AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION
CITY CODE,CHAPTER 3 ADMINISTRATION,PERTAINING TO COUNCIL
AUTHORITY OVER PERSONNEL MATTERS;REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code,Chapter 3 ADMINISTRATION,
Article 3-1 CITY MANAGER,Section 3-1-8 Powers and Duties,Subsection C
Power of Appointment and Removal,be amended to read as follows:
C.Power of Appointment and Removal.Subject to the exceptions
expressly provided by this chapter,i t shall be the duty of
the city manager to appoint,remove,promote and demote any
and all officers and employees of the city,except magistrate,
city attorney and members of the boards,commissions and
committees,all of whom shall •be appointed by the council.
As to these officials,the city manager shall recommend
appointment and removal.All department heads shall be
appointed subject to ratification by the council,including
the Director of Public Works,Director of Public Safety,City
Clerk,Finance Officer,Superintendent of Community Services,
and Director of Planning.All such actions of the city manager
shall be subject to all applicable personnel ordinances,rules
and regulations and statutes of the State of Arizona.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the pro-
visions of this ordinance or any part of the code adopted herein by
reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion
of this ordinance or any part of the code adopted herein by reference is,
for any reason,held to be invalid or unconstitutional by the decision of
any court of competent jurisdiction,such decision shall not affect the
validity of the remaining portions thereof.
