Manager John 'White Public Works Manager Shane Kiesow Human Resources Director Liz Riley Accountant John Petges • SPECIAL MEETING OFITHE'CITY COUNCIL JUNE 25, 2007 PAGE 1 OF 21 DISCUSSION ON TENTATIVE BUDGET FOR: FISCAL YEAR -2007-2008 )City Manager George Hoffman briefed the council on the item.He stated they had a draft budget that has been updated.The contingency fund has been increased to $700,000 from $422,000 to provide for the ability to address the pay compression issues for officers, corporals and sergeants in the amount of $305,000 at the council's sole.discretion.That includes the salary and benefits associated with the salary.It includes the ability to provide for:amid-year review and.possible market adjustment for officers, corporals and sergeants.It also provides for the: senior program Councilmember Dietz -had talked about in the• amount of $17,000.The IEG sponsorship has not been provided_ with a separate revenue source; if'they wish to do that at -a - later date the council may take it out of the contingency budget.The goal tonight is tentative budget adoption. was about $900,000 carried over. stated there.is not. $900,000 is. Vice Mayor Eck asked if there City 'Manager George Hoffman Vice Mayor Eck asked what the City Manager George Hoffman stated the $874,000 -item is not projected for utilization. Vice Mayor Eck commented he would like to keep it at that.He would like to think of it as Capital Facilities Plan II money if possible. City Manager George Hoffman stated that a council discussion.:Staff had heard about acceleration of the existing Capital Facilities Plan. Vice Mayor Eck commented he thinks the way to do it, as a prime example, is the way they had done it the first time and it came out remarkably well where SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 2 OF 21 they got several projects done.They had to raise $6,000,000 in order to borrow $7,000,000.That $7,000,000 is going to sunset and they might go back to the .2% tax.He thinks they have the opportunity that if this is put away, they will get more than just something at the rodeo ground and maybe another area of the community gets a park or whatever the needs are.He would like to see them start saving for a second plan while they can.He asked if they could go after it if it is an emergency. City Manager George Hoffman stated they can. Vice Mayor Eck commented he would like to keep it as a thought process for capital facilities plan money. Councilmember Dietz commented he thought they were keeping all the one-time fees for capital facilities projects. Vice Mayor Eck stated they are not.Only 20% of the development fees go towards the capital facilities plan.It is just not enough money.They have to save and borrow, especially if they want to do an amphitheater or indoor building at the rodeo grounds. Councilmember Dietz commented they need a new animal control building.They could also look at a library extension south of the freeway once things get going there in about 5 years. Vice Mayor Eck commented if south of the freeway does not go, they could use this money on a library addition.By saying they are going to put money away now, they will get some ideas on what they need, like a dog park.They could have 4 or 5 projects.He would like to start now. Councilmember Dietz asked if there was enough in the contingency that, if needed, they could start picking up supplies for a pandemic. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 3 OF 21 Vice Mayor Eck asked if he meant something from the fire department, like the masks. Councilmember Dietz commented they have already done that.He would like to save about $20,000 to $30,000 to start purchasing some of the items for that just in case something does happen.He would like to take the lead and stay up on top of it. Vice Mayor Eck asked what items he would like to purchase. City Manager George Hoffman stated it could be masks or emergency food rations for employees working 12 to 18 hour shifts and their wanting to be able to feed them and keep them on their feet and on the road.The fire district has allocated resources so that they could keep themselves operational if the food supply systems were interrupted.This would keep the core emergency workers literally fed. Councilmember Dietz stated it would be things of that nature that could be stockpiled here. Mayor Insalaco asked where it would be stored if they did this. City Manager George Hoffman stated he would work with the chief on that; it could be stored at the police department and the city manager's office. Business Advocate Janine Hanna-Solley commented she had already budgeted $20,000 in this budget for pandemic supplies. Mayor Insalaco asked where that is. Business Advocate Janine Hanna-Solley stated it is in non -departmental. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 4 OF 21 Councilmember Barker commented under the information about the $305,000, it says if the council is desirous of addressing this so it will be effective July 1 that it should be requested along with this motion tonight. City Manager George Hoffman stated if they want to address that issue, they can direct staff to remove it from the nondepartmental and put it over into the police department. Vice Mayor Eck asked if that is the compression issue. City Manager George Hoffman stated that is correct. Councilmember Dietz asked if it has to be in the police department's budget to be utilized. City Manager George Hoffman stated it would be the cleaner if they did that and it makes clear their policy decision.There are other ways they could work it or if they did not want to make that decision tonight, it could be figured out.If they are prepared to make it a policy tonight, that would be the most straightforward way to do it. Vice Mayor Eck asked what his recommendation is on that. City Manager George Hoffman stated he has not made a recommendation to them on that matter because it only affects one group of employees and not all the employees.He sought to point out to them the market issues that the city faces and what he believes to be the chief's legitimate need to lateral people in and the morale issues that creates if he cannot lateral outside people in.He also pointed out the morale issues if it is done for the one group of officers, corporals and sergeants and not for the rest of the department, and the morale issues if it is done for the one group and not the rest of the organization. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 5 OF 21 Vice Mayor Eck asked what the most difficult position to fill in the city is. City Manager George Hoffman stated he believes that as a class, numerically, the single largest staffing issue we have is the filling of police officers. Councilmember Severs commented that within that department the most difficult part would be the three positions being discussed. City Manager George Hoffman stated for outside recruitment they would mostly look at officers.The people inside the department have worked hard and studied and they have been able to fill corporal and sergeants positions from in house.They are going directly to market for officer positions. Councilmember Serdy asked Councilmember Dietz if he had a plan for how they would rotate perishable items for those purchased towards a pandemic. Councilmember Dietz asked what he meant by perishable items. Councilmember Serdy commented even MREs have a shelf life.They are not forever.He asked what they would do if they do not have an emergency for 6 years. Vice Mayor Eck commented they could talk to churches or other volunteer organizations. Councilmember Serdy commented they could do that when they have a year of shelf life left so that they could keep it rotated. Councilmember Dietz commented they would have to figure out some type of rotation plan if that is the case. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 6 OF 21 City Manager George Hoffman stated it is a legitimate question.They would need to have a rotational program; that plan is not in place now.They do not have any substantive stock of MREs now, if any. Councilmember Serdy commented he has been talking to different officers about a police dog. He thinks it is a good idea and that the city needs it.He would like to look into whether they should have a dual purpose dog or just a sniffing narcotics dog that can be appropriated later. City Manager George Hoffman commented if council is interested in that topic now or if staff knows they are interested they will bring it back. Councilmember Serdy commented he believes there is $40,000.If they go with the more universal dog and there is a $5,000 or $6,000 more expense, he asked if the money is in there for that. City Manager George Hoffman stated they would make that work. Councilmember Dietz asked if that is called contingency. City Manager George Hoffman stated the police department has a multi -million dollar budget and if the decision was to evolve it slightly to a $45,000 dog instead of a $40,000 dog they could make it work.If they know they are going to do that now, the ideal thing would be to budget for it now. Vice Mayor Eck asked if the D.A.R.E. program is coming back in the fall. Chief Walp stated from the audience that it would be. Councilmember Dietz commented it would not hurt to budget for it so that they have it in the SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 7 OF 21 tentative budget.They do not need to use it, but they cannot go over the tentative. Mayor Insalaco commented he would rather see a dual purpose dog than just the one. City Manager George Hoffman suggested they hear from the chief on that and then make their decision. Councilmember Dietz commented that would be good.They are not sure if it is something they need to go from $40,000 to $45,000 in the budget.They could pick up the other $5,000 somewhere else. Chief Walp commented he only put a drug sniffing dog in the budget; that is what he presented ,to the city manager.He had not thought about a bite dog at that time.His position on a bite dog is a policy decision.He can present a good argument for a drug sniffing dog in this community.He does not think he has a valid position at this junction for a bite dog.As a policy decision it would be the council's call.He advised the council there is liability involved with a bite dog.A dog is a dog.There are cases where dogs have turned on handlers and have not stopped biting when they should.It does not happen often but it does happen. He has been told Phoenix Police Department has paid out millions of dollars in civil liability because of that.It does not mean it will occur here, but it is his responsibility to tell them that it is an issue.It does not cost that much more a month in risk management to have one. City Attorney Joel Stern stated it is about $65 to $75 a month for either type of dog. There are some limitations on the damages, such as a $10,000 limit on if the dog died. Vice Mayor Eck commented they are covered for $70 a month if a dog goes overboard and really injures someone. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 8 OF 21 City Attorney Joel Stern stated they would be covered for the damages that would accrue. Councilmember Dietz asked what the deductible is. City Attorney Joel Stern stated there is a $50,000 deductible under the policy for damages if the city is found liable.Defense costs, attorney costs, experts, if there is a trial, would be picked up by Southwest Risk. Councilmember Serdy commented they use Final County's dog if they use one now and it is a dual purpose dog. Chief Walp commented they have used Final County's dog; they have not used them that much. There are some other avenues, too.They do not want to have to keep calling them in.The important thing about a sniff dog is that the Supreme Court made the decision that the dog has a free sniff, meaning if they stop a car for speeding they can take the dog out and run it around the car.If it hits on the car, they can stop it for probable cause, get a .search warrant and go in. He believes they will find a lot of that.When a SWAT team goes in a house, the drug dealers hide it under floor boards, in ceilings and behind panels.If the dog is sent in, they will sniff it out and they will have to forfeit their boats, cars and houses.The bite dog is another dynamic to it.They could use it but there is some liability with it.A dual purpose dog would be fine and a lot of agencies have them and a lot of agencies do not.It is a viable product to have. Councilmember Dietz commented he does not think they need to increase it.If it needs to go to $45,000, they can go to that and leave them with the decision on how to do it in the best way for the city. Vice Mayor Eck asked if there are any staff that have worked with dogs. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 9 OF 21 Chief Walp commented Officer Shikany had worked with dogs when he worked for Maricopa County Sheriff's Department; he is not sure if anyone else has. Vice Mayor Eck asked if they would need additional training dollars. Chief Walp stated that is all in the budget.The money is there for the dog, but if they are going to go with a dual purpose dog, there is no substitute for quality.They should get a good dog, not mediocre one, that will last a long time, listen and pair up good with its handler. Councilmember Severs asked if he missed the conversation about making the midyear adjustment. Councilmember Dietz stated it is in there. Councilmember Severs asked if it states that the adjustments will be made no matter what the findings are or if there is a certain percentage. City Manager George Hoffman stated there are lots of forward looking issues on how adjustments will be made.They have not thought them through at the staff end and they have not communicated with the council on them.He is partial to making sure that any action that staff might contemplate would be consistent with council's policy preference.He would like to have an opportunity for communication on that.The $100,000 is included in the nondepartmental budget. Vice Mayor Eck commented that just like any other study, if it comes back that we are under, or close to it, then it fits the need.If not, then does not. City Manager George Hoffman stated that is correct. Mayor Insalaco opened the public hearing on the item. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 10 OF 21 Mr. John Petges, accountant from the Finance Department, asked for some clarification as far as'how the compression would be implemented. City Manager George Hoffman commented he believes it will essentially be for years of service.A 6 -year officer who might be at a 3 -year step might move to a 6 -year step. Mr. John Petges stated that if they go by years of service, then they are leaving out that although this person may have 5 years of service, there may be a reason that he is not as high up as he should be because of disciplinary action or whatever.They are also not looking at going directly from a C to a C.They may also move that person, just because he has 5 years, from a C to an E.He thinks that would be unfair for everyone. Vice Mayor Eck asked how they would even know if there was previous disciplinary action. City Manager George Hoffman stated there was a time John is referencing when there was a so- called "pay for performance". Vice Mayor Eck commented that was horrible.If they are going to talk about that, then they should wipe the slate clean. City Manager George Hoffman stated all the signs point out that the employee who broke their neck and just worked as much as any human being can, and the employee who just skated by and avoided getting fired and got a pay that was commensurate with that, that this action would now erase all that. Vice Mayor Eck commented that was continuous from 1.5% because there was morale problems or what have you, compared to the 3% or 2.5% that other people averaged.They are not really comparing the whole.He does not know how they would go back. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 11 OF 21 City Manager George Hoffman stated their orientation is not now differentiating in pay that way.The vice mayor used the vernacular in describing the effectiveness of the other system.We are experimenting with another. Vice Mayor Eck commented they went to a step in 2005, and they are at a step now.They should have dealt with that in 2005. City Manager George Hoffman stated they are looking to have much more meaningful, accurate and productive methods of evaluating and communicating with employees about performance. Mayor Insalaco commented that overall the step system should work. Vice Mayor Eck commented they should have found it in 2005 because that is when they went to the steps. Councilmember Severs commented that with the chief and their recordkeeping, if that is the case there is documentation of that and that person would be dealt with. Vice Mayor Eck commented that the step is not a guarantee.He asked if they are guaranteed a step increase if they have a disciplinary problem. Councilmember Serdy commented it would be more like the military. City Manager George Hoffman stated the pay system and the performance system are separated. If someone has performance issues, they will continue to address those issues. Mr. John Petges commented he was just stating a fact that if they want to move a person, and he is in a C now, and his range moves up 3 and he stays in a C, SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 12 OF 21 then he does not have any objection to that.If they move him up from a C to an E just because he has 5 years of service, then he would have an issue with that. Vice Mayor Eck commented they are doing what most organizations do not do.It is unusual to do what they are doing. Mr. John Petges stated he is just making a comment. Councilmember Barker commented the compression that they are talking about is actually saying that if they have 5 years they will therefore move 5 years on the compression regardless of what the issues are instead of saying you were retained at step "x" and you will move to that step "x" on the new schedule.She asked if that is what they are saying. City Manager George Hoffman stated he believed the Apache Junction Police Officers Association has proposed to them essentially that they place the officers in a years -of -service system.That is the policy choice before them. Vice Mayor Eck commented he agreed with what Mr. Petges is saying.The 5 year person could have managed to survive and only go up 2 steps and now they will be at the same pay as an outstanding 5 year employee because they are moving it up. Councilmember Serdy commented he is saying it is more like the military.Sad Sack was in the military for 40 years and he was always a private. Councilmember Wilson commented he thought it originally was that if they were in a C step that if, without compression, they were getting to the closest step with the percent pay raises that they were going to be getting.The compression portion was to keep them in the C step regardless as to what the nearest step up was in the pay increase.If the percentage was to put them to a D, which is SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 13 OF 21 closer to their pay, then that is where they would go.They would stay in the general area of where they were at.Now they are talking about moving them into a five year system. Vice Mayor Eck commented he was talking about the employee advisory team original discussion without the compression. City Manager George Hoffman stated there are 2 core approaches in front of them.One is what the vice mayor referenced, which is the employee classification/compensation team and they gave one set of recommendations.That is what Janine stood up and talked about, putting employees to the nearest dollar placement without disadvantage.That is where an employee could go from a C to an A; the employee would still be going up in pay.Then there is the Apache Junction Police Officers Association's recommendation on fixing the problem that would essentially place the employee with years of service.One thing that this does allow, theoretically, is if the chief were seeking to bring in a 5 year employee from the City of Tempe, Tempe might pay a little bit more than we do, but he could presumably bring that 5 year employee in and pay them at the 5 year mark.It would be competitive with bringing the person here and not end up being paid more than our 5 year employee.If our 5 year employee is only at the 2 year mark, it is tough for him to bring in a 5 year employee and have two different levels of pay.That is one argument the association has made to him and it is one of the deficiencies they should think about when they consider the issue. Mayor Insalaco commented he does not want this to turn out like a merit system like they had before. Vice Mayor Eck and Councilmember Dietz commented they are not. City Manager George Hoffman commented he thinks it completely achieves the objective of not having it look like a merit system. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 14 OF 21 Councilmember Dietz commented it is just the opposite. Vice Mayor Eck commented they fought hard in 2005 to get a step plan; he thinks the step plan is what is necessary.If they stay in the step plan long enough, it will take care of the compression.But it takes years. City Manager George Hoffman stated that is a generally true statement unless the position happens to be one where salaries are escalating rapidly.In a situation where salaries are escalating rapidly, you have what happened to us.Two years ago we were precisely in the middle of the labor market.In 2 years time for police officers we went from being in the middle of the market to being at the bottom of the market.It is about a $5,000 to $5,500 slide in starting pay and presumably in maximum pay as well.If they go with the nearest dollar placement, the challenge is that if the person is the C employee now, and the pay range is bumped up, they are now an A employee.They have not been able to move through the range with the step system because the market is moving faster than the pay range.For most jobs that will not happen.For police officers, it is an even shot that it may continue for awhile.There is a shortage around the nation.He has passed around a number of articles describing the competitive labor market for police officers.Human resources and the class/comp team have recommended moving each year and making a market adjustment so that we keep up with that. Vice Mayor Eck asked if that is for the whole organization. City Manager George Hoffman stated that is correct.He does not have a theoretical challenge to that point of view, only one of balancing a budget. His concern is that they all get caught up in this and think that this will keep forever.He is deeply concerned that before they get in this window of time between where we are now and when the growth really picks up, they could really have some tight budget years.He could find himself in the unenviable position of saying not only no cost of living adjustment, but SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 15 OF 21 that they might not be able to fund another step every year.He does not know that; they would have to wait to see how the revenues come in.He requested they keep that in mind.If that becomes an assumption in the minds of the employees, we just may or may not be able to deliver. Vice Mayor Eck stated a neighbor requested he ask about what they do as far as from high school up through Central Arizona College.Apparently one has to be twenty-one to be a law enforcement officer.Outside the D.A.R.E. program, what is done to get young minds to want to become a police officer.There is such a demand for it. Chief Walp stated the amount of people that are interested in law enforcement is not where it used to be decades ago. Vice Mayor Eck commented everyone wants to be a firefighter. Chief Walp stated the fire lines are pretty thick.The bottom line is it is a tough job with a lot of frustration and anxiety.They get shot at, sued and hollered at.It is not as popular as it used to be and that has brought down the dynamics.As far as trying to instill, locally they have the explorer program.A lot of the universities have criminal justice programs.Beyond that, there is not too much. Vice Mayor Eck asked how they get the senior in high school to go, even some of the explorers. Some of them do not want to do that.It is corny to them at seventeen.At 18 or 19, when they start college and they are looking for a career, they should know about that Central Arizona College program. Chief Walp stated the school resource program is good; just having an officer on campus to observe and give them a role model to look at.Not everyone that wants to be a cop goes into the explorers.It is another environment and they do not know who they are really having an effect on.He does not know of anything beyond that locally of SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 16 OF 21 trying to instill or encourage people in.If they want to be a police officer, they have to have that desire in their gut.It is not a job just -to get a check or they.will not survive.They have to really want to be a police offiCer with a burning desire in their hearts.Those that have -that gravitate to it.They go out and preach but it still has to come from the heart.A lot of the laterals they had, once they started doing backgrounds, were terrible.They were washed out.They have to qualify. Councilmember Severs commented his nephew went right into the marines upon graduating from high school.By the time he was twenty-one he was so far up in the marines that they took him into the police force almost instantly.It was an easy way for him to get in; they paid for all the schooling.It is good way to do it, but the desire has to be there first. Chief Walp commented- this happens all the time.Whenever you have a war, you have a good supply of people at that time.He understands there are some police departments that are doing that now.They are digging into that pool of applicants from the men and women coming home. He thinks they will see a little bit of a -flood of tha-Lighen we get out of Iraq. Mr. Steve Kridler, police department, addressed the council.He stated they are looking at correcting problems that have been developing over a number of years as far as the compression issues.They will have a 6 year officer making less than a 2 year officer.They are not rewarding the people for the service that they have.He commented there is the possibility of disciplinary issues, but .that is -a supervisory issue and they are the ones that need to make the determination whether or not the step is allowed in the next year.It is based on their:review. Vice Mayor Eck commented it is pretty slim for that to happen. Mr. Steve Kridler agreed, but it is a supervisory issue and it can be taken up by the SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 17 OF 21 supervisor and/or department head.It proceeds as it is right now. Mayor Insalaco closed the public hearing and reopened the item to council discussion. Vice Mayor Eck asked Doug Dobson if they were doing $7,000,000 in roadwork this coming fiscal year. Dobson stated that is correct. had enough staff for that. Dobson stated he thought so. Public -_Works Director Doug Vice Mayor Eck asked if he Public Works Director Doug Vice Mayor Eck asked if he had enough equipment so that they are capable of doing what they have to do. Public Works Director Doug Dobson stated they do. Vice Mayor Eck commented he was curious.They do not often do $7,000,000 in street maintenance or new paving. Public Works Director Doug Dobson stated they are doing more with contracts than they have in the past. Vice Mayor Eck asked when the library expansion starts. City Manager George Hoffman stated it is underway. Vice Mayor Eck asked when they start the new employees for the library. SPECIAL MEETING OF THE CITY COUNCIL JUNE 25, 2007 PAGE 18 OF 21 City Manager George Hoffman stated that will be a key issue the next budget year. if she was okay for now. stated she was. Bell if he was alright. Jeff Bell stated he was. Vice Mayor Eck asked Pam Loui Library Director Pam Loui Vice Mayor Eck asked Jeff Parks and Recreation Director Vice Mayor Eck asked David Alexander if he needed another judge. City Magistrate David Alexander stated he did not; maybe next year. Mayor Insalaco closed the discussion and moved on to the next item. CONSIDERATION OF PROPOSED RESOLUTION 07-23, ADOPTION OF TENTATIVE BUDGET FOR FISCAL YEAR 2007-2008 AND GIVING NOTICE OF FINAL BUDGET ADOPTION )City Clerk Kathleen Connelly briefed the council on the item.She stated they have added the final adoption date of July 9.If the council wishes to change that, they need to make an amendment to the resolution. There was general discussion on the date and time.The consensus was to change the time to 5:00 p.m. Mayor Insalaco closed the discussion and called for a motion.
