HomeMy WebLinkAbout1979-09-12 City Council Regular MinutesSpecial Meeting of the City Council of Apache Junction September 12, 1979 There was a Special Meeting of the Apache Junction City Council September 12, 1979 at City Hall pursuant to notice as required by law. The Special Meeting was called to order by Mayor Virginia Seeman. The Invocation was presented by Jimmy Eidson. The Pledge of Allegiance was led by Vice -mayor John Granillo. Roll Call Councilmembers present Mayor Virginia Seeman, Vice -mayor John Granillo, Jerry Burgess, Thomas Damiano Jimmy Eidson, Norman Hill and Marie Shanks. Staff present Ray Lee, City Manager; Susan Goodwin, City Attorney; Mike Curtis, City Attorney; Isabel Ballard, City Clerk; Bill McDaniel, Chief of Police. Special Business Mayor Virginia Seeman asked if any one on the Council had any input on the Palm Springs Moratorium. Norman Hill stated he had checked the water pressure in the Palm Springs and found it to be 28-30 pounds. George Baljo spoke for the Homeowners Association of Palm Springs.Mr. Baljo read a letter from the Association to Council. Sam Gardom asked Council what was considered safe water and showed an evaporation sample of Palm Springs Utility Co. water and showed a sample after filtering. Joe Saggio spoke on the limited purpose of the moratorium.Mr. Saggio said that Mr. Baljo stated many people are supporters of the moratorium but Mr. Saggio had not seen any such supporters.Mr. Saggio stated it was an illegal and immoral moratorium and requested it be lifted. Charles K. Ayers, attorney, stated the water from Palm Springs Utility Co. was potable.Possibly it did not taste good but it was potable.It is the water company's responsibility to furnish water to residdnts thru a franchise with Arizona Corporation Commission.Mr. Ayers went on to explain Palm Springs Utility Co. is within legal requirements. David Moreno Sr., a representative of Consolidated Water Company, spoke on the Company's plans to furnish better water. When asked when results could be seen, Mr. Moreno stated a noticable change could be expected within three weeks.Mr. Moreno stated the company planned to take over the Palm Springs Utility Co. in November.Plans had been made to add a new well in six months to a year.Mr. Moreno stated himself and three men would take care of maintenance of the utility company. Thomas Damiano asked if while changes were being made would residents still have water and was told yes. Mancelyn Boyken, Consolidated Water Company Council on the company's and David Moreno's Vice -mayor John Granillo asked if the water operations manager, spoke to qualifications. would be sufficient for fire Special Meeting September 12, 1979 Page 2 protection.Mayor Virginia Seeman asked Fire Marshall Harvey Miller to report on fire hydrants for water supply.Mr. Miller stated a test had been run on fire hydrants in the Palm Springs area and only one was found to be sufficient for fire protection. Mr. Charles Ayers stated he had received opinions form two sources on fire protection. An insurance firm stated to Mr. Ayers a minimum standard of 250 gallons per minute for two hours or 500 gallons per minute for one hour was required ,to get an insurance rating.Apache Junction had a rating so at some time there was adequate pressure. Chief Butler of Rural Metro Fire had told Mr. Charles Ayers 90% of residential fires are controlled with 500 gallons or less if they are going to be controlled.Since the fire trucks carried more than that, there was adequate water. Mayor Virginia Seeman requested the Health Department test results. Susan Goodwin, City Attorney, stated she had examined the Health Dept. records and stated they do meet standards for chemicals for suspended solids.Susan Goodwin stated the maintenance would be inspected next week by the Health Dept. Mayor Virginia Seeman asked what was the purpose of fire hydrants.Mike Curtis, City Attorney, stated the purpose of fire hydrants was to furnish water when water on the fire trucks was not sufficient. Mayor Virginia Seeman asked if the Water Company did not have to furnish water, then what was the purpose of fire hydrants. Mike Curtis stated delivery of water was a contractual service.If there is no contract agreement to provide fire service, then there is no obligation.Mayor Virginia Seeman stated the sale of the Palm Springs Utility Company had not been approved as yet by the Arizona Corporation Commission. Vice -mayor John Granillo made a motion to adjourn into an Executive Session under Title 38 for legal advise and Thomas Damiano seconded.Motion carried unanimously. Upon return of the City Council, Marie Shanks made a motion that upon the basis now before the Council on the adequacy of water service in the Palm Springs Water Company Service area that as of now on the basis of the date and the reputation of Spencer D. Stewart that the moratorium on permits be lifted, further that the City Manager be instructed to apply for a Four (4) Corners Grant to study the water system requirements of the City, further that upon an adverse report by the De- partment of Health Services as to the adequacy of the system or evidence of an adverse change in the data presented, a moratorium be reconsidered and seconded by Norman Hill. Motion carried unanimously. Award of Bid on City Hall Modular Unit Jerry Burgess made a motion to purchase a modular unit from the Bonded Mobile Homes of Arizona, Inc. at a price of $16,200.00 and seconded by Thomas Damiano.Motion carried unanimously. Vice -mayor John Granillo made a motion to adjourn and seconded by Marie Shanks. Motion carried unanimously.
