REGULAR MEETING
APRIL 20, 2010
The regular meeting of the City Council of the City of
Apache Junction, Arizona, was held on April 20, 2010, at the
Apache Junction City Council Chambers pursuant to the notice
required by law.
CALL TO ORDER
Mayor Insalaco called the meeting to order at 7:07 p.m.
INVOCATION
Councilmember Wilson gave the Invocation.

AWARDS, PRESENTATIONS AND COMMUNICATIONS
Mayor Insalaco presented Certificates of Graduation to the 17
graduates of the twelfth Citizen Leadership Institute.
Mayor Insalaco read a proclamation designating May 16-22 as
National Public Works Week and presented it to Public Works
Director David Fern.
Mayor Insalaco read a proclamation designating May as Foster
Care Month.
Mayor Insalaco read a proclamation designating April 18-24 as
National Volunteer Week and presented it to Community Resource
Coordinator Suzanne Strong.She then gave a brief presentation
on the volunteers at the police department.
ANNOUNCEMENT OF CURRENT EVENTS
Councilmember Barker reminded everyone that this weekend there
is the Lost Dutchman State Park Ride with sign up at
Superstition Harley.Relay for Life is also this weekend.They
are two very good things going on this weekend to help others.
Relay for Life starts at 6:00 p.m. on Saturday.

Councilmember Wilson thanked the parks and recreation department
for assisting with the Second Touch of the Black Stallion
Literacy program this last Friday.Senator Rebecca Rios and
Pinal County Supervisor Bryan Martyn were in attendance, along
with Councilmember Barker, Assistant City Manager Bryant Powell,
City Attorney Joel Stern, Public Safety Director Jerald Monahan
and other staff members.They had only 3 schools but were able
to spend more time with the kids.They unfortunately had an
accident out there, and he expressed in his prayer that Pam will
recover real fast from a severe back injury.
CITY MANAGER'S REPORT
City Manager George Hoffman commented on an error that needs to
be corrected on city taxes that appeared in the Apache Junction
Independent today and the transition of the MOA-1 Street Program
from a full program to one essentially on life support.As part
of the city manager's report, Assistant to the City Manager Matt
Busby gave a brief update on the corporate sponsorship program.
Vice Mayor Eck asked if the sponsors of Allied Waste, Mediacom
and the other are sponsoring the fireworks completely.
Assistant to the City Manager Matt Busby stated they have gained
enough funds through the sponsorship program to cover the cost
of the event.It is important to note that the revenues from
the program are seen as another line of revenue in the general
fund.It will fund all city programs, not just the fireworks.
It was marketed for the sponsor to participate in the Fourth of
July Celebration.
Councilmember Serdy asked what would happen to the money from
the people who donated in the buckets.
Assistant to the City Manager Matt Busby stated that money is
being set aside to be used directly for the Fourth of July
event.That is why he distinguished it from the sponsorship
money.The sponsorship money can'be -used for all city events,:
not just the Fourth of July, although much of it will be.
Councilmember Dietz commented he thinks it is a great program
It is a plus -for the city and for the companies out there.They
get recognition and it really helps the city in a rough time..

With this economic situation we are in, we can still continue
with the Fourth of July and a few other things.He thinks it is
beneficial for us.
Mayor Insalaco asked if the surrounding cities have canceled
their Fourth of July or if they have got them back.If they
have canceled them, the 5,000 attendance will double.
Assistant to the City Manager Matt Busby stated he does not know
who has canceled or continued their Fourth of July celebrations.
He could some research as it could impact ours.
Mayor Insalaco commented it would be nice to know which of our
neighbors were going to have any so that we can be prepared.
When they find out we are having them, people will come.
Councilmember Dietz commented they saw a large increase last
year when a few of the cities dropped them.
Vice Mayor Eck commented last year was the first time he saw
vehicles parked on the side of the freeway.
Assistant to the City Manager Matt Busby stated the city sees
this as its premiere event and he can only see it growing.
City Clerk Kathleen Connelly reminded the city manager that as
part of his report on this, he was going to thank Councilmember
Dietz for becoming the champion of this program almost three
budget years ago.

RESOLUTION NO. 10-10, AUTHORIZING
SUBMISSION OF GRANT 'APPLICATION TO
FORT MCDOWELL YAVAPAI NATION FOR

Hacker briefed the council on the item.
Councilmember Serdy commented
they already have several trees lit up down there in front of
the old Bashas'.It will give you an idea of how it will look.
When the sun goes down, people now quit shopping or going to the
restaurants.Project how good it will look once that area is
lit up.He suggested they not stop there but go down the Trail
and light everything up like other cities are doing.He
believes it will add to the city and the business.
Councilmember Dietz asked if
we received funds a couple of years ago from the Yavapai Nation
that goes along with this.
Grants Specialist Roger
Hacker stated that is correct. They helped us fund phase 1 of
the project which installed cement infrastructure and some of
the lighting at the focal point.
Mayor Insalaco closed the
discussion and called for a motion.
Councilmember Barker MOVED
THAT RESOLUTION NO. 10-10, A RESOLUTION OF THE MAYOR AND CITY
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, APPROVING THE
SUBMITTAL OF A GRANT APPLICATION TO THE FORT MCDOWELL YAVAPAI
NATION FOR PROPOSITION 202 FUNDS, BE APPROVED.
Councilmember Dietz SECONDED

RESOLUTION NO. 10-09, AUTHORIZING
INTERGOVERNMENTAL AGREEMENT WITH
PINAL COUNTY FOR PARTICIPATION IN

Vice Mayor Eck asked if Pinal
County is considering Apache Junction a smaller community.
Program Coordinator Heather
Patel stated when the Department of Energy started the Energy
Efficiency and Conservation Block Grant Program, they looked at
an old census population number.That is how they determined we
were of a smaller size community.
Councilmember Barker
commented that it was then an advantage to us.
Program Coordinator Heather
Patel stated that it was in this case.
Mayor Insalaco closed the
discussion with no further comments and called for a motion.
Councilmember Coleman MOVED
THAT RESOLUTION NO. 10-09, A RESOLUTION OF THE MAYOR AND CITY
COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AUTHORIZING AN
INTERGOVERNMENTAL AGREEMENT WITH PINAL COUNTY FOR PARTICIPATION
IN THE PINAL COUNTY ENERGY EFFICIENCY INITIATIVE, BE APPROVED.

PRESENTATION AND DISCUSSION ON
DRAFT 2010 GENERAL PLAN

Director Brad Steinke briefed the council on the item.
Councilmember Coleman asked
if all of the triggers for a major plan amendment are in state
law.

Brad Steinke commented everything that he has told them up until
now has been state law.We deviate from state law in what we
decide is a major amendment and what is a minor amendment.
Currently they have it if 100 acres or more is to be changed,
that constitutes a major amendment.Another trigger is when
going from commercial land use to residential, or from
residential to commercial, or commercial to industrial, or
single family to multi -family, those changes are significant and
trigger a major general plan amendment if it involves 10
contiguous acres or more.Minor amendments are everything else.
The first two public meetings on the plan are already scheduled;
no presentations will be given, they will have booths staffed by
city employees from various departments who will answer
questions.
Vice Mayor Eck commented he
thinks it is an awesome plan for public input.
Councilmember Coleman
commented he agrees with the 10 acres, and he thanked him for
finally getting the map right.
Councilmember Dietz thanked
him for all the hard work his department has done.
Mayor Insalaco closed the
item with no further discussion and moved on to the next item.

AND THAT AN EXECUTIVE SESSION AT 5:45 P.M. BE HELD ON TUESDAY,
MAY 4, 2010, IN THE CITY COUNCIL CHAMBERS.

CALL TO THE PUBLIC:
Mr. John Kantowski, 835 W. Windsong, Apache Junction, thanked
everyone for their concern for his wife; requested the Black
Stallion Literacy Program continue; and commented on the
professionalism of the fire district.
Ms. Juanita Sivara Corbin, 1617 S. Cortez #44, Apache Junction,
addressed the council regarding two roads that needed to be
repaired.
Ms. Lucille Colon, 1617 S. Cortez, Apache Junction, addressed
the council regarding 16th Avenue and 18th Avenue needing
repair.
Mr. Elliott :Fisher, 547 E. Quail, Apache Junction, addressed the
council regarding corporate sponsorships; the Capital Facilities
Plan tax; requested taxes be put to a _vote; and his concern on
non-profit organizations not reporting what they do.
Councilmember Dietz directed staff to look at the street repair
issue and see what can be done.
Vice Mayor Eck commented he hoped the street repair issue is in
the city and not in the county as she said so that something can
be done, and that he understands Mr. Fisher's concern over large
donations from organizations, but it is up to the council.He •
thinks it is great.Generally you gc,to a corporation land they
say no, they are corporate and they donate elsewhere.He thinks
it is good that we finally got some of the money.He added Lost
Dutchman Days is doing well, having given $80,000 to local
charities last year.
