HomeMy WebLinkAbout2009-03-03 City Council Regular MinutesCITY COUNCIL REGULAR MEETING MARCH 3, 2009 The regular meeting of the City Council of the City of Apache Junction, Arizona, was held on March 3, 2009, at the Apache Junction City Council Chambers pursuant to the notice required by law. CALL TO ORDER Mayor Insalaco called the meeting to .order at 7:00 p.m. INVOCATION Councilmember Wilson gave the Invocation. PLEDGE OF ALLEGIANCE Councilmember Dietz led the Pledge of Allegiance. M9 AND M10 AND THAT THE MAYOR BE AUTHORIZED TO ADJOURN THE MEETING IF ANYONE BECOMES DISORDERLY, UNCIVIL OR MAKES PERSONAL ATTACKS DURING CALL TO THE PUBLIC; AND THAT RESOLUTION NO. 09-01, A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AUTHORIZING SUBMISSION OF A GRANT APPLICATION TO THE UNITED STATES DEPARTMENT OF JUSTICE OFFICE ON VIOLENCE AGAINST WOMEN FOR PARTICIPATION IN ITS FISCAL YEAR 2009 SAFE HAVENS SUPERVISED VISITATION AND SAFE EXCHANGE GRANT PROGRAM, BE APPROVED, AND THAT AUTHORIZATION BE GIVEN TO SETTLE TROTTER VS. CITY,PINAL COUNTY SUPERIOR COURT NO. CV200701363, IN THE AMOUNT OF $48,070, WITH THE CITY'S PORTION BEING $1,000 AND ARIZONA MUNICIPAL RISK RETENTION POOL INSURANCE'S PORTION BEING $47,070. Councilmember Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. AWARDS, PRESENTATIONS AND COMMUNICATIONS Mayor Insalaco read a proclamation designating March 11-16, 2009, as "American Veterans Traveling Tribute Week" and presented the proclamation to Mike Ferguson. ANNOUNCEMENT OF CURRENT EVENTS Councilmember Serdy announced that he and Grants Specialist Roger Hacker, Public Works Director David Fern, and City Manager George Hoffman met with the staff of Congressman Jeff Flake a week -and -a -half ago to discuss the assistance of the congressman in potentially deeding the BLM land with the rodeo grounds to the city or getting the restrictions eased, plus qualifying for any stimulus funds.The staff seemed eager to look into it and coordinate with Senator Kyl's office. REGULAR MEETING OF THE CITY COUNCIL MARCH 3, 2009 PAGE 2 OF 6 Councilmember Serdy announced flyers have been made up to take donations at the Community Development Corporation and Main Street for the bricks for the focal point.He will be going to different community events with the flyers.The lights will be on in 2 weeks. Councilmember Wilson announced the second touch of the Black Stallion Literacy program will be taking place March 28 for 7 schools in the East Valley. Vice Mayor Eck announced the Lost Dutchman Days Parade was nice but long for him, and the Lost Dutchman Days Rodeo was also nice. CITY MANAGER'S REPORT City Manager George Hoffman commented the parks system presentation will be moved forward to a subsequent future meeting. Grants Specialist Roger Hacker and Program Coordinator Heather Patel gave a presentation on the American Recovery and Reinvestment Act of 2009, also known as the economic stimulus package. PUBLIC HEARINGS None. OLD BUSINESS None. NEW BUSINESS None. COUNCIL DIRECTION TO STAFF None. SELECTION OF MEETING DATES, TIMES, LOCATIONS, AND PURPOSES REGULAR MEETING OF THE CITY COUNCIL MARCH 3, 2009 PAGE 3 OF 6 Councilmember Dietz MOVED THAT AN EXECUTIVE SESSION AT 6:00 P.M. AND A WORK SESSION AT 7:00 P.M. BE HELD ON MONDAY, MARCH 16, 2009, IN THE CITY COUNCIL CONFERENCE ROOM AND CITY COUNCIL CHAMBERS, RESPECTIVELY; AND THAT AN EXECUTIVE SESSION AT 6:00 P.M. BE HELD ON TUESDAY, MARCH 17, 2009, IN THE CITY COUNCIL CONFERENCE ROOM. Councilmember Barker SECONDED THE MOTION. VOTE:Unanimous. The motion carried. CALL TO THE PUBLIC: Mr. Thom Parker, Vice President, Apache Junction Police Officers Association, Executive Chairman of Arizona Labor Council, P.O. Box 330, Apache Junction, addressed the council to speak in support of the home rule option and as the representative of the Apache Junction Police Officers Association gave the current council their endorsement and advised they had always been against the recall. Mr. Mike Weller, 471 W. 21st Avenue, Apache Junction, addressed the council to speak in support of the current council. Ms. Janice Stenglein, 733 W. Windsong, Apache Junction, addressed the council regarding the stimulus fund, urged people to vote in support of home rule, and urged people to see the Vietnam Wall while the tour is here. Mr. Wayne Standage, 1920 E. 20th Avenue, Apache Junction, addressed the council regarding the recall team half-truths and spoke in support of the current council. Mr. John Kantowski, 835 W. Windsong, Apache Junction, addressed the council to urge people to vote in support of home rule and announced that an acrobatic circus is coming to town at the greyhound park. REGULAR MEETING OF THE CITY COUNCIL MARCH 3, 2009 PAGE 4 OF 6 Mr. Charles Duffy, 768 S. Warner Drive, Apache Junction, addressed the council to urge the city to purchase things made in America. Mr. Elliott Fisher, 547 E. Quail Avenue, Apache Junction, addressed the council regarding the ballot being poorly designed and the cost of the recall. Mr. Noel Benoist, 900 N. San Marcos #79, Apache Junction, addressed the council regarding the negative image of the city and the city using its water aquafirs for revenue. Mrs. Shannon Flynn, 305 N. Acacia, Apache Junction, addressed the council regarding remarks made in a blog about the early ballots. Mr. Dan Wald, 560 N. Rennick Drive, Apache Junction, addressed the council in support of home rule and the current city council. Mr. Lenny Cota, 2200 N. Delaware Drive #110, Apache Junction, addressed the council in support of the current city council. ADJOURNMENT )Mayor Insalaco adjourned the meeting at 8:06 p.m. Consent Agenda Items are as follows: 1. Acceptance of Agenda. 2. Acceptance of Minutes of Regular Meeting of February 17, 2009. 3. Resolution No. 09-01, authorizing submission of a grant application to the United States Department of Justice on Violence Against Women for participation in its Fiscal Year 2009 Safe Havens Supervised Visitation and Safe Exchange Grant Program. 4. Council authorization to settle Trotter vs. City,Pinal County Superior Court No. CV200701363 (City contribution - $1,000; Insurance carrier - $47,070).
