish that. Councilmember Evans said you keep talking about putting the cart before the horse,because the list is only generated after you apply for the permit. The city does not give the list first. They have already met with you,told you what you needed to do,how to do it,and you went ahead and did the work anyway. You still haven't applied for a permit. Mr.Carble stated he went through the list from Mr.Zellner and all that work has been completed. City of Apache Junction,Arizona Page 9 City Council Meeting Meeting Minutes May 21,2019 She askedif he has done/provided the diagramidrawing,the building sketches that was asked for. Mr.Carble stated before the meeting he didn't realize that was necessary. They went through the list of things that needed to be done and he has completed those. He stated that Mr.Zellner told him a hand diagram would work and this was conveyed to him in their earlier meetings as well. Councilmember Rizzi said Mr.Carble is already open for business,already serving food,already using these structures and the only thing not happening is he is not serving alcohol. The Council is a recommending board. We do not approve or disapprove the license,but when our recommendation goes to the liquor board do they see all that we see that is happening? Will they have all the information? City Attorney Stern stated the Board will receive what has been presented to council,your recommended motions the minute excerpt and the recommendations from the other entities. Councilmember Rizzi suggested that if the Council is making a recommendation on whether he can sell liquor,because he is already serving food and using the furniture,she does not understand the concern on letting the final decision be with the State. The State will either approve or deny. If they see an issue,they will have the same information they do. Councilmember Rizzi inquired as to the deadline and what the process is if this does not get approved and does this cost the applicant City Attorney Stern stated the city has 60 days to submit its recommendation to the state. The council has continued it once. While they have the authority to grant or deny a liquor license they rely on local boards when they make a negative recommendation. Councilmember Rizzi inquired if they ever go against a city's recommendation. He stated sometimes they do. A building permit is a basic element of a business and if the council says they do not have a building permit that's an important factor to consider. He stated if you don't act on it is presumed approved. But if you do act on it,it will go with your recommendation. Councilmember Rizzi inquired if we had a date as to when the city received the application. Deputy City Clerk Ms.Pena stated the city received the application on April 1st,and at this point the application was at 51 days. City Attorney Mr.Stern asked if the council acts on this tonight,how long it will take to transmit the record to the state. Deputy City Clerk Pena stated a few days so it might be mailed next week. Mayor Serdy stated this is a public hearing and called for any more comments from the public. There were no more comments from the public so he closed the public hearing. He asked Council if there was any more discussion and then asked for a motion. Councilmember Rizzi moved,seconded by Mayor Serdy,that the application for a new Series 6 Bar liquor license submitted by Duane Earl Carbone for Tipsy Kow Smokehouse and Spirits located at 185 N.Apache Trail be recommended for approval to the Department of Liquor City of Apache Junction,Arizona Page 10 City Council Meeting Meeting Minutes May 21,2019 Licenses and Control. Yes: 2-Mayor Serdy,Councilmember Rizzi No: 5-Vice Mayor Wilson,Councilmember Barker,Councilmember Evans,Councilmember Schroeder, Councilmember Struble Motion Failed 2-5. Councilmember Evans moved,seconded by Councilmember Barker that the application for a new Series 6 Bar liquor license submitted by Duane Earl Carbone for Tipsy Kow Smokehouse and Spirits located at 185 N.Apache Trail be denied for lack of building permits in the construction of the bar to date. Yes: 5-Vice Mayor Wilson,Councilmember Barker,Councilmember Evans,Councilmember Schroeder, Councilmember Struble No: 2-Mayor Serdy,Councilmember Rizzi Motion carried 5-2. 11. 19-212 Presentation, discussion and public hearing on the February 14, 2019 draft (updated April 23, 2019) Land Use Assumptions, Infrastructure Improvements Plan and Development Fee Report. Development Services Director Larry Kirch stated the city is in the process of updating its fees. This update is required every five years and includes two documents: 1. Land Use ass umptions/Infrastructure Improvement Plan and Development Fee Report and 2.an ordinance for Volume 11 chapter 7 of the code. They have held several meetings on this to receive public input and recommendations for changes which have been incorporated into the fee schedules. Residental fees have been reduced from what they were 5-6 years ago from$9,000 to$4,925,but will increase this year by$1,000. On the Non-Residential side the fees are actually decreasing this year. He then summarized the next steps in the process and meetings they have had with developers. This process is very regimented by statute. There will be a public hearing on July 2nd and another on August 6th. The effective date for the fees will be October 21,2019. Mayor Serdy opened the public hearing. Mr.Tim Sheean expressed his concern with the fee schedule is that for the small builder are expensive. Receiving no other comments from the public,the Mayor closed the public hearing. Council and staff held discussion on how the fees were derived. 12. 19-225 Presentation, discussion, public hearing and consideration of Ordinance No. 1474, case PZ-1-19, a city-initiated rezoning request,for the Prickly Pear RV Park located at 1630 W.Apache Trail,from RVP (Recreational Vehicle Park) to B-2/PD (Old West Commercial by Planned Development). City of Apache Junction,Arizona Page 11 City Council Meeting Meeting Minutes May 21,2019 Development Services Director Larry Kirch introduced Kelsey Schaftnik planning intern within the department to present the zoning case PZ-1-19 a city-initiated rezoning for Prickly Pear RV Park. Ms.Schaftnik presented the zoning case which would change zoning for the area from RVP (Recreational Vehicle Park)to B-2/PD(Old West Commercial by Planned Development). Councilmember Barker inquired if the zoning changes,will the RV's be required to move. Ms.Schaftnik stated no,but when the owner decides to make changes they may then require the RV's be removed. Councilmember Evans inquired why a certain parcel was zoned the way it was. Senior Planner Rudy Esquivias stated the zoning is a"hold over"from past county zoning. Councilmember Evans inquired whether the billboard with the lease which will be up in August will be removed. Mr.Esquivias stated that is what they agreed upon. Public Information Office Al Bravo briefly updated the council on the US census for 2020. April 1, 2020 will be the census kick-off. You will be able to respond to the census questions by mail,by phone and online. In the past the city has been able to support the census by having a Complete Count Committee. this committee is comprised of councilmembers,non profit organizations, local businesses,faith based community and from the educational community. There has already been a meeting this year and another will be held in June where representatives from the census bureau will be present to help with the campaign and how to conduct this census. With a census,comes increased jobs. These will be the door to door census workers and those that will continue compiling the data after the count.
