HomeMy WebLinkAboutORD456ORDINANCE NO.456 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-70-85 FROM TRAILER HOMESITE BY PLANNED DEVELOPMENT (TH/PD)TO MULTIPLE FAMILY RESIDENCE ZONE BY PLANNED DEVELOPMENT (CR-5/PD);REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL 1.The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcels of land described as: A portion of the West half of the Northwest quarter of the Northeast quarter of the Northeast quarter of the Southeast quarter of Section 17,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona,being more particularly described as follows: COMMENCING at the East quarter corner of said Section 17; Thence south,329.97 feet along the East line of said Section 17;Thence North 89°49'30"West,628.34 feet to the TRUE POINT OF BEGINNING of this description;Thence continuing North 89°49'30"West,32.00 feet along the South line of said West half of the Northwest quarter of the Northeast quarter of the Northeast quarter of the Southeast quarter; Thence North 000 00'15"West,50.00 feet along the West line of said West half of the Northwest quarter of the Northeast quarter of the Northeast quarter of the Southeast quarter; Thence South 89°49'30"East,32.00 feet;Thence South 00° 00'15"East,50.00 feet to the TRUE POINT OF BEGINNING. EXCEPTING THEREFROM all coal,oil,gas and other mineral deposits as reserved in the Patent recorded in Book 211, page 591;AND The North half of the Northwest quarter of the Northeast quarter of the Southeast quarter of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; EXCEPTING AND RESERVING unto the United States,all oil, gas and other mineral deposits,according to the provisions of said Act of June 1,1938,as set forth in the Patent to said land;AND The South half of the Southwest quarter of the Northeast quarter of the Southeast quarter (SISWANEiSEi)of Section 17,Township 1 North,Range 8 East and Salt River Base and Meridian,Pinal County,Arizona; EXCEPTING THEREFROM all coal,oil,gas and other mineral deposits as reserved in the Patent recorded in Docket 238, page 595;AND The South half of the Northeast quarter of the Northeast quarter of the Southeast quarter (SiNEANEASEk)of Section 17,Township 1 North,Range 8 East,of the Gila and Salt River Base and Meridian,Pinal County,Arizona;AND The North half of the Northwest quarter of the Southeast quarter of the Southeast quarter (NINWISEkSEi)of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; EXCEPTING THEREFROM all coal,oil,gas and other mineral deposits as reserved in the Patent recorded in Docket 229, page 220;AND The South half of the Southeast quarter of the Northeast quarter of the Southeast quarter (SISEANEiSE*)of Section 17,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,Arizona; EXCEPT the South 99 feet thereof; EXCEPTING THEREFROM all coal,oil,gas and other mineral deposits as reserved in the Patent recorded in Docket 222, page 284 be and hereby is amended from Trailer Homesite by Planned Development (TH/PD)to Multiple Family Residence Zone by Planned Development (CR-5/PD). 2.The approval of the zoning district classification shall be construed as only concept approval for the base zoning and shall serve as official approval of the base zoning amendment to the Zoning Map. 3.Development of said property shall be in accordance with the provisions of Article 19 of the Zoning Ordinance.The provisions of the Uniform Building Code and all other City codes,policies,guides,and detailed standards shall apply and control all design and construction of improvements. 4.The applicant shall dedicate the East fifty feet (50')along North Idaho Road,the North forty feet (40')along West Tepee Street,the West thirty-three feet (33')along North Plaza Drive and twenty foot (20')by twenty foot (20')cutoffs at intersections for roadway and associated purposes. 5.The development schedule shall be followed as submitted by the applicants. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this Ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,sub -section,sentence,phrase,clause,or portion of this Ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
