HomeMy WebLinkAbout2011-03-15 City Council Regular MinutesCITY COUNCIL REGULAR MEETING MARCH 15, 2011 The regular meeting of the City Council of the City of Apache Junction, Arizona, was held on March 15, 2011, at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Insalaco called the meeting to order at 7:00 p.m. INVOCATION Councilmember Wilson gave the Invocation. PLEDGE OF ALLEGIANCE Vice Mayor Dietz led the Pledge of Allegiance. ROLL CALL Councilmembers Present:Mayor Insalaco Vice Mayor Dietz Councilmember Barker Councilmember Eck Councilmember Serdy Councilmember Wilson Staff Present: (Councilmember Coleman was absent.) REGULAR MEETING OF THE CITY COUNCIL MARCH 15, 2011 PAGE 1 OF 10 ACCEPTANCE OF CONSENT AGENDA )Councilmember Eck MOVED THAT THE CONSENT AGENDA BE ACCEPTED AS PRESENTED; AND THAT APPROVAL BE GIVEN TO THE AMENDMENT TO THE EXISTING AGREEMENT BETWEEN THE ARIZONA DEPARTMENT OF COMMERCE AND THE CITY OF APACHE JUNCTION, CONTRACT NUMBER R016-10-01, TO ALLOW THE CITY TO USE THE BALANCE OF GRANT MONIES AWARDED IN LATE 2009 FOR ENERGY EFFICIENCY AND CONSERVATION IMPROVEMENTS PROJECTS TO CITY FACILITIES; AND THAT AUTHORIZATION BE GIVEN FOR THE MAYOR TO SIGN THE AGREEMENT; AND THAT THE AWARD OF BID FOR PW 2010-19, PURCHASE AND INSTALLATION OF ABOVE GROUND FUEL TANKS BE AWARDED TO FRYE CONSTRUCTION IN THE AMOUNT OF $182,770.61 WITH A 10% CONTINGENCY FOR UNFORESEEN CHANGE ORDERS IN THE AMOUNT OF $18,277.06 FOR A TOTAL AMOUNT NOT TO EXCEED $201,047.67; AND THAT AUTHORIZATION BE GIVEN FOR THE MAYOR TO SIGN THE AGREEMENT PENDING FINAL APPROVAL AS TO FORM BY THE CITY ATTORNEY; AND THAT ITEM NO. 5 BE MOVED TO DIRECTLY BEFORE CALL TO THE PUBLIC. Councilmember Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. ANNOUNCEMENT OF CURRENT EVENTS Councilmember Wilson announced he attended the Antique Engine and Tractor Show last weekend.He assisted them at the gate by giving them their buttons as they paid for their admission.He started talking to an individual from Australia who came specifically to Arizona to attend some of our events.He just came the week before so he was unaware of Lost Dutchman Days. He came out with 7 other people that are here for a month.It shows they knew what was going on out here and our activities. He commented he loved our community and the area and they are coming back next year.The show felt it had a record turnout this year, possibly close to 5,000 people over the two days. They will be expanding it next year. REGULAR MEETING OF THE CITY COUNCIL MARCH 15, 2011 PAGE 2 OF 10 Councilmember Barker commented she went to the Boys and Girls Club spaghetti dinner on Thursday along with the mayor, the city manager, the police chief and half the town.It was marvelous. It was all the spaghetti you could eat and lots of people to talk to.There was great artwork.The club is doing a great job.They were trying to pay for the mural that was painted behind the stage.They are hoping they made enough to do that. Councilmember Barker commented she, Councilmember Wilson and Vice Mayor Dietz on Friday attended the police awards ceremony. It was a lovely ceremony, and she congratulated all the men and women who got the awards.It was a privilege for her to be there. AWARDS, PRESENTATIONS AND COMMUNICATIONS None. CITY MANAGER'S REPORT City Manager George Hoffman commented on an article in the East Valley Tribune on parks that recognized our parks and recreation department facilities, and commented on the various events happening in the city including the opening of Mountain Health and Wellness, the improvements being done on Plaza Drive, the landscaping and drainage improvements being done on Apache Trail, significant improvements taking place at Central Arizona College, and infrastructure improvements taking place on Winchester. PUBLIC HEARINGS APPLICATION FOR A TEMPORARY EXTENSION OF PREMISES FOR ELKS LODGE #2349 )City Clerk Kathleen Connelly briefed the council on the item. Mayor Insalaco requested the applicant address the council. Ralph from the Elks Club addressed the council. REGULAR MEETING OF THE CITY COUNCIL MARCH 15, 2011 PAGE 3 OF 10 Mayor Insalaco asked if they were having a car show there. Ralph stated they will be having their annual car show.It will be the second annual show with the same set up they have had in the past year.The cars will be set up on the west side near the highway. Mayor Insalaco opened the public hearing on the item.There being no one wishing to speak, he closed the public hearing and reopened the item to council discussion.There being no further discussion, he called for a motion. Vice Mayor Dietz MOVED THAT THE APPLICATION FOR A TEMPORARY EXTENSION OF PREMISES FOR ELKS LODGE #2349, SUBMITTED BY DENNY WALTER FOR APRIL 2, 2011, BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF LIQUOR LICENSES AND CONTROL. Councilmember Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. APPLICATION FOR A SPECIAL EVENT LIQUOR LICENSE FOR COMMUNITY ALLIANCE AGAINST FAMILY ABUSE )City Clerk Kathleen Connelly briefed the council on the item. Mayor Insalaco requested the applicant address the council. A representative of Community Alliance Against Family Abuse addressed the council.She stated this is the large fundraiser that they have every year.They have had it three times.It will be at Dolce Vita. Councilmember Barker MOVED THAT THE APPLICATION FOR A SPECIAL EVENT LIQUOR LICENSE FOR COMMUNITY ALLIANCE AGAINST FAMILY ABUSE, SUBMITTED BY COURTNEY KLEINEBREIL FOR MARCH 26, 2011, BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF LIQUOR LICENSES AND CONTROL. Vice Mayor Dietz SECONDED THE MOTION. VOTE:Unanimous. The motion carried. RESOLUTION NO. 11-01, DECLARING A PORTION OF A PUBLIC ROADWAY EASEMENT ON THIRD AVENUE BETWEEN SOLANA ROAD AND STARR ROAD AS SET FORTH IN EXTINGUISHMENT CASE EX- 11 -01 IS NO LONGER NECESSARY FOR PUBLIC USE )Councilmember Wilson excused himself from this item. City Engineer Giao Pham briefed the council on the item. Vice Mayor Dietz asked if the applicant had gotten approval from the neighbors. REGULAR MEETING OF THE CITY COUNCIL MARCH 15, 2011 PAGE 5 OF 10 Councilmember Eck MOVED THAT RESOLUTION NO. 11-01, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, DECLARING THAT PORTIONS OF PUBLIC ROADWAY EASEMENTS LOCATED ON THIRD AVENUE FROM SOLANA ROAD TO STARR ROAD AND DESCRIBED IN EXTINGUISHMENT CASE EX -11-01 ARE NO LONGER NECESSARY FOR PUBLIC USE AS PUBLIC ROADWAY EASEMENTS AND ARE HEREBY EXTINGUISHED AS PRESENT OR FUTURE PUBLIC RIGHTS -OF -WAY, BE APPROVED. Councilmember Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. OLD BUSINESS None. NEW BUSINESS None. COUNCIL DIRECTION TO STAFF None. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES Vice Mayor Dietz MOVED THAT AN EXECUTIVE SESSION AT 5:45 P.M. AND A WORK SESSION AT 7:00 P.M. BE HELD ON MONDAY, APRIL 4, 2011, IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS, RESPECTIVELY; AND THAT AN EXECUTIVE SESSION AT 5:45 P.M. BE HELD ON TUESDAY, APRIL 5, 2011, IN THE CITY COUNCIL CONFERENCE ROOM. Councilmember Barker SECONDED THE MOTION. VOTE:Unanimous. CONSENT AGENDA ITEM NO. 5 PROPOSED RESOLUTION NO. 11-07: DECLARING AND ADOPTING THE RESULTS OF THE MARCH 8, 2011 PRIMARY ELECTION AND RECALL ELECTION )Vice Mayor Dietz thanked Mr. Eck for 14 years of dedicated service to the city.The city has been his top priority and they have a special bond.When he was first appointed to the council in 1998, there was no orientation or anything for a new councilmember.Mr. Eck showed him where to pick up his book and where to sit down for the meetings.He had no idea.R.E. helped him through a lot and taught him a lot.He loves him and thanked him for everything he has done for the council and the city. Mayor Insalaco stated he thinks that goes for all the council. Councilmember Serdy commented he would not be sitting here if not for Councilmember Eck.He encouraged him to run.He did not think he could do it but Councilmember Eck said he should do it.He would not be here if not for R.E. Councilmember Wilson commented he wanted to also say thanks to Mr. Eck.Even though they did get some information when they first came on board the city council, R.E. was the individual who helped him out with the aspect of what goes on behind the scenes and what they need to be involved with.He also talked to him about running for city council.He basically cornered him, told him he was very active in the community and needed to step forward and do it. He thanked him for his leadership and assistance. Mayor Insalaco thanked him for saying that and added he believes they all feel the same about Councilmember Eck. Councilmember Eck commented he appreciated what all of them have said.He has been on the council 14 years now.It has been a large part of his life, REGULAR MEETING OF THE CITY COUNCIL MARCH 15, 2011 PAGE 7 OF 10 especially when his 22 -year -old son looked at him and said he was not going to be on the council anymore.That is all he has known.He was 6 or 7 when he got on.He really appreciated working with professional people of different backgrounds.He believes the last 4 years has been the best council he has had the opportunity to work with.There are several different backgrounds and he believed it showed on several different issues.A successful organization cannot be run without successful staff.He thinks the city is at the top end.He was fortunate enough to be here when the city hired Joel; it was shortly after he took office.Then eventually George came along.They are both blessings.He remembered Bryant coming on, and the new people like Giao and Chief Monahan.He is very impressed with who we have, like Jeff Bell in parks and recreation and Spencer with the library.We have true professionals, and that is what makes an organization work.It has been an absolute pleasure and honor to serve.He feels like this has been a family after a decade -and -a -half.He appreciated it very much, and thanked them for all their kind words.They will be seeing him around.He is not leaving Apache Junction. Mayor Insalaco closed the discussion and called for a motion. Vice Mayor Dietz MOVED THAT RESOLUTION NO. 11-07, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, PINAL AND MARICOPA COUNTIES, ARIZONA, DECLARING AND ADOPTING RELUCTANTLY THE RESULTS OF THE PRIMARY, SPECIAL AND RECALL ELECTIONS HELD ON MARCH 8, 2011, BE APPROVED. Councilmember Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. CALL TO THE PUBLIC: None. REGULAR MEETING OF THE CITY COUNCIL MARCH 15, 2011 PAGE 8 OF 10 ADJOURNMENT )Mayor Insalaco adjourned the meeting at 7:22 p.m. Consent Agenda Items are as follows: 1. Acceptance of Agenda. 2. Approval of Minutes of Regular Meeting of March 1, 2011. 3. Consideration of approval of amendment to the existing agreement between the City of Apache Junction and Arizona Department of Commerce (Contract Number R016-10-01). 4. Consideration of award of contract to Frye Construction, Inc. for the purchase and installation of above -ground fuel tanks in an amount not to exceed $201,047.67. 5. Consideration Resolution No. 11-07: declaring and adopting the results of the March 8, 2011 Primary Election and Recall Election.
