HomeMy WebLinkAboutORD424ORDINANCE NO.424 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE, CHAPTER 2 MAYOR AND COUNCIL,BY ADDING ARTICLE 2-14 YOUTH ADVISORY BOARD;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS: SECTION I IN GENERAL be That the Apache Junction City Code,Chapter 2 MAYOR AND COUNCIL, amended by adding Article 2-14 YOUTH ADVISORY BOARD,to read as follows: Section ARTICLE 2-14 Section Section Section Section Section Section Section Section YOUTH ADVISORY BOARD 2-14-1 Creation 2-14-2 Membership and Terms of Office 2-14-3 Salaries and Personal Expenses 2-14-4 Officers 2-14-5 Meetings 2-14-6 Vacancies 2-14-7 Removal of 2-14-8 Duties 2-14-1 Creation Members There is hereby established a Youth Advisory Board which shall act solely as an advisory body to the City Council to promote and develop youth -oriented programs and services within the City of Apache Junction. Section 2-14-2 Membership and Terms of Office A.The Youth Advisory Board shall consist of nine (9)members who shall be appointed by the Mayor and approved by the City Council.The nine members shall consist of five (5)juveniles and four (4)adults.Ex officio members,without voting privileges,may be designated by the Mayor with the approval of the City Council. B.The initial appointments of members shall be as follows:Three members with terms beginning upon their appointment and expiring June 30,1986; three members with terms beginning upon their appointment and expiring June 30,1987;and three members with terms beginning upon their appointment and expiring June 30,1988.Thereafter,Board members shall serve for a term of three years or until their successors are duly appointed and qualified,and terms of members shall be so stag- gered that the terms of no more than three members shall expire in any one year.Ex officio members shall serve for a term not to exceed one year. C.All members shall be residents of the City of Apache Junction. Section 2-14-3 Salaries and Personal Expenses Members of the Youth Advisory Board shall receive no salary or other remun- eration for their services in such capacity and shall not be entitled to personal expenses incurred by them in the discharge of their official duties except to the extent,purposes and amount such expense is first authorized and approved in advance by the City Council. Section 2-14-4 Officers The Board shall elect a chairman,vice chairman and secretary from among its members to serve for a period of one year.The vice chairman shall preside at meetings in the absence of the chairman. ORDINANCE NO.424 PAGE ONE OF TWO Section 2-14-5 Meetings The Board shall establish a regular meeting day and time and shall meet at least once each month.Special meetings may be called as required. All meetings shall be held in compliance with the Open Meeting Act as provided for in A.R.S.§38-431 as amended.A quorum shall consist of five (5)voting members for the transaction of all business. Section 2-14-6 Vacancies Vacancies shall be filled by the City Council in accordance with Section 2-14-2 for the unexpired term of the affected member. Section 2-14-7 Removal of Members Members of the Youth Advisory Board shall serve at the pleasure of the Council and may be removed by the Mayor with the concurrence of the Council.A member shall not be absent from any Youth Advisory Board regular meetings for more than three (3)consecutive times without a reasonable excuse.After the absence of three consecutive regular meetings,the remaining members of the Youth Advisory Board shall vote to retain or recommend to the City Council that the absentee member be relieved of his duties on the Board. Section 2-14-8 Duties The Board,through the Superintendent of Community Services,shall make recommendations to the City Council regarding general policy relating to youth -oriented services and programs as provided by the City. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV EMERGENCY CLAUSE I t being necessary for the preservation of the peace,health and safety of the City of Apache Junction,Arizona,an emergency is declared to exist and this ordinance shall become immediately operative and in force from and after the date of adoption.
