REGULAR MEETING
APRIL 15, 2014
The regular meeting of the City Council of the City of
Apache Junction, Arizona, was held on April 15, 2014, at the
Apache Junction City Council Chambers pursuant to the notice
required by law.
CALL TO ORDER
Mayor Insalaco called the meeting to order at 7:00 p.m.
INVOCATION
Councilmember Wilson gave the Invocation.
PLEDGE OF ALLEGIANCE
Councilmember Waldron led the Pledge of Allegiance.

ACCEPTANCE OF CONSENT AGENDA
)Vice Mayor Barker MOVED
THAT THE CONSENT AGENDA BE ACCEPTED AS PRESENTED; AND
THAT THE AWARD OF BID FOR MULTI -GENERATIONAL CENTER FITNESS
EQUIPMENT, INSTALLATION, TRAINING AND SERVICE BE AWARDED TO
ADVANCED EXERCISE EQUIPMENT THROUGH STATE CONTRACT #021512-LFF
IN AN AMOUNT NOT TO EXCEED $104,257.69; AND
THAT RESOLUTION NO. 14-20, A RESOLUTION OF THE MAYOR AND CITY
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AUTHORIZING THE
CITY TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH MARICOPA
COUNTY DEPARTMENT OF TRANSPORTATION FOR MAINTENANCE OF MERIDIAN
DRIVE FROM SOUTHERN AVENUE TO MCDOWELL ROAD, BE APPROVED.
Councilmember Rizzi SECONDED
THE MOTION.
VOTE:Unanimous.
The motion carried.
AWARDS, PRESENTATIONS AND PROCLAMATIONS
None.
ANNOUNCEMENT OF CURRENT EVENTS
Councilmember Waldron announced the Little League season is
underway and they have dedicated the two fields at Superstition
Mountain Elementary School to the military POWs/MIAs and Richard
Favi.
Vice Mayor Barker commented last fall Apache Junction became the
first city to pass the Start by Believing Resolution which
recognizes domestic violence.Today the same resolution was
read into the record for the State House of Representatives,
making it 29 cities plus the state and moving onward.
Councilmember Evans announced last week at Central Arizona
College, in conjunction with Central Arizona College, Mountain
Health and Wellness, the City of Apache Junction, Community
Awareness Against Family Abuse and CBD Church, a youth matters

summit was held and attended by 60-70 students.They talked
about wanting to start a youth commission.
Councilmember Evans announced there was a farmers' market on
Saturday at Earth Heart Park.They estimated 800 people had
been there.Due to the theft from the park earlier, Ace
Hardware is donating solar lights for the garden and Bonnie
Plants will replace the plants and trees that were stolen and
provide plants and soil for the future growing season.They
also had an Earth Day Celebration and released lady bugs.She
thanked Jamie Sullivan and Dave who assisted.The last event
will be May 3, the Salsa Pinata farmers' market day.
Mayor Insalaco commented Councilmember Evans had been talking
about the social justice forum at Central Arizona College.The
students would like to have a youth council set up like a city
council.If they have any ideas they present them to the city
council.He would like to look into it.
CITY MANAGER'S REPORT
City Manager George Hoffman read a note from the police chief
regarding a phone call he received from the sister of a lady who
went missing earlier in the week and was recovered safely.

Mayor Insalaco opened the
public hearing on the item.There being no one wishing to
speak, he closed the public hearing and called for any further
discussion.There being no further discussion, he closed the
item as it was a public hearing only with no action at this time
and moved on to the next item.

NEW BUSINESS
DESIGNATION OF ACTING MAYOR IN
ACCORDANCE WITH APACHE JUNCTION
CITY CODE SECTION 2-2-3 ACTING
MAYOR

Connelly briefed the council on the item.
City Manager George Hoffman
stated his encouragement to the council would be that they name
a position until some standard time at which it would be
renewed, as in every two years, three years or whatever.Kathy
is talking about a foreseen period of time where there will be a
gap.He is concerned, for emergency operations purposes, about
an unforeseen time.One may be off for a wedding and the other
is taken ill, and staff needs to work with the mayor to declare
a curfew.He does not know if they want to synchronize it with
the next appointment of a vice mayor or a month after that.It
is up to the council.He encouraged them to not think of it in
terms of just this summer, but fdr a longer period of time.
Mayor Insalaco called for a
motion.
Councilmember Wilson asked
what the current date is right now if they are trying to assign
it to tie in with the vice mayor.
City Attorney Joel Stern
asked if he meant what the current process is.

Councilmember Wilson asked if
it is after an election.
City Attorney Joel Stern
stated right now the vice mayor is chosen right after an
election.There is no procedure for an alternate.He checked
Robert's Rules as that is what is supposed to govern and it does
not really talk about an alternate.In the past when the mayor
and vice mayor were gone for a meeting, the council would just
pick someone.That has happened in the past.It happened when
the mayor was gone and Mr. Eck was gone.Mr. Dietz volunteered
to do it.He took the gavel and started the meeting.
City Manager George Hoffman
asked if it would be a legitimate motion to say that the person
serves until they are replaced.It could not exceed their term
of office.
City Clerk Kathleen Connelly
stated it would probably be better to pick a beginning date and
have it run concurrent with the term of the mayor.For
instance, May 1, 2014, until the new mayor is seated in 2017.
Mayor Insalaco commented in
January because the election is in August.

commented we are not even sure of the date.She would tie it to
when a new mayor is seated.
Mayor Insalaco called for a
motion.
Councilmember Wilson MOVED
THAT JEFF SERDY BE DESIGNATED AS ACTING MAYOR ACCORDING TO
APACHE JUNCTION CITY CODE SECTION 2-2-3 FOR THE TIME PERIOD
BEGINNING TODAY'S DATE AND ENDING WHEN THE MAYOR IS RE-ELECTED
OR RE -APPOINTED.
Councilmember Rizzi SECONDED
THE MOTION.

stated that would be when a new mayor is seated.
Councilmember Wilson
corrected it to WHEN A NEW MAYOR IS SEATED.
VOTE:4-3 (Mayor Insalaco and Councilmembers Waldron and Evans
voted in opposition.)
During the vote Vice Mayor Barker commented she would have
preferred to have seen the next person with the most time on a
council doing this job.
During the vote Councilmember Evans commented she thinks anybody
up here would be able to take this job.Her only consideration
and thought in this is time of availability of the person.
The motion carried.
DIRECTION TO STAFF
None.
SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES
Vice Mayor Barker MOVED THAT
AN EXECUTIVE SESSION AT 5:45 P.M. AND A WORK SESSION AT 7:00
P.M. BE HELD ON MONDAY, MAY 5, 2014, IN THE CITY COUNCIL
CONFERENCE ROOM AND CITY COUNCIL CHAMBERS RESPECTIVELY; AND
THAT AN EXECUTIVE SESSION AT 5:45 P.M. BE HELD ON TUESDAY, MAY
6, 2014, IN THE CITY COUNCIL CONFERENCE ROOM.
Councilmember Evans SECONDED
THE MOTION.
VOTE:Unanimous.
The motion carried.

)Mayor Insalaco adjourned
the meeting at 7:25 p.m.
Consent Agenda Items are as follows:
1. Acceptance of Agenda.
2. Approval of Minutes of Regular Meeting of April 1, 2014.
3. Bid for new cardio fitness equipment for the Apache Junction
Multi -Generational Center.Staff recommends the bid be
awarded to Advanced Exercise Equipment in an amount not to
exceed $104,257.69, and requests permission to move forward
with procurement.
4. Proposed Resolution No. 14-20, authorizing the city to enter
into an intergovernmental agreement with Maricopa County
Department of Transportation for the maintenance of Meridian
Drive from Southern to McDowell.
