AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,ESTABLISHING A DATE FOR A SPECIAL
REFERENDUM ELECTION;PROVIDING FOR THE PRINTING AND DIS-
TRIBUTION OF THE PUBLICITY PAMPHLET;PROVIDING FOR THE
SUBMITTAL OF ARGUMENTS;REPEALING CONFLICTING PROVISIONS;
PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
A.In accordance with the provisions of the Arizona State Constitution,
Article 4,Arizona Revised Statutes,Title 19,Initiative,Referendum
and Recall,and Ordinance No.469 of the City of Apache Junction,
Arizona,a special election for Referendum No.AJRF-3-86 i s hereby
ordered to be held and conducted on Tuesday,May 13,1986.
B.In accordance with Arizona Revised Statutes 19-141 (A),the
publicity pamphlet for said special election shall be submitted
to the Apache Junction Post Office for distribution on or before
May 1,1986.
C.In accordance with Arizona Revised Statutes 19-124 (E),arguments
submitted either in favor of or against Referendum No.AJRF-3-86
shall be filed with the Apache Junction City Clerk no later than
5:00 p.m.,Friday,April 11,1986,in order to comply with nec-
essary deadlines imposed by the Pinal County Elections Department
for the printing and distribution of the publicity pamphlet as
required by Arizona Revised Statutes 19-141 (A).
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,clause,phrase or portion of this
ordinance or any part of the code adopted herein by reference is,for any
reason,held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portions thereof.
SECTION IV EMERGENCY CLAUSE
I t being necessary for the preservation of the peace,health and safety of
the City of Apache Junction,Arizona,that this ordinance become effective
immediately,an emergency i s hereby declared to exist and this ordinance
shall be effective immediately upon its passage and adoption.
