4. 19-560 Announcement of current events from mayor and councilmembers.
Councilmember Struble announce they held the Arizona Winter Visitors Welcome Back
Bash on Monday, December 2nd. The event was held at Barleens Dinner Show
restaurant and many people won raffle prizes. He reminded everyone that on January 26,
2020, at Mountain View Lutheran Church, they will be holding the 3rd annual AJ kids idol,
with the last audition being Thursday night at the C.
Councilmember Evans commented on the Arizona Winter Visitor's Welcome Back Bash
held at Barleens. She highly recommended to those that have never been to Barleens, to
attend at least one dinner theater.
Vice Mayor Wilson reminded everyone of the parade of lights being held Saturday,
December 7th.
Councilmember Rizzi announce the holiday decorating competition. It is open to all the
businesses in the community. It is called Jingle in the Junction. She also announced the
annual toy drive she and her husband to trough their business. She reminded everyone to
ask the sponsor of the event if the donations stay in the community.
Councilmember Barker announced she just returned from a trip to Seattle where she had
been visiting for a few weeks. It was cold and snowy.
Mayor Serdly announced there would be no Founder's Day meeting in December due to
the holidays. He announced the tree lighting would be held Saturday, December 7th with
the lighting of the tree at 7:00 p.m. and the parade starting after that event. He announced
there would be activities during the day at Flatiron Park starting at 3:00 p.m.
He announced the Apache Trail has been closed beyond Tortilla Flats due to the extensive
damage and then wash out after the massive wild fire this summer in the area. There will
be a meeting with ADOT on December 17th at 8:00 a.m. to see about opening the
roadway sooner than ADOT's prediction of three or four years.
G. CITY MANAGER'S REPORT
5. 19-561 City Manager's Report.
City Manager Bryant Powell announced Police Chief Kelly is President of the Police
Chiefs Association of Arizona and was a key speaker in the press conference held at the
state capital on the DUI state wide task force kick-off event.

Mr. Powell showed a brief news clip of that event.
Mr. Powell then introduced Deke Beveridge, the new Executive Director of Empowerment
Systems, Inc.
6. 19-538 Introduction of Empowerment Systems, Inc. new Executive Director, Deke
Beveridge.
Mr. Beveridge highlighted several areas of service the organization helps with and their
initiatives and outreach programs.
7. 19-557 Update on State Route 24, interim phase 11, Ellsworth Road to Ironwood Drive.
Public Works Director Mike Wever provided an update on State Route 24
H. PUBLIC HEARINGS
8. 19-526 Consideration of application for a special event liquor license for applicant Ed
Shockley of the Superstition Mountain Rotary Club#1246 - Lost Dutchman
Days event, to be held at the Apache Junction Rodeo Grounds located at
1590 E. Lost Dutchman Blvd., Apache Junction, AZ. This event will be held for
three consecutive days, starting on Friday, February 28, 2020 through
Sunday, March 1, 2020 from 10:00 a.m. to 10:00 p.m. The next step in this
process is for the council to hold a public hearing on the application and make
a recommendation for approval or denial to be forwarded to the Arizona
Department of Liquor Licenses and Control.
Councilmember Rizzi moved,seconded by Vice Mayor Wilson to recommend approval of the
application to the Arizona Department of Liquor Licenses and Control.

City Clerk Jennifer Pena briefed the council on the item. She stated the applicant was not
able to attend tonight's meeting and may have another representative present to answer
any questions the council may have.
City Manager Bryant Powell stated he is a member of the Superstition Mountain Rotary
Club and was asked to present the details of the application.
Mayor Serdy opened the public hearing, receiving no comments, he closed the public
hearing.
9. 19-568 Presentation, discussion, public hearing and consideration of proposed
Ordinance No. 1484 (case PZ-9-19), a city-initiated corrective rezoning for 22
parcels bounded by N. Ironwood Drive, W. Roundup Street, N. Gold Drive and
W. Greasewood Street, from Medium Density Single-family Detached
Residential, 20,000 sq.ft. minimum lots ("RS-20M")to Medium Density
Single-family Detached Residential, 10,000 sq.ft. minimum lots ("RS-10M").

10. 19-565 Presentation, discussion, public hearing and consideration of approval of
Resolution No. 19-30, declaring as a public record that certain documents
filed with the city clerk entitled "2019 Amendments to Apache Junction City
Code,Vol. 1, Chapter 9: Health and Sanitation,Article 9-5:Collection of
Residential Solid Waste", repealing any conflicting provisions; providing for
severability; and declaring an emergency.
Mayor Serdy announced since items 10,11 and 12 dealt with the same issue,he would hold the
public hearing for all three items at one time,but each item would have a separate vote. Those
who wished to speak on the items would be given 5 minutes to address their comments on all
three items. While several Request to Speak forms had been submitted anyone wishing to speak
on the items may do so.
Mayor Serdy read all three items aloud to start the public hearing process.
Councilmember Barker requested to make a brief statement first. She read the postcard that was
mailed to"residents"of Apache Junction and commented on the statements listed on that
postcard.
Councilmember Evans moved,seconded by Councilmember Barker that Resolution No.19-30,
declaring as a public record that certain documents filed with the city clerk entitled"2019

Mayer Serdy asked Assistant City Manager Matt Busby to start the discussion. Mr. Busby
provided a quick summary of the initial RFP and process for the collection of solid waste.
He then introduced Steven Herring to provide a brief presentation.
Mr. Steven Herring provided a brief presentation regarding their company, provided a rate
comparison, the old and new rates, services, contract terms, service reliability, servicing
2,400 other municipalities across the country and recycling costs.
City Attorney Joel Stern explained why the city had a Resolution and an Ordinance for this
item. He stated to avoid the significant publication costs associated with publishing the
entire amendments to the city code, a resolution is used to adopt as reference those
amendments, and just the Ordinance is published, not the exhibits or attachments.
Mayor Serdy inquired if the Resolution and Ordinance pass and are adopted and the
contract is not approved, would that then negate the Ordinance and Resolution?
Mr. Stern addressed the emergency clause first since the Ordinance had an emergency
clause affiliated with it.

Mr. Stern stated if the Ordinance is passed with a less than 6-1 in favor vote, the
Ordinance passes, but the emergency clause does not take effect. If the contract is not
approved, then there is no contract for services with Allied Waste.
Assistant City Manager Matt Busby then reviewed the services that were addressed at the
open house that encompassed the city code language/regulations as well as the contract
language. He reviewed the requirements listed in the ordinance language.
Mayor Serdy then opened the Public Hearing. He reminded everyone that while some had
filled out the Request to Speak forms, they are not required if anyone wishes to speak on
the three agenda items during this public hearing.
Mayor Serdy started with the Request to Speak forms.
A summary of the items addressed by those who spoke at the public hearing is listed
below the list of speakers.

Michael Wilcox stated he opposes the item, he does not want to be dictated to. His
amount of trash so minimal it does not warrant the service.
Pearl Agard stated she is neither for or against the service yet. Her neighbor who is blind
shares garbage service with her for$54.00 per quarter and they still do not fill the trash
can as much as they fill the recycle bin. She asked council to explain about pick up for
horse manure. She understands the administrative fee goes to the general fund and
stated the money should be used for cleaning the city up. Punishment for not paying your
solid waste bill becomes a felony? This is an abuse of power.
Laurel Lewis read a prepared speech and provided a handout for the overhead projector.
Believes the city has found a way to tax 50% of the residents without calling it a tax. The
administrative fee is being used to bring income to the city. Apache Junction is a poor city
with the average income of residents approximately$21,000 per year, the national
average $28,000 per year. What benefits will the city receive by collecting the
administrative fee? This service will not help with code compliance issues. Code
compliance duties are dictated by state law.

Only half of the city residents will be paying the administrative fee, trailer parks, RV resorts,
residential properties larger than a 4-plex are exempt.
The contractor can increase the fee every year, which in turn means an increase to the city.
The contract violates free enterprise. The city will be stuck with the contract whether the
provider does a good job or bad job. The city should address poverty, homelessness and
drug problems within the city. There are fees with the pick-up of your trash can when you
change companies to the tune of$75.00.
Kathy Boseck stated she wants to be able to choose which trash hauler she uses and
does not want to be forced to pay for garbage service. She stated there is either a lack of
information or misinformation about the administrative fee. She wanted clarification on
what the administrative fees would be used for. She assumed it would reduce their dump
fees. She mentioned that Waste Management drives into her neighbor's yard leaving
deep tracks where they back up to turn around.
Dale Stites stated he lives in Apache Villa and comments from a meeting they held were
mostly on the lack of information provided to residents especially the winter visitor
residents.
George Schroeder stated he worked for Allied Waste in 2001-2002. The power the city is
using is illegal. He stated the piles of trash in someone's yard has been accumulating for
years. Code enforcement needs to do their job. He tried to cancel his RAD service and
he could not reach anyone. Code Enforcement is behind this and someone is going to get
shot over this. Mr. Schroeder stated he was not making a threat,just suggesting council
be aware because the issue has so many people upset. This is a dangerous issue. The
city is trying to use the Terrorist Act to impose this service.
Jose Perez-Wagner commented on the benefit of reduced emissions and potential
improvement efforts towards environmental matters having a single provider; but she is
opposed to the penalties being imposed. Apache Junction is a city of retired people and
the income of most is much lower than other communities.
Terry Reynolds- Did not approve of the grouping of the public hearings. Limiting people
to 5 minutes to address all three items is a manipulation of the system and is wrong. He
could not find any other meetings where the ordinance was discussed. He spoke on the
administrative fee which will not be paid for by the other residents of the city who live in RV
parks, trailer parks or residential units larger than 4- leis. Earlier it was stated that this
would help pay for the household hazardous waste events. That program benefits all
Apache Junction residents. Therefore the administrative fee could be construed as a
discriminatory fee. He would like his concern reviewed. The administrative fee was to
monitor the contract and program, not to pay for a city program. Mr. Reynolds then said,
"as of this day I am resigning my seat on the board of the Municipal Property Corporation".

Mayor Serdy that concluded hearing from those who filled out the Request to Speak forms
and asked for other speakers.
Ms. Melody, lives near Warner and University stated she has complained to code
compliance and the police for three years trying to get her neighbors to clean up their
trash. She can smell their trash and sees it every day. The neighbors do not even take it
to the landfill. Trash is everywhere in her area, and it devalues her home.
Dave Dingley, 2948 W. Tepee, Apache Junction stated he is a winter visitor and was
happy to hear that for the six months he is not here, he can obtain a waiver from trash
service. He does not accumulate enough trash on a weekly basis that warrants weekly
pick up. He is more concerned with his neighbor who has several broken down vehicles, a
broken hot tub, a travel trailer, a mattress, dog kennels, a stove, an exercise machine and
other things in his yard. He would like to see that cleaned up.
Brenda Chenyholmes, 812 E. Hondo Ave. Apache Junction, AZ stated she is in support of
the service and pays $30.00 per quarter with Republic Service. She is tired of seeing all
the wrong information being distributed.
Connie Van Driel, 213 S. Charlebois Rd., Apache Junction, AZ stated she did receive the
anonymous mailer that trashed the elected officials. She stated she believes it was sent
out by another trash company which holds contracts as a single hauler provider for other
cities and finds it ridiculous.
She also addressed the illegal dumping that occurs inside and out of the community. Over
her many years of service in government, they partnered with community organizations and
municipalities to clean up the trash in the area. Illegal dumping scars the beauty of the
area. She asked council to approve the item.
Gil Den Besten, 560 N. Valley Dr., Apache Junction, AZ appreciates his ability to choose
what services he pays for. The 8% "gratuity"the city is getting should not influence who is
awarded the service contract.
Amelia Times, 835 S. Lawson Dr., Apache Junction, AZ expressed appreciation on the
reduced cost for garbage and recycling service. She did address the fees and fines for
not participating in the program and stated this could force those on fixed income to
actually lose their house.
Jim Palmer, 240 E. 13th Ave., Apache Junction, AZ inquired if there is a cancellation
clause if the provider does not live up to the services. He inquired what residents will be
charged for their old trash can to be picked up.

Bob Mole, from the Apache Junction Food Bank, stated he currently uses Republic
Services but is tired of seeing all the different trucks drive up and down his street. He has
been relocated six times in his career and in all locations, they had a single source hauler.
Tobia Eaks, lives near San Marcos and Shiprock here in Apache Junction. Stated she
shares trash and recycling with a neighbor. She does not have trash service, computer
access, newspaper service, postal delivery or phone services. She knows of others that
do not have sewer or water service and they do not keep a trashy residential lot. She is
not a winter visitor but only"sleeps" in the city approximately 60 nights a year. She travels
a lot. She is concerned that she may have a criminal record if she does not subscribe to
the service.
Anita Soller, 220 E. 13th Avenue, Apache Junction AZ stated they moved to the city a year
ago. When she moved to the city she had a problem with the first garbage provider so she
contracted with another provider. The first provider still charged her for picking up her can
and billed her for the entire quarter.
Sandra Fisher, 1860 S. Winchester Rd., Apache Junction AZ thought the concerns of the
residents were freedom of choice. The other concern is the cost being imposed on those
who live on a fixed income.
Monty Moore lives at the junction of US 60 and Tomahawk Rd. in Apache Junction stated
most of his thoughts and concerns had been discussed and addressed. It is the freedom
of choice that is being taken away especially for a service he does not need. The
penalties are excessive. He inquired as to what initiated the matter. He has received
excessive misinformation but no factual information. A trash can will not fix the trashy
people. Enforcement needs to be done through code enforcement.
Kimber Shinn, 1877 W. 11 th Avenue, Apache Junction presented letters from residents
who have received misinformation on the service. She expressed concern over the 100%
participation rate and if that is not met, will the price increase. The other concern
addresses vacant lots where people store their belongings but there is no residential unit
on the lot. She expressed concern for those people who may not be able to afford the
service.
Diane Burns, 527 W. Whiteley St. Apache Junction, AZ stated she picked a random
neighborhood and spoke to everyone she met. She stated she had letters to submit to the
council and read one letter in particular. The majority of people she spoke with expressed
opposition to the service.
Robert Newhouse 2935 E 18th Avenue, Apache Junction, AZ stated he was in favor of
having a single provider, but does not like the mandatory requirement. Those who throw
their trash in their yard are not going to change just by having a trash can. His other
concern was the penalties that could be imposed.

Council took a short recess at 9:06 p.m.
Council reconvened the meeting at 9:17 p.m.
Mayor Serdy requested staff address some of the concerns that had been expressed.
Assistant to the City Manager Anna McCray answered some of the questions. She stated
while pick up of manure is not part of the contract, they do offer that service for$16.00 per
month for a 96 gallon container with once a week pick up. There are no felony provisions in
the code. The civil and potential criminal penalties are similar to what other cities have
and is consistent with provisions already in the city's code. Other cities allow for placing
liens on homes,Apache Junction is not going to be placing liens on property. The city
ordinance outlines the process of mediation for compliance.
In response to Councilmember Rizzi's question about criminal charges, City Attorney Joel
Stern stated after following the process for compliance and efforts to work with the
individual to help them come into compliance, if there is no resolution, then it can escalate
to a misdemeanor. He stated cities and towns cannot pass felony law.
In response to Mr. Palmer's question about rescinding the contract if Allied Waste fails to
honor the terms of their contract, Mr. Stern stated there is a termination clause.
Councilmember Barker stated she is an avid recycling advocate and right now there is
nowhere to take our recycling goods.
Councilmember Schroeder asked staff to explain the 8% administrative fee.
City Manager Bryant Powell stated it is an administrative fee that will help offset the cost
for the household hazardous waste events. The event roughly costs $80,000, but the city is
reimbursed by Pinal County$20,000 for those residents that live in the county that bring
their waste for disposal. So the estimated cost of the event the city pays for is $60,000.
The city is estimating roughly$100,000 of new revenue, but in actuality it becomes
$40,000. Like most cities with a single hauler, there will be work for a staff member to
monitor and work with the provider on issues.
Councilmember Schroeder highlighted a few comments made about how the city is home
to a significant percentage of low income residents, and yet the city houses 50%who have
another home somewhere else. If you want to know what business your city is considering
it is easy to find through their website and the agendas they post.
He understood there are people who do not generate a lot of trash, but to open the door
for exceptions, it creates a flood of issues.

Councilmember Rizzi commented she has taken over 200 calls and emails from people
against the contracted service. One common denominator however, was that the city
needs to be cleaned up. Illegal dumping is also an issue. The resident that throws their
trash out the back door or hoards junk may have an issue with drugs or mental health. So
there are issues to be addressed and maybe the conversation needs to be continued.
Vice Mayor Wilson responded to a comment stating the city is forcing a 2 day service of
garbage collection on them. He stated it is actually state law that the city provide 2 days
per week garbage collection if it is offered in your area. If you don't have trash you do not
have to put our can out. Only when it is full. In response to trash trucks driving up and down
the roads; three different providers drive up and down the same street.
He commented on when people burn their trash. There are state laws against burning on
certain days, but again, enforcement is an issue.
The city council has held several meetings on solid waste services he referred them to the
internet to watch all the council video.
Councilmember Evans stated earlier in the year the city passed the property maintenance
standards. These items go hand in hand. Apache Junction has had a long standing
reputation. This is another step to improve the lives of its residents and improve the city
as a whole.
She stated city council works hard at doing what is best for the residents. To improve their
quality of life and to appreciate the value in property value. Change is not easy or
comfortable, but the city is growing and it needs to address these priority matters.
Councilmember Struble thanked the audience members for attending the meeting.
Council has to make decisions that impact each and every one of them and so many times
there is no one from the public that attend these meetings. They rely on council to do what
is best for the city and its residents.
This is an environmental issue, a health and safety matter as well.
Mayor Serdy stated he pays for sewer but the connection was never made. He has
garbage service at his home and his business. He pays for both.
In response to a question from council, Mr. Herring from Republic Service stated the
contract regulates the rate. The rate is the rate. This is why they and the city need to work
together to have the highest compliance percentage.

Representatives from Republic Services will provide the presentation.

13. 19-563 Presentation and discussion on amending the zoning regulations to allow
cargo containers in zoning districts other then RS-GR and/or lots smaller than
1.25 acres.
Director of Development Services Larry Kirch provided an update on the lot size requirement in
order to have a cargo container on their lot. Mr. Kirch stated this item could be directed to go
through the normal course of being heard before the Planning and Zoning Commission or at this
time it will be on the January 7, 2020 council agenda for them to decide what they would like to
do.

council conference room and city council chambers located at 300 E.Superstition Boulevard,
Apache Junction,Arizona,respectively;and other meetings if necessary.

M. CALL TO PUBLIC
Terry Reynolds, 1121 S. Lawther Dr.Apache Junction,AZ inquired as to why his question on the
administrative fee not addressed. The$80,000 used towards the Household Hazardous Waste
event is a misuse of the 8% administrative fee.
City Manager Bryant Powell and City Attorney Joel Stern stated how the funds are a policy
issue.
