HomeMy WebLinkAboutORD483ORDINANCE NO.483 SECTION I AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE,CHAPTER 2 MAYOR AND COUNCIL,BY ADDING ARTICLE 2-17 APACHE JUNCTION TRANSPORTATION BOARD;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AS FOLLOWS: IN GENERAL That the Apache Junction City Code,Chapter 2 MAYOR AND COUNCIL, be amended by adding Article 2-17 APACHE'JUNCTION TRANSPORTATION BOARD,to read as follows: ARTICLE 2-17 APACHE JUNCTION TRANSPORTATION BOARD Section Section Section Section Section Section Section Section 2-17-1 Creation 2-17-2 Membership and Terms of Office 2-17-3 Salaries and Personal Expenses 2-17-4 Officers 2-17-5 Meetings 2-17-6 Vacancies 2-17-7 Removal of 2-17-8 Duties Section 2-17-1 Creation Members There i s hereby established an Apache Junction Transportation Board which shall act as an advisory body to the City Council to promote,develop and make recommendations on matters relating to transportation matters affecting the City of Apache Junction including,but not limited to,all limited -access freeway systems,county transportation systems,purchase of right-of-way,general street construction planning and rapid transit systems. Section 2-17-2 Membership and Terms of Office A.The Apache Junction Transportation Board shall consist of eight (8) members who shall be appointed by the Mayor and approved by the City Council.The eight members shall consist of the chairman of the Economic Opportunities Action Team,the chairman of the Planning and Zoning Commission,the Apache Junction Chamber of Commerce Transportation Committee Chairman and Vice Chairman,one (1)member of the City Council, two (2)citizen members,and the Mayor who shall be an ex -officio member. B.All members of the board shall have the power to vote on all matters presented to them for consideration,except the Mayor who shall serve as a non -voting ex -officio member. C.The two citizen members of the board shall be residents of the City of Apache Junction and shall serve for a term of three (3)years with the first terms commencing on the date of appointment and expiring on June 30,1989.Thereafter,all terms shall be for three (3)years each. All other members of the board shall serve as long as they are acting in the capacity of position so named. D.A Technical Advisory Committee consisting of the City Manager,City Clerk, Director of Public Works,Director of Planning,Economic DevelopmentSpecialistandothermembersofthecitystaffasdeemedappropriate by the City Council shall assist the board when necessary.The City Clerk shall act as recording secretary of the board. Section 2-17-3 Salaries and Personal Expenses Members of the Apache Junction Transportation Board shall receive no salary or other remuneration for their services in such capacity and shall not be entitled to personal expenses incurred by them in the discharge of their official duties ORDINANCE NO.483 PAGE ONE OF THREE except to the extent,purposes and amount such expense i s first authorized and approved in advance by the City Council. Section 2-17-4 Officers The board shall elect a chairman and a vice chairman from among its members to serve for a period of one (1)year.The vice chairman shall preside at meetings in the absence of the chairman. Section 2-17-5 Meetings The board shall establish a regular meeting day and time and shall meet at least once each month.Special meetings may be called as required.All meetings shall be held i n compliance with the Open Meeting Act as provided for i n A.R.S.§38-431 and as amended.A quorum shall consist of four (4)voting members for the trans- action of all business. Section 2-17-6 Vacancies Vacancies shall be filled by the City Council in accordance with Section 2-17-2 for the unexpired term of the affected member. Section 2-17-7 Removal of Members Members of the Apache Junction Transportation Board shall serve at the pleasure of the City Council and may be removed by the Mayor with the concurrence of the Council.A member shall not be absent from any regular board meetings for more than three (3)consecutive times without a reasonable excuse.After the absence from three consecutive regular meetings,the remaining members of the board shall vote to retain or recommend to the City Council that the absentee member be relieved of his duties on the board. Section 2-17-8 Duties The board shall make recommendations to the City Council regarding general policy and programs pertaining to limited -access freeway systems,county transportation systems,purchase of rights -of -way,general street construction planning,and rapid transit systems,and in other matters pertaining to transportation as deemed necessary. SECTION II.REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is,for any reason,held to be invalid or unconstitutional by the decision of any court of competent juris- diction,such decision shall not affect the validity of the remaining portions thereof. SECTION IV EMERGENCY CLAUSE I t being necessary for the preservation of the peace,health and safety of the City of Apache Junction,Arizona,an emergency is hereby declared to exist and this ordinance shall become immediately operative and i n force from and after the date of adoption.
