AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY
AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING
THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-51-85 FROM GR GENERAL
RURAL TO C-3/PD GENERAL COMMERCIAL DISTRICT BY PLANNED DEVELOPMENT;RE-
PEALING ANY CONFLICTING PROVISIONS AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
1.The zoning district classification on the Zoning District Map,City
of Apache Junction,Arizona,for the parcel of land described as:
A portion of the Northwest A of the Southwest i of Section
20,Township 1 North,Range 8 East,Gila and Salt River Base
and Meridian,Pinal County,Arizona,more particularly described
as follows:
Commencing at the center of said Section 20;thence South 000 08'
19"East,an assumed bearing,along the east line of the Southwest
i of said Section 20 for a distance of 435.60 feet to the TRUE
POINT OF BEGINNING;thence continuing South 000 08'19"East
for a distance of 236.85 feet to the northeast corner of Apache
Ho Unit One,a subdivision recorded in Book 9 of Maps,Page
59,Pinal County Records;thence South 89°57'46"West along
the north line of Apache Ho Unit One for a distance of 509.56
feet;
Thence North 00°03'48"West for a distance of 411.27 feet
to a point 200.00 feet southerly of the south right-of-way
line of Highway 60-70-80-89;
Thence North 89°56'12"East,parallel to and 200.00 feet
southerly of said south right-of-way line for a distance of
109.98 feet;
Thence North 00°03'48"West for a distance of 200.00 feet,
to a point on said south right-of-way line;
Thence North 89°56'12"East,along said south right-of-way
line for a distance of 198.78 feet to a point 200.00 feet westerly
of the east line of the Southwest i of Section 20.
Thence North 89°08'19"East,parallel to and 200.00 feet
westerly of said east line of the Southwest A of Section 20
for a distance of 374.53 feet;
Thence North 89°58'12"East,parallel to the north line of
said Southwest A of Section 20 for a distance of 200.00 feet
to the TRUE POINT OF BEGINNING;EXCEPT
The north 400.00 feet thereof.
2.The approval of the zoning district classification shall be construed
as concept plan approval for base zoning and shall serve as approval
for amendment of the zoning map.
3.Development of said approval shall be in accordance with the provisions
of Article 19 of the Zoning Ordinance.The provisions of the Uniform
Building Code and all other City Codes,policies,guides and standards
shall apply and control all design and construction of improvements.
4.Applicant shall dedicate all rights -of -way and easements deemed
necessary by the City prior to final plan approval.
5.The preliminary and final plan approval,issuance of permits and
development shall be conditioned upon site plan approval by the
Development Coordinating Committee,issuance of permits and
development of the adjacent property zoned CB -2 and indicated on
the concept plan submitted as part of the mini -storage,mail center,
apartment,retail complex;
be and hereby is amended from GR General Rural to C-3/PD General Commercial
District by Planned Development.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance or any part of the code adopted herein by reference are
hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,sub -section,sentence,phrase,clause,or portion of this
Ordinance or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of
the remaining portions thereof.
