HomeMy WebLinkAboutORD481ORDINANCE NO.481 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-84-85 FROM GR GENERAL RURAL TO CR-4/PD MULTIPLE FAMILY RESIDENCE ZONE BY PLANNED DEVELOPMENT;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL 1.The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcels of land described as: The East i of the Southwest of the Southwest of the Southeast *of Section 27,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona,AND The West of the Southwest *of the Southwest *of the Southeast *of Section 27,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona be and hereby i s amended from GR General Rural to CR-4/PD Multiple Family Residence Zone by Planned Development. 2.The approval of the zoning district classification shall be construed as only concept approval for the base zoning and shall serve as official approval of the base zoning amendment to the Zoning Map. 3.Development of said property shall be i n accordance with the provisions of Article 19 of the Zoning Ordinance.The provisions of the Uniform Building Code and all other City codes,policies,guides,and detailed standards shall apply and control all design and construction of improve- ments. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances i n conflict with the provisions of this Ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this Ordinance or any part of the code adopted herein by reference i s for any reason held to be invalid or unconstitutional by the decision of any court' of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof. Norman S.Hill Mayor ATTEST: Kathleen Connelly 67 City Clerk APPROVED AS TO FORM: av City' Attorney ORDINANCE NO.482 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA REVISING THE SPEED LIMIT ON LOST DUTCHMAN BOULEVARD BETWEEN MERIDIAN DRIVE AND IDAHO ROAD; REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;PROVIDING FOR PENALTIES;AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,THAT: SECTION I IN GENERAL I t i s i n the public interest to insure safe,effective and efficient traffic flow along public rights -of -way within the City of Apache Junction, Arizona,and i t has been determined that speed limits are necessary for the public safety and convenience;therefore,the speed limit be revised from 35 mph to 45 mph on Lost Dutchman Boulevard,between Meridian Drive and Idaho Road. Furthermore,the Director of Public Works and the Director of Public Safety are hereby empowered and directed to initiate appropriate action to install the speed limit signs and enforce the speed limits on the referenced street. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances i n conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,i s for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV PENALTY CLAUSE Any person found guilty of any violation of or failure or refusal to do or perform any act required by Chapter 12 of this code constitutes a civil traffic violation.Civil traffic violations are subject to the provisions of Title 28,Chapter 6,Article 20 and 21,Arizona Revised Statutes,and amendments thereof. SECTION V EMERGENCY CLAUSE I t i s necessary for the preservation of the peace,health and safety of the City of Apache Junction,Arizona,that this ordinance become effective irfirnediately,an emergency i s hereby declared to exist and this ordinance shall be effective immediately upon passage and adoption.
