L TO ORDER Mayor Serdy called the meeting to order at 7:03 p.m. B. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Wilson gave the invocation and Councilmember Rizzi led the meeting attendees in the Pledge of Allegiance. C. ROLL CALL Councilmember Schroeder participated by phone. CONSENT AGENDA Councilmember Barker moved,seconded by Councilmember Rizzi that the consent agenda be accepted as presented. . 1 - 7 Consideration of acceptance of agenda. The agenda was accepted. 2. 19-248 Consideration of approval of minutes of regular meeting of May 21, 2019. The minutes were approved. City of Apache Junction,Arizona Page 1 City Council Meeting Meeting Minutes June 4,2019 3. 19-255 Consideration of approval of Resolution 19-18 on an intergovernmental agreement with the Arizona Department of Transportation for the procurement of a street sweeper recently awarded the city through a Congestion Mitigation Air Quality grant. Resolution No.19-18 was approved. PROCLAMATIONSE. AWARDS, PRESENTATIONS AND None. F. ANNOUNCEMENT OF CURRENT EVENTS . 19-29 Announcement of current events from mayor and councilmembers. Councilmember Struble stated he visited Flatiron Park over the weekend and was appreciative of the beauty and condition the park is kept. Vice Mayor Wilson stated he sits on the League of Arizona Cities and Towns Transportation and Public Works Advisory Committee and they are seeking funding support to improve and repair the sewage infrastructure between Nogales and its southern neighbor. The population increase on the southern side of the border has been so significant that the sewage lines are not able to handle the waste and raw sewage is seeping into the streets. The nine mile stretch of this line will cost approximately 8 million. Councilmember Rizzi congratulated all the high school graduates. Many of them received scholarships. She announced the Chamber of Commerce is hosting 2nd Saturdays at Flatiron Park where everyone can enjoy movies,vendors selling wares and food trucks. She announced a Founders Day meeting coming up Thursday at 6:00 PM in the Library;they are looking for volunteers and to please contract Braden Biggs on Facebook. Mayor Serdy stated at the last Council meeting they honored Mary St.James who left a significant endowment to Paws and Claws. He wanted to mention her again for several reasons, she did not live in the city,she lived in Gold Canyon,and she volunteer many hours not only at Paws and Claws but promoting it as well. Paws and Claws was a significant cause for her and she expressed and promoted it on a daily basis. She will be missed by family,friends and by her 4-legged friends. The Phoenix Mesa Gateway Airport won first place for an airport in its classification. He also mentioned the Founders Day meeting will be held at 6:00 PM at the library on Thursday. If you cannot make the meeting,he recieusted residents reach out to someone who would be interested in volunteering for this celebration adn to contact Brayden Biggs for further information. e and other councilmebers attended the Memorial Day service at Mountain View Cemetery. It is a wonderful service of remembrance and invited everyone to take a few hours out of their day to attend these events to honor those and never forget them. He stated following the Memorial Day service there is another event held at Flatiron Park and hoped next year more people come out to enjoy and honor our veterans. He wanted to recognize the mother/daughter team that was out picking up trash around the city. He spotted them near the Burger King. Thinking they were homeless,he stopped to talk with them. CITY MANAGER'S REPORT 5. 19-250 City managers report. Assistant City Manager Matthew Busby invited Bob Mohle and Myra Garcia from the Apache Junction Food Bank to speak on the recent food drive. Mr.Busby announce the Apache Junction City Attorney Joel Stern is the first recipient of the Distinguished Municipal Attorney Award. This is the first year this award has been given and it is a great honor that Mr.Stern was recognized to be the first attorney to receive this award. The association chose a well deserving attorney. Mr.Stern said it was a great honor and it is a team effort. He recognized his law staff and the exceptional work they do. 6. 19-236 Presentation and discussion by Bob Mohle of Apache Junction Food Bank on the Postal Carrier Food Drive. Robert Mohle briefed the council on the recent Postal Carrier Food Drive. He stated there was a tremendous community turn out and donations. Sponsors included Frys grocery store which donated 30,000 bags with cards attached that postal workers left at houses to make donations easy. Los Gringos provided lunch for all the postal workers,American Express Global Business Travels,Gold Canyon Rotary Club,SkyMed,AZ Happy Trails,the Paseo. Postal workers in the city and Gold Canyon collected 39,000 pounds of food. Beginning in 2013 when this postal food drive kicked off they received 15,836 pounds.Donations have increased every year and this year Apache Junction Food Bank was number one in the valley with 39,006 pounds. H. PUBLIC HEARINGS 7. 19-239 Consideration of application for a new Series 9 Liquor Store License for Elodia George Khoury, for the Apache Mini Mart located at 2925 W. Superstition Blvd., Apache Junction, AZ 85220. The next step in this process is for the council to hold a public hearing on the application and make a recommendation for approval or denial to be forwarded to the Arizona Department of Liquor Licenses and Control. Deputy City Clerk Jennifer Pena briefed the council on the item. Mayor Serdy opened the public hearing,receiving no comments from the public,he closed the public hearing and called for a vote. Vice Mayor Wilson moved,seconded by Councilmember Rizzi to recommend approval of the Series 9 Liquor Store license for Apache Mini Mart located at 2925 W.Superstition Blvd.to the Arizona Department of Liquor Licenses and Control. Yes: 7- Mayor Serdy, Vice Mayor Wilson, Councilmember Barker, Councilmember Evans, Councilmember Rizzi, Councilmember Struble and Councilmember Schroeder No: 0 City of Apache Junction,Arizona Page 3 City Council Meeting Meeting Minutes June 4,2019 8. 19-227 Presentation, discussion, public hearing and consideration of proposed Ordinance No. 1476, amending Apache Junction City Code,Volume 1, Chapter 3:Administration,Article 3-9: Department Of Development Services, by repealing and replacing in its entirety Section 3-9-4, Division Of Building Safety And Inspection, repealing any conflicting provisions; providing for severability; and establishing an effective date. Development Services Director Larry Kirch announced for anyone looking to see the presentation on this item it was conducted the previous night of June 3rd. This item has been through several council work sessions with changes and suggestions incorporated into the updated code. There was an additional handout regarding changes to the code for council to review and determine which option they preferred. It will be included in the permanent agenda packet in the clerk's office. Mr.Kirch reviewed the options with city council. Assistant City Manager Matt Busby clarified that this item,Ordinance No.1476 just changes the department name in the city code. Items No.9 and 10 deal with adopting the International Building Codes(IBC's)as amended by the city council,and adopting them by reference due to the numerous pages of the IBC. Any changes would be referenced and made under item No.10. The city council held discussion regarding the proposed amendments,city easements,federal patent easements and various other matters including fencing and permitting. Mayor Serdy opened the public hearing on all three agenda items,receiving no comments,he closed the public hearing. Councilmember Barker moved,seconded by Councilmember Evans to continue item No.8, Ordinance No. 1476 to the Monday,June 17th work session and the public hearing be conducted on Tuesday,June 18th at the regular meeting. Yes: 7- Mayor Serdy, Vice Mayor Wilson, Councilmember Barker, Councilmember Evans, Councilmember Rizzi, Councilmember Struble and Councilmember Schroeder No: 0 9. 19-230 Presentation, discussion, and possible consideration of Resolution No. 19-14, declaring as a public record that certain document filed with the city clerk entitled '2019 amendments to the Apache Junction City Code,Volume 1, Chapter 7: Buildings", repealing any conflicting provisions; providing for severability; and establishing an effect date. Councilmember Barker moved,seconded by Councilmember Evans to continue item No.9, Resolution No.19-14 to the Monday,June 17th work session and the public hearing be conducted on Tuesday,June 18th at the regular meeting. Yes: 7- Mayor Serdy, Vice Mayor Wilson, Councilmember Barker, Councilmember Evans, Councilmember Rizzi, Councilmember Struble and Councilmember Schroeder No: 0 City of Apache Junction,Arizona Page 4 City Council Meeting Meeting Minutes June 4,2019 10. 19-229 Presentation, discussion, public hearing and consideration of Ordinance No, 1475 amending Apache Junction City Code,Volume 1, Chapter 7: Buildings, by repealing and replacing in its entirety all articles under Chapter 7 and adopting by reference that certain document entitled"2019 Amendments to Apache Junction City Code, Volume 1, Chapter 7: Buildings; repealing any conflicting provisions; providing for severability; establishing an effective date and providing for penalties. Councilmember Barker moved,seconded by Vice Mayor Wilson to continue item No.10, Ordinance No.1475 to the Monday,June 17th work session and the public hearing be conducted on Tuesday,June 18th at the regular meeting. Yes: 7- Mayor Serdy, Vice Mayor Wilson, Councilmember Barker, Councilmember Evans, Councilmember Rizzi, Councilmember Struble and Councilmember Schroeder No: 0 1, OLD BUSINESS J. NEW BUSINESS 11. 19-252 Presentation, discussion, and consideration of the acceptance of the Apache Junction Strategic Plan on Homelessness. Grants Administrator Heather Patel stated this is a strategic Plan on homelessness that was compiled by several community organizations. She highlighted the process the group went through to create a county wide plan to help with the homeless. Ms.Patel stated there will be various committees formed to address and possibly provide assistance related to the wide variety of issues related to homelessness. She reviewed these committees and each committees goals and directives. The goal is to have council accept the strategic plan,the city is not committing to anything other than the city will look at its polity on homelessness. Council did have several questions about the plan. Councilmember Barker moved,seconded by Councilmember Evans to accept the Apache Junction Strategic Plan on Homelessness and city staff continue efforts in working with the coalition on homelessness. COUNCIL DIRECTION TO STAFF City of Apache Junction,Arizona Page 5 City Council Meeting Meeting Minutes June 4,2019 12. 19-256 Council direction to staff on public art,the establishment of a public art commission, and associated ordinances, including possible amendments to Volume 1; Chapter 2, Volume 1; Chapter 4 and Volume 11; Chapterl. Grants Administrator Heather Patel stated staff is looking for direction to establish a public art commission,the make up of that commission and proceed with the appropriate ordinances to form the commission. Staff would bring back all this information to Council for review of who will be on the commission,the number of commission members,the authority of the commission and any possible appeal process if necessary. Council held lengthy discussion on how to fund the art projects,and commission member make up. Ms.Patel stated they will provide several options for council to choose from regarding all the variables addressed tonight. Councilmember Evans moved,seconded by Vice Mayor Wilson directed staff to research alternate funding mechanisms and create the associated ordinances to establish an arts commission. Yes: 7- Mayor Serdy, Vice Mayor Wilson, Councilmember Barker, Councilmember Evans, Councilmember Rizzi, Councilmember Struble and Councilmember Schroeder No: 0 13. 19-259 Direction to staff on Fiscal Year 2019-2020 human services funding recommendations. If so directed, the contracts for services will be placed on the June 18 consent agenda at which time council can approve them or opt to continue them to another date. Deputy City Clerk Jennifer Pena stated at last nights work session council received the presentation from the health and human services commission. Chairperson Erickson was present to answer questions council had last night,and the contracts for services would be presented at the June 18th council meeting. Chairperson Erickson provided answers related to licensed providers who were providing legal services within Community Alliance Against Family Abuse (CAAFA). They would like to review the deadline requirement for these funding applications to allow the most current information on fundraising events before they make funding recommendations. Councilmember Rizzi moved,seconded by Vice Mayor Wilson directed staff regarding fiscal year 2019-2020 human services funding recommendation that the contracts for services as recommended by the health and human services commission be placed on the June 18th consent agenda.
