HomeMy WebLinkAbout2009-02-03 City Council Regular MinutesCITY COUNCIL REGULAR MEETING FEBRUARY 3, 2009 The regular meeting of the City Council of the City of Apache Junction, Arizona, was held on February 3, 2009, at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Insalaco called the meeting to order at 7:00 p.m. INVOCATION Mayor Insalaco gave the Invocation. PLEDGE OF ALLEGIANCE The Boys and Girls Club of the East Valley -Apache Junction Branch led the Pledge of Allegiance.They followed it with a song commemorating the anniversary of statehood for Arizona. ROLL CALL Councilmembers Present:Mayor Insalaco Vice Mayor Eck Councilmember Barker Councilmember Dietz Councilmember Serdy Councilmember Wilson Staff Present: (Councilmember Coleman was absent.) Superintendent Liz Langenbach ACCEPTANCE OF CONSENT AGENDA )Vice Mayor Eck MOVED THAT THE CONSENT AGENDA BE ACCEPTED AS PRESENTED. Councilmember Dietz SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS, PRESENTATIONS AND COMMUNICATIONS None. CALL TO THE PUBLIC: Ms. Christa Rizzi, 1755 S. Sombrero, Apache Junction, addressed the council regarding crack or meth pipes being sold in the city and requested an ordinance be drafted to ban their sale in the city. Mr. Noel Benoist, 900 N. San Marcos #79, Apache Junction, addressed the council regarding a board appointee entering his mobile home park to take pictures of where he lived and also the State Bar complaint filed against the city attorney. Mr. Elliott Fisher, 547 E. Quail, Apache Junction, addressed the council regarding a transportation link with Mesa, bike paths, and that Call to the Public speakers should be shown from the front on the cable channel in the future. Mr. Wayne Standage, 1920 E. 20th Avenue, Apache Junction, addressed the council to comment on the team and other speakers at previous meetings during Call to the Public. Councilmember Barker stated her son had already brought this to her attention and she had advised the police chief who will tell you what she had discovered to this point.She is not willing to let it go as there is something wrong with this.They need to do something.Elliott came up, spoke and was very upset that the camera was not on his face.She noticed he left immediately so evidently his was purely political that he wanted to be seen. She thanked Wayne for his levity. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 3, 2009 PAGE 2 OF 8 Councilmember Serdy commented since it is drawing close to an election, many people use this time to campaign.He thinks that is why the cameras are turned.He wondered where the speakers are the rest of the year as they only come now. Vice Mayor Eck requested staff follow up and get an answer on the concern about the pipes that are being sold.He knows it was being looked at, that it was on the radar, and that the chief was aware of it.He had asked a teenager about them who he is hoping is buying tobacco only.The teenager said he is seeing them in all the communities.He does not know if they have any leverage to forbid them; he thinks they should.They know what they are used for.He would like to see them address them and have something in writing that tells them what their legal standpoint is.If they can get them out of the community, he thinks they should try.As for board members, there are 15 boards and commissions.Unless a board member is convicted of a crime, we should not have concerns about a board member taking a picture of someone's trailer because of a political thing. Regarding transportation, for 10 years now Valley Metro will not go east of Power Road.He wondered if they should get that in writing.They have inquired as far as the bus lines.And if they have to worry about where the cameras are going in Call to the Public, or who is being heard, then they need to consider removing it from the regular meetings and not even hearing that. It is not a campaign forum, it is a concern for the community. Mayor Insalaco requested the news articles from Christa Rizzi in order to forward them to the police chief and commented that Call to the Public is not a right, it is a privilege that this city and every other city provides. ANNOUNCEMENT OF CURRENT EVENTS Vice Mayor Eck announced that at last week's Central Arizona Association of Governments meeting there was a presentation on the incentive program.Out of the possible $800 plus billion dollars, only $30 million was going to infrastructure, with only one to two projects as of this date.It is unlikely a town or city will get any money.There will be over $180 billion in incentives for state and BLM land, and it would be a good time to ask for money if you have a project for BLM land. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 3, 2009 PAGE 3 OF 8 CITY MANAGER'S REPORT City Manager George Hoffman announced Dan Taylor of the senior center, Grants Specialist Roger Hacker, Public Works Director David Fern and he met with Pinal County consultants to discuss their review of transit in the East Valley; and that the economic stimulus project is in a high degree of flux but the city will try to position itself on the best information available.Department of Public Safety Director Jerald Monahan gave a presentation on the development of their strategic. plan. Recreation Superintendent Liz Langenbach gave a presentation on the parks and recreation program. PUBLIC HEARINGS BINGO LICENSE APPLICATION FOR GOLDEN ACRES ACTIVITIES GROUP )City Clerk Kathleen Connelly briefed the council on the item. Mayor Insalaco requested the applicant address the council. Mr. James Froelich, 1150 N. Delaware #120, addressed the council.He stated they were only wondering about how they were supposed to keep track of the money.They will have 10 games, divide the money for the first 9 games, and then the remaining funds will have a blackout bingo for the last game.That will take care of the money. Mayor Insalaco commented that is the way most of them do it. City Clerk Kathleen Connelly stated they need to check with the state. Councilmember Barker commented he needs to check with the people who can give him the information on exactly how that should be done. Mr. James Froelich stated there are people in the park who have done it before. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 3, 2009 PAGE 4 OF 8 Mayor Insalaco commented that is basically how it is done in most of the parks.They put whatever is left into a blackout game. Vice Mayor Eck asked if they could be given a number for them to call to ask that question. City Clerk Kathleen Connelly stated it is on their application. Mayor Insalaco opened the public, hearing on the item. Mr. Elliott Fisher, 547 E. Quail, addressed the council.He stated it seems like they need a business license for everything, for renting rooms and bingo licenses.He asked how much this bingo license cost. City Clerk Kathleen Connelly stated this is not a business license.It is a bingo license that is required by the State of Arizona in order for this park to have a bingo game. Mr. Elliott Fisher stated they required the same _business license for him for a roommate. Mayor Insalaco and Vice Mayor Eck asked what that has to do with a bingo license. Mr. Elliott Fisher stated it has everything to do with it.There is a license and a fee for everything. Councilmember Dietz commented this is for the State of Arizona.It is not the same. Mayor Insalaco commented it is the State of Arizona.It is not required by the city. Mr. Elliott Fisher stated the bingo license is administered by the city. REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 3, 2009 PAGE 5 OF 8 City Clerk Kathleen Connelly stated it is not. Mr. Elliott Fisher stated they are asking for a business license in Apache Junction. Councilmember Barker commented this is from Title 5, Chapter 4, Article 2 of the Arizona Revised Statutes.We are meeting the Arizona Revised Statutes requirements by having this hearing.That is what we are doing. Mr. Elliott Fisher stated he stands corrected.Business licenses are ridiculous in Apache Junction. Mayor Insalaco closed the public hearing with no one else wishing to speak.He reopened the item to council discussion.There being no discussion, he called for a motion. Vice Mayor Eck MOVED THAT THE BINGO LICENSE APPLICATION FOR GOLDEN ACRES ACTIVITIES GROUP BE RECOMMENDED FOR APPROVAL TO THE ARIZONA DEPARTMENT OF REVENUE, BINGO SECTION. Councilmember Dietz SECONDED THE MOTION. VOTE:Unanimous. The motion carried. OLD BUSINESS None. NEW BUSINESS None. COUNCIL DIRECTION TO STAFF REGULAR MEETING OF THE CITY COUNCIL FEBRUARY 3, 2009 PAGE 6 OF 8 None. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES Councilmember Dietz commented the executive session and work session on Monday, February 16, 2009, have been cancelled due to observation of the Presidents' Day Holiday.He MOVED THAT AN EXECUTIVE SESSION AT 6:00 P.M. AND A WORK SESSION AT 6:00 P.M. BE HELD ON TUESDAY, FEBRUARY 17, 2009, IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS, RESPECTIVELY. Councilmember Barker SECONDED THE MOTION.
